SUBJECT: Acceptance of Storm Drainage Easement
Tract 3403
California Community Builders
PROPOSED ACTION
Consider the acceptance of a storm drainage easement in conjunction
with the requirements of development of tract 3403 , California
Community Builders .
BACKGROUND INFORMATION
In July , 1984 , this matter was originally considered by the City
Council . After discussion, the City Council directed staff to
request staff to review the possibility of requiring the developer
to install a concrete drain qr pipe across the Edison easement .
The City Engineer reviewed the tract conditions and discussed
the situation with the County Public Works Agency , who originally
set the conditions for tract 3403. From this review it was
determined that the developer is not required to provide any
permanent improvements .
Subsequently , the City' s Inspector discussed this situation with
the developers on both sides of the Edison easement and, in response ,
Urban West Communities provided some substantial improvements to
the previously existing condition including , removing a pepper tree ,
cleaning up miscellaneous construction debris , and regrading and
shaping the earthen ditch. It should be emphasized that the
foregoing activities were provided by Urban West Communities even
though they were under no obligation to do so. There is no further

work contemplated on this earthen drain.
PROPOSED MOTION
By minute action, authorize acceptance of the storm drainage
easement and subsequent recordation thereof.

Easement Deed for Storm Drainage Purposes from
California Community Builders, Inc. ,
Re: Knotty Pine Street, Tract 3403
PROPOSED ACTION
Accept the proposed easement deed.
BACKGROUND INFORMATION
At the City Council meeting of August 1, the City Council directed the
City Engineer to investigate a drainage complaint at the outlet of the
drain pipe which is within the proposed easement.
The City Engineer visited the site with the Mosquito Abatement District
Representative. The Mosquito Abatement District Representative concluded
that the present flow of water is fast enough so that mosquitos will not
breed. However, he pointed out that additional weed growth could cause
a problem and he would continue to monitor the situation.
Upon further investigation, the City Engineer found that an earthen
ditch could be graded with a 3 percent slope across the Edison easement.
This would be steeper than the present conditon and would increase the
velocity of the water, preventing mosquito breeding.
The City Engineer also reviewed the subdivision improvement plans and
conditions of approval of the adjacent subdividers and found that neither
subdivider was required (by the County, prior to incorporation) , to pro-
vide any improvements within the Edison easement. However, as a goodwill
gesture, it may be possible to have the work done by the adjacent developer
to the west, as part of the construction work yet to be accomplished.

Other more expensive options could be considered such as construction of a
concrete swale or an enclosed pipe. However, since neither developers are
conditioned to provide these improvements, the City Engineer is inclined to
opt for the grading alternative. Assuming the City Council agrees with this
approach, once implemented, the graded ditch would be monitored to be sure
that it is not creating a nuisance. If the problem should continue, the
City Engineer would return to the City Council with solutions which would
be considerably more expensive.
PROPOSED MOTIONS
1. Receive and file this memorandum.
2. Adopt Resolution No. 84- , accepting an easement deed for storm
drainage purposes from California Community Builders, Inc.

PROPOSED ACTION
Accept the proposed easement deed.
BACKGROUND INFORMATION
As part of the improvement plans for Mission Ridge subdivision
on Peach Hill , a catch-basin and underground pipe was to collect
water on Knotty Pine Street, convey it beneath the recreational
lot and discharge it at the rear of the property. The storm
water was to discharge onto the adjacent property within a
recorded drainage easement; however, because of concerns with
this arrangement raised by adjoining property owners , County
Public Works required that the pipe be turned and extended so
that no water is discharged onto the residential lot to the
south. To accommodate this change, it is necessary for the
storm drainage easement to be similarly extended.
PROPOSED MOTION
Adopt Resolution No. 84- , accepting an easement deed
for storm drainage purposes from California Community Builders,
Inc.
