Affordable housing as defined by the Zoning Ordinance is housing restricted for 30 years or longer to very low and low income households through an affordable housing agreement between the City and developer. Current City General Plan Land Use Element policies limit the density of a project with a density bonus for affordable housing to a maximum of 20 units per acre. The Zoning Ordinance provides a 25% density bonus when a certain percentage of affordable housing is provided. State law (Government Code Section 65915 et seq.) on density bonuses has been amended recently, requiring cities to provide higher density bonuses (up to 35 %) depending upon the percentage and type of affordable housing provided. State law also requires density bonuses for moderate income affordable housing. Cities can provide greater density bonuses than required by State law if they choose. In order to update the General Plan and Zoning Ordinance to be consistent with State law and provide greater flexibility in the use of density bonuses for affordable housing, staff recommends that the City Council initiate a General Plan Amendment and Zoning Ordinance Amendment to allow for the study and consideration of changes to the City's policies and regulations.
