MINUTES OF THE CITY COUNCIL

A Special Meeting of the City Council of the City of Moorpark was held on March 19,
2008, in the Community Center of said City located at 799 Moorpark Avenue, Moorpark,
California.
1 . CALL TO ORDER:
Mayor Pro Tern Parvin called the meeting to order at 6:50 p.m.
2. ROLL CALL:
Present: Councilmembers Mikos, Millhouse, Van Dam, and Mayor
Pro Tern Parvin.
Absent: Mayor Hunter.
Staff Present: Steven Kueny, City Manager; Joseph Montes, City Attorney;
Hugh Riley, Assistant City Manager; Mary Lindley, Parks,
Recreation and Community Services Director; Yugal Lail,
City Engineer/Public Works Director; David Bobardt,
Planning Director; and Deborah Traffenstedt, Administrative
Services Director/City Clerk.
3. PUBLIC COMMENT:
None.
4. REORDERING OF, AND ADDITIONS TO, THE AGENDA:
None.
5. PRESENTATION/ACTION/DISCUSSION:
A. Consider Budget Amendment for the Installation of One Hundred and
Fourteen Twenty-Four Inch Box Valley Oak and Coast Valley Oak Trees
for the 23 Freeway Interchange at Tierra Rejada Road. Staff
Recommendation: 1) Authorize staff to purchase 114 twenty-four inch box
trees, a combination of 109 Valley Oak and 5 Coast Valley Oak, for the
Tierra Rejada Road Interchange Landscaping at a cost not to exceed
$20,000; and 2) Authorize the city Manager to enter into cooperative
agreement with Caltrans for reimbursement associated with the planting
and staking of the trees.

Mr. Lall gave the staff report. He stated discussion is continuing with
Caltrans regarding whether an agreement can be reached for the
Calttrans contractor to install the larger trees.
Mr. Kueny asked the Council to approve the staff recommendation as
modified to give staff the authority to spend up to $40,000 from the City's
Tree and Landscape Fund for the enhanced landscaping.
MOTION: Councilmember Mikos moved and Councilmember Van Dam
seconded a motion to: 1) Authorize staff to purchase 114 twenty-four inch box
trees, a combination of 109 Valley Oak and 5 Coast Valley Oak, for the Tierra
Rejada Interchange Landscaping at a cost not to exceed $40,000; 2) Authorize
the City Manager to enter into cooperative agreement with Caltrans for
reimbursement associated with the planting and staking of the trees; and 3)
Direct staff to schedule a future budget appropriation item for the landscaping
funding. The motion carried by voice vote 4-0, Mayor Hunter absent.
6. CLOSED SESSION:
Mr. Kueny requested the Council go into closed session for discussion of two
cases under Item 6.13. on the agenda.
MOTION: Councilmember Mikos moved and Councilmember Van Dam seconded a
motion to adjourn to closed session for discussion of two cases under Item 6.13. on the
agenda. The motion carried by voice vote, 4-0, Mayor Hunter absent.
B. CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION
Initiation of litigation pursuant to Subdivision (c) of Section 54956.9 of the
Government Code: (Number of cases to be discussed — 4)
Present in closed session were Councilmembers Mikos, Millhouse, Van Dam,
and Mayor Pro Tern Parvin; Steven Kueny, City Manager; Joseph Montes, City
Attorney; Hugh Riley, Assistant City Manager; David Bobardt, Planning Director;
and Deborah Traffenstedt, Administrative Services Director/City Clerk.
The Council reconvened into open session at 7:12 p.m. Mr. Kueny stated two
cases under Item 6.13. were discussed and there was no action to report.

7. ADJOURNMENT:
Mayor Pro Tern Parvin adjourned the meeting at 7:12 p.m.
