Lail, City Engineer/Public Works Directo / Prepared by: Adam Burks, Assistant Engineer DATE: March 25, 2008 (CC Meeting of 04/02/2008) SUBJECT: Consider Resolution Approving Speed Limits and Approving the Posting of Speed Limit Signs on Spring Road from Walnut Canyon Road to Charles Street BACKGROUND The City recently retained Hartzog and Crabill, Inc. to prepare an Engineering and Traffic Survey for Speed Limits for Spring Road from Walnut Canyon Road to Charles Street. The survey has been completed and a copy has been filed with the City Clerk and distributed to the Council under separate cover. This report presents a resolution establishing the speed limit on the newly constructed portion of Spring Road, based on the findings, conclusions and recommendations set forth in the survey. DISCUSSION Section 40802 of the California Vehicle Code (CVC) requires, as a prerequisite to the enforcement of any speed law with radar, the preparation and adoption of an Engineering and Traffic Survey for Speed Limits within the past five years. Pardee Homes recently constructed the portion of Spring Road from Walnut Canyon Road to Charles Street including the posting of 45MPH speed limit signs. The posted speed limit is not enforceable by radar until the speed survey is completed and adopted by City Council. The Speed Survey was conducted during off-peak traffic periods on March 4, 2008, nearly two months after Spring Road was opened to the public. As stated in the Speed Survey, in order to employ radar enforcement, the posted speed limit for any street should be established at the nearest 5MPH increment to the 85th percentile speed (the speed at which eighty-five percent [85%] of the vehicles surveyed SAPublic Works\Everyone\Staff Reports\2008\April\Prima Facie Speed-Spring from Walnut Cyn to Chades.doc a 0 V 02 1 Honorable City Council April 2, 2008 Page 2 travel). However, the speed limit may be reduced by 5MPH based on roadway conditions and the safety needs of the community. The subject Resolution is attached as Attachment 1. Exhibit "A" of that Resolution lists the segments of Spring Road which were included in the Speed Survey. The recommended speed limit for each segment is 45MPH. FISCAL IMPACT None. Resolution SAPublic Works\Everyone\Staff Reports\2008\April\Prima Facie Speed-Spring from Walnut Cyn to Chades.doc Attachment 1 RESOLUTION NO. 2008 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, APPROVING PRIMA FACIE SPEED LIMITS FOR AND APPROVING THE POSTING OF SPEED LIMIT SIGNS ON SPRING ROAD FROM WALNUT CANYON ROAD TO CHARLES STREET WHEREAS, an Engineering and Traffic Survey for Speed Limits has been prepared for Spring Road from Walnut Canyon Road to Charles Street; and WHEREAS, the findings in said survey support posting the prima facie speed limits on Spring Road from Walnut Canyon Road to Charles Street. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the designated speed limit for each of the street segments shall be per Exhibit "A". SECTION 2. The City Engineer/Public Works Director is hereby directed to replace and/or post new speed limit signs to reflect the adopted speed limits set forth in Exhibit "A". SECTION 3. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions. PASSED AND ADOPTED this 2nd day of April, 2008.
