City Council Meeting Of 5'G -AM 9 ACTION: MOORPARK CITY COUNCIL AGENDA REPORT TO: The Honorable City Council FROM: Jennifer Mellon, Senior Management Analyst DATE: April 23, 2009 (CC meeting of May 6, 2009) SUBJECT: Consider SB 1016—Solid Waste Disposal Measurement Act: New AB 939 Compliance Reporting Methodology SUMMARY Council is bein g asked to receive and file the. 2007 AB 939 solid waste diversion compliance report(Attached). The entire reporting system has changed with the passage of SB 1016 which will be explained in detail below. BACKGROUND Back in 1989, the Integrated Waste Management Act was passed which required jurisdictions to report the tonnage of waste diverted from disposal in the landfill. It has been the goal for many years to divert 50% of generated material from the landfill and Moorpark has been successful in meeting this goal. In 2006, the City's reported diversion rate was 56% and this rate has been maintained since the baseline disposal report was generated in 2000. Reporting diversion numbers is a tedious process which takes 18—24 months in which to gather various diversion data and report. The purpose of SB 1016, which implements the per capita disposal measurement system, is to make the process of goal measurement as established with AB 939 reporting simpler, more timely, and more accurate. SB 1016 builds on AB 939 compliance requirements by implementing a simplified measure of jurisdiction performance by changing to a disposal-based indicator, the per capita disposal rate, which uses only two factors: a jurisdiction's population (or in cases of industrial jurisdictions, employment) and its disposal as reported by disposal facilities. DISCUSSION The California Integrated Waste Management Board (CIWMB) has always focused on jurisdictional program implementation and SB 1016 will assist with this process by shifting 000227- i Honorable City Council May 6, 2009 Page 2 emphasis on using calculated generation and estimated diversion to using actual annual disposal numbers. The 50% diversion requirement still stands; it is just measured with a different method. In summary, instead of measuring diversion rates, the City will now measure pounds disposed per person per day and the goal will be to annually reduce this number. Council and Staff have become accustomed to the diversion number and comparing that diversion number to other jurisdictions. Our diversion of 56% will no longer be used nor will our jurisdiction be compared to other jurisdictions in terms of diversion. Each jurisdiction will have a unique disposal rate of pounds/person/day (PPD) that is calculated per that jurisdictions data. The Moorpark 50% per capita disposal target rate for 2007 has been calculated at 6.0 PPD and the actual annual rate for 2007 has been reported at 4.2 PPD.
