Ff City Council Meeting of `f-/- X ACTION: BY: MOORPARK CITY COUNCIL AGENDA REPORT TO: The Honorable City Council FROM: Jennifer Mellon, Senior Management Analyst DATE: March 17, 2009 (CC meeting of April 1, 200 — SUBJECT: Consider Resolution Updating the Solid Waste Collection Service Fee Schedule and Rescinding Resolution No. 2008-2768 BACKGROUND In November, 2008, a staff report was presented to City Council regarding the Solid Waste Rate Adjustments that would take effect on January 1, 2009. While staff was presenting the discussion item, it was noticed that the hauler discounted rate on the report was incorrect and staff brought the error to the attention of City Council. DISCUSSION Staff is requesting Council adopt Resolution 2009- which updates the Solid Waste Service Fee Schedule and rescind Resolution 2008-2768. During the initial report, the hauler discounted rate was calculated at $48.50; but the correct rate is $48.45. Correcting the rate on the solid waste rate calculation sheet, the residential rates were not affected; however, the Commercial bin rates were. Commercial rates reported in the original report were higher than the actual rates that were put into effect by the Haulers on January 1, 2009. Both Moorpark Rubbish and Waste Management made the proper rate adjustments; staff had incorrect numbers on the rate schedule attached to Resolution 2008-2652 which was adopted December 2008. Both the new Resolution (Attachment "A") as well as the original Resolution (Attachment "B") are attached herein for review. The residential rates have not changed and the commercial rates have been revised. A merged worksheet has also been attached (Attachment "C") for comparison purposes. Attachment "A" — Resolution 2009- Attachment "B" — Corrections in Legislative Format 1)60068 RESOLUTION NO. 2009- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, UPDATING THE SOLID WASTE COLLECTION SERVICE FEE SCHEDULE AND RESCINDING RESOLUTION NO. 2008-2768 WHEREAS, the City provides residential and commercial solid waste and recycling collection services; and WHEREAS, on September 18, 2002, the City Council granted exclusive franchise agreements with G.I. Industries and Moorpark Rubbish Disposal for the collection, transportation, recycling, and disposal of solid waste in residential and commercial — industrial areas within City limits; and, WHEREAS, the Franchise Agreements provide for adjustments to the service fee schedule pursuant to a specified formula; and WHEREAS, the City Council declares its intention of maintaining reasonable rates for collection, management, and disposal of solid waste and recyclables within the City limits. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. Effective January 1, 2009, the monthly residential solid waste, recycling, and green waste collection rate was implemented as shown in Exhibit 1". SECTION 2. Effective January 1, 2009, the commercial, industrial, and multi- family solid waste, recycling, and composting bin collection rates were implemented as shown in Exhibit "1". SECTION 3. Effective January 1, 2009, the temporary bins and roll-off/drop box rates for solid waste, recycling, and composting bin services were implemented as shown in Exhibit 1". ". SECTION 4. Effective January 1, 2009, the annual Solid Waste Management Fee for exemption to the required solid waste collection service shall be $24.40. SECTION 5. The City's Residential Franchise Agreements Service Fee Schedules (Exhibit "F" of Residential Franchise Agreements) are hereby replaced with the attached Service Fee Schedule upon the effective date of this resolution. )00069 Resolution No. 2009- Page 2 SECTION 6. The City's Commercial Franchise Agreements Service Fee Schedules (Exhibit "F of the Commercial Franchise Agreements) are hereby replaced with the attached Service Fee Schedule upon the effective date of this resolution. SECTION 7. This Resolution hereby rescinds Resolution 2008-2768 in its entirety upon the effective date of this resolution. SECTION 8. The City Clerk shall certify to the adoption of the resolution and shall cause a certified resolution to be filed in the book of original resolutions. PASSED AND ADOPTED this 1 st day of April, 2009.
