SUBJECT: Consider Resolution Adopting a Fee for Services Rendered Pursuant
to the Moorpark Municipal Code, Section 8.50.100, Related to
Shopping Carts
BACKGROUND /DISCUSSION
On June 18, 2008, the Council voted to establish Moorpark Municipal Code Chapter
8.50; a chapter entitled "Shopping Carts ". Chapter 8.50 includes sections regarding a
mandatory abandoned cart prevention plan and fees associated with this required plan.
Each owner (an owner being any person or entity, who in connection with the conduct of
a business, possesses, leases or makes carts available to customers or the public for
the purpose of transporting merchandise on the business premises), must submit the
aforementioned plan. The fee referenced in Section 8.50.100 of this new chapter
regards recovering staff costs incurred in the processing of the mandatory plans.
FISCAL IMPACT
Currently five (5) businesses use shopping carts and one (1) additional business is
under construction that would be required to submit an abandoned cart prevention plan.
The staff costs associated with processing annual plans is $46.33 per plan. Processing
involves tracking, review, processing and approval an abandoned cart prevention plan.
Staff recommends a fee of $45.00 per plan be established.

RESOLUTION NO. 2008-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA ADOPTING A FEE FOR SERVICES
RENDERED PURSUANT TO THE MOORPARK MUNICIPAL CODE,
SECTION 8.50.100, RELATED TO SHOPPING CARTS
WHEREAS, at its meeting of June 18, 2008, the City Council conducted a
hearing amending Title 8, Health and Safety of the Moorpark Municipal Code, by adding
Chapter 8.50, Shopping Carts, received public testimony on the proposed amendment,
and after receiving oral and written public testimony, closed the hearing and reached a
decision; and
WHEREAS, abandoned shopping carts are increasingly pervasive in the
community, litter the parkways and curbs of the City, create potential safety hazards to
the public, and interfere with pedestrian and vehicular traffic; and
WHEREAS, the accumulation of wrecked and dismantled abandoned shopping
carts on public and private property tends to diminish property values and promote
blight in the overall; and
WHEREAS, amending Title 8, Health and Safety of the Moorpark Municipal
Code, by adding Chapter 8.50, Shopping Carts is exempt from the provisions of the
California Environmental Quality Act by the general rule that CEQA only applies to
projects that may have a significant effect on the environment.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The fee imposed upon each owner, as defined in Section
8.50.020, in association with the submittal of a Mandatory Abandoned Cart Prevention
Plan ( "Plan ") shall be $45.00.
SECTION 2. The payment of fees is due upon submittal of a Plan.
SECTION 3. The fee associated with the submittal of a Plan will be paid
annually.
SECTION 4. This Resolution shall become effective thirty (30) days after its
passage and adoption.

SECTION 5. The City Clerk shall certify to the adoption of this resolution and
shall cause a certified resolution to be file in the book of original resolutions.
