CITY OF MOORPARK,CALIFORNIA City Council Meeting of /0-05 47 MOORPARK CITY COUNCIL ACTION: �pAa�,d AGENDA REPORT nim° ' �z BY: TO: Honorable City Council FROM: Sean Corrigan, P.E., City Engineer/Public Works Director Prepared by: Shaun Kroes, Program Manager cr DATE: October 4, 2016 (Special CC Meeting of 10/05/16) SUBJECT: Consider Amendment No. 1 to Agreement with City of Thousand Oaks for Moorpark Fixed Route Operations, and Amendment No. 1 to Agreement with City of Thousand Oaks for Moorpark Fixed Route Maintenance DISCUSSION On June 24, 2014, the City of Moorpark (Moorpark) and the City of Thousand Oaks (Thousand Oaks) entered into Agreements for Moorpark Fixed Route Operations and Fixed Route Maintenance. The Agreements include a section in their respective Scopes of Work that state that in the event that if 3 of Moorpark's buses go out of service, Thousand Oaks will provide Moorpark with a Dial-A-Ride van on an emergency basis in order to ensure that Moorpark's bus routes continue without interruption. The Agreements currently have no such clause for reciprocal use of a Moorpark bus in the event that Thousand Oaks is in need of a supplemental vehicle. City staff is requesting that City Council approve Amendment No. 1 for Moorpark Fixed Route Operations (Attachment 1) and Amendment No. 1 for Moorpark Fixed Route Maintenance (Attachment 2), permitting Thousand Oaks to use a Moorpark bus in the event Thousand Oaks needs the vehicle. On October 4, Thousand Oaks staff requested that Moorpark consider permitting the use of one of Moorpark's fixed route buses for a short-term period (two to three weeks). Thousand Oaks has experience the loss of two fixed route buses and has requested that it be permitted to use a Moorpark bus in the event that it loses another two buses due to maintenance or other unforeseen accidents. Thousand Oaks is proposing to place one of Moorpark's buses on "standby". In the event that the bus is needed, Thousand Oaks would deploy the bus for Thousand Oaks service. If Moorpark's bus fleet were to be diminished due to accidents and/or maintenance requirements, the "standby" bus would be put into service for Moorpark's fleet. 1 Honorable City Council October 5, 2016—Special Meeting Page 2 FISCAL IMPACT None. Thousand Oaks will cover fueling and maintenance costs associated with Moorpark's bus while it is in service for Thousand Oaks. • STAFF RECOMMENDATION (Roll Call Vote) 1. Authorize the City Manager to sign Amendment No. 1 to the Agreement with Thousand Oaks for Moorpark Fixed Route Operations, subject to final language approval by the City Manager; and 2. Authorize the City Manager to sign Amendment No. 1 to the Agreement with Thousand Oaks for Moorpark Fixed Route Maintenance, subject to final language approval by the City Manager. Attachments: 1. RECITALS WHEREAS, on June 24, 2016, Moorpark and the City entered into an Agreement to have the City provide fixed route operation services; and WHEREAS, City has requested that Moorpark permit City to use one (1) of Moorpark's fixed route buses on an emergency basis and City and Thousand Oaks now desire to amend the Agreement to permit the use and document said agreement to amend by jointly approving Amendment No. 1 to the Agreement. NOW, THEREFORE, it is mutually agreed by and between the parties to the Agreement as follows: I. Exhibit A, SCOPE OF WORK, is amended by adding the following paragraph to Section 5, VEHICLES, and reads: "The Moorpark City Manager may authorize the use of one (1) of its vehicles for City's use on an emergency basis, for a not-to-exceed time of thirty (30) days at one time. In the event that Moorpark requires the vehicle to ensure operation of Moorpark's route, City shall return the vehicle for Moorpark's use." II. Remaining Provisions: Except as revised by this Amendment No.1, all of the provisions of the Agreement shall remain in full force and effect. 3 In Witness Whereof, the parties hereto have caused this Amendment to be executed the day and year first above written.
