SUBJECT: Consider Rejection of Claim: David Acosta
BACKGROUND
The City received the above referenced Claim on May 7, 2008. The claim was forwarded to
the City's claims adjuster, Carl Warren & Co., for review.
DISCUSSION
The stated reason for the claim is for injuries sustained when struck by a train while standing
on the train station platform. The train station platform is owned by the Ventura County
Transportation Commission and is therefore not the property of the City. The City's claim
adjuster, Carl Warren, has recommended that a standard rejection letter be sent to the
claimant.
STAFF RECOMMENDATION
Reject the claim and direct staff to send a standard rejection letter to the claimant.
