BY: TO: The Honorable City Council "-)A— FROM: Jennifer Mellon, Senior Management Analyst DATE: May 21, 2008 (CC meeting of June 4, 2007) SUBJECT: Consider Resolution Authorizing Submittal of a Used Oil Recycling Block Grant Application to the California Integrated Waste Management Board SUMMARY The City Council is being asked to consider a resolution approving the submittal of the City's annual application for a Used Oil Block Grant to the state of California Integrated Waste Management Board. DISCUSSION In 1993 the City began receiving Used Oil Recycling Block Grants and began a Used Oil recycling program. The grants are administered by the California Integrated Waste Management Board (CIWMB) with the main goal to provide funding to local governments in order to establish and maintain used oil collection programs that encourage recycling of used motor oil. Recently the state allowed Used Oil Block Grant funds to be spent on certain federally- mandated National Pollutant Elimination System (NPDES) activities connected to illegal disposal of motor oil. Used motor oil is recycled through Certified Used Oil Collection Centers and the City monthly Household Hazardous Waste (HHW) collection events. Moorpark residents can attend HHW events three times per month: on the second Friday; on the Saturday following the second Friday; and on the third Saturday of the month (except for December). Two certified centers in Moorpark, Jiffy Lube and Autozone, accept a maximum of five (5) gallons of used oil per person, per day free of charge. The certified centers must offer a $0.04 per quart recycling incentive to walk -in clients. Grant funds may be used to purchase equipment for a certified center such as holding tanks and tools to test for contamination. The funding is distributed on a per capita basis. Moorpark is entitled to receive approximately $9,000 in the upcoming cycle 14, and the money is available on a reimbursement basis for S: \Community Services\ADMINISTRATIVE \CC Reports\2008 \6 -4 -08 (UOBG Cycle 14).doc Honorable City Council June 4, 2008 Page 2 three years (2008- 2011). The grant administrators at the CIWMB have the authority to determine if grant funds can be used for a particular activity. Approved uses include purchasing equipment, contaminated oil disposal, overhead costs, staff time, public information, promotional items, and NPDES activity related to preventing disposal of used motor oil into the environment. Historically the City has used the grant funds for a balanced mix of all the approved expense categories. The grant application must contain an approved resolution from each City's governing body authorizing submittal of the application and identify the individual authorized to executive any agreements, contracts, and requests for payments. FISCAL IMPACT Funding for the Used Oil Program is budgeted in Solid Waste and as funds are expended staff reports to the California Integrated Waste Management Board and is reimbursed periodically by the Grant. STAFF RECOMMENDATION Adopt Resolution No. 2008 - RESOLUTION NO. 2008- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, AUTHORIZING SUBMITTAL OF A USED OIL BLOCK GRANT APPLICATION TO THE CALIFORNIA INTEGRATED WASTE MANAGEMENT BOARD, AND AUTHORIZING THE CITY MANAGER TO EXECUTE ANY AGREEMENTS, CONTRACTS, AND REQUESTS FOR PAYMENT WHEREAS, the City of Moorpark recognizes that it is in the public interest to enact and implement an integrated waste management plan to address the state's diminishing landfill space and the potential adverse environmental impacts from inappropriate disposal of waste materials including used oil; and WHEREAS, the people of the State of California have enacted the California Oil Recycling Enhancement Act and related legislation that provides funds to cities and counties for establishing and maintaining local used oil collection programs that encourage recycling or appropriate disposal of used oil; and WHEREAS, the people of the State of California have enacted §47000 et seq. of the California Public Resources Code that provides grants to local governments to establish and implement waste diversion and separation programs to prevent disposal of hazardous waste, including household hazardous waste, in solid waste landfills; and WHEREAS, the California Integrated Waste Management Board has been delegated the responsibility for the administration of these programs within the state, setting up necessary procedures governing application by cities and counties under these programs. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Moorpark authorizes the submittal of grant applications to the California Integrated Waste Management board for all available grants under the California Oil Recycling Enhancement Act and all available Household Hazardous Waste grants under the California Integrated Waste Management Act through June 30, 2011. Used Oil Block Grant Resolution No. 2008 - Page 2 SECTION 2. The City Manager; Parks, Recreation & Community Services Director; Community Services Senior Management Analyst; or a designee named by the City Manager, is hereby authorized and empowered to execute in the name of the City of Moorpark all necessary applications, contracts, payment requests, agreements and amendments hereto for the purposes of securing grant funds and to implement and carry out the purposes specified in the grant application. SECTION 3. The City Clerk shall certify to the adoption of the resolution and shall cause a certified resolution to be filed in the book of original resolutions.
