Section 5.1 of the General Plan Land Use Element and Chapter 17.64 of the Zoning
Ordinance provide the City's policies and regulations for residential density bonuses (a
residential unit density greater than that of the underlying zone) when affordable
housing is provided. Affordable housing as defined by the Zoning Ordinance is housing
restricted for 30 years or longer to very low and low income households through an
affordable housing agreement between the City and developer.
Current City General Plan Land Use Element policies limit the density of a project with a
density bonus for affordable housing to a maximum of 20 units per acre. The Zoning
Ordinance provides a 25% density bonus when a certain percentage of affordable
housing is provided. State law (Government Code Section 65915 et seq.) on density
bonuses has been amended recently, requiring cities to provide higher density bonuses
(up to 35 %) depending upon the percentage and type of affordable housing provided.
State law also requires density bonuses for moderate income affordable housing. Cities
can provide greater density bonuses than required by State law if they choose.
In order to update the General Plan and Zoning Ordinance to be consistent with State
law and provide greater flexibility in the use of density bonuses for affordable housing,
staff recommends that the City Council initiate a General Plan Amendment and Zoning
Ordinance Amendment to allow for the study and consideration of changes to the City's
policies and regulations. Section 17.44.050 of the Zoning Ordinance requires City -

resolution of City Council. A draft resolution to initiate consideration of amendments to
the City's density bonus provisions in the General Plan and Zoning Ordinance is
attached for Council consideration.

RESOLUTION NO. 2009-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, DIRECTING THE PLANNING COMMISSION
TO STUDY, HOLD A PUBLIC HEARING AND PROVIDE A
RECOMMENDATION TO THE CITY COUNCIL ON AN AMENDMENT TO
THE GENERAL PLAN LAND USE ELEMENT SECTION 5.1 RELATED
TO DENSITY BONUS PROVISIONS AND AN AMENDMENT TO
CHAPTER 17.64, DENSITY BONUS PROVISIONS, OF TITLE 17,
ZONING, OF THE MOORPARK MUNICIPAL CODE
WHEREAS, Section 17.44.050 of the Municipal Code provides that the City
Council may initiate proceedings to consider amendments to the General Plan and
Zoning Ordinance by the adoption of a resolution of intent; and
WHEREAS, the City Council wishes to initiate proceedings to consider a General
Plan Amendment and Zoning Ordinance Amendment that would amend City policies
and regulations (Section 5.1 of the Land Use Element and Chapter 17.64 of the Zoning
Ordinance) related to density bonus provisions.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. INITIATION OF PROCEEDINGS: The City Council hereby
authorizes the initiation of proceedings to consider a General Plan Amendment and
Zoning Ordinance Amendment that would amend Section 5.1 of the Land Use Element
and Chapter 17.64 of the Zoning Ordinance related to density bonus provisions.
SECTION 2. DIRECTION TO PLANNING COMMISSION: The Planning
Commission is hereby directed to study, hold a public hearing, and provide a
recommendation to the City Council on this matter.
SECTION 3. CITY CLERK CERTIFICATION AND FILING: The City Clerk
shall certify to the adoption of this resolution and shall cause a certified resolution to be
filed in the book of original resolutions.
