Lail, City Engineer /Public Works Director Prepared by: Dave Klotzle, Assistant City Engineer DATE: August 25, 2008 (CC Meeting of 09/03/2008) SUBJECT: Consider Resolution Rescinding Resolution No. 2006 -2511 and Approving Speed Limits for Certain Street Segments and Approving the Posting of Speed Limit Signs on Said Streets BACKGROUND Based on an Engineering and Traffic Survey for Speed Limits dated August 2006, the City Council adopted Resolution No. 2006 -2511 on August 16, 2006, approving speed limits for certain street segments. A speed limit of 40 miles per hour (mph) was approved and subsequently posted on Championship Drive from Walnut Canyon Road to Grimes Canyon Road. The August 2006 speed survey found the 85th percentile speed for Championship Drive to be 45.1 mph. The survey recommended a 40 mph speed limit for Championship Drive because 1) it fell midway between the 10 mph pace range of 37 to 46 mph; and 2) roadway conditions consisting of gradual to moderate horizontal and vertical curves. DISCUSSION On June 25, 2008, the Superior Court of California, County of Ventura, dismissed the charge of speeding in the case of People v. Gaite. The court found that the 40 mph posted speed limit, at less than the 85t percentile speed, created a speed trap where more than half the motorists passing through this speed zone would be placed at risk of a speeding ticket without a documented safety reason. The court found that the speed survey did not justify the 40 mph speed limit because based on the citing officer's testimony, the curving roadway conditions are readily apparent to drivers. The California Manual on Uniform Traffic Control Devices ( MUTCD) requires that posted speed limits should be established at the nearest 5 mph increment of the 85th percentile speed of free - flowing traffic. The MUTCD allows local authorities to establish ,,�w(f60 SAPublic Works \Everyone \Staff Reports\2008 \September \Championship Speed Limit.doc Honorable City Council September 3, 2008 Page 2 posted speed limits below the 5 mph increment nearest the 85th percentile speed if unusual road conditions are not readily apparent to drivers. Since the Superior Court found that roadway conditions on Championship Drive are readily apparent (People v. Gaite), the posted speed limit should be changed to 45 mph which is at the nearest 5 mph increment of the 85th percentile speed of 45.1 mph. Section 40802 of the California Vehicle Code (CVC) requires, as a prerequisite to the enforcement of any speed law with radar, the preparation and adoption of an Engineering and Traffic Survey for Speed Limits within the past five years. Therefore, the August 2006 Engineering and Traffic Survey for Speed Limits which found the 85 th percentile speed of 45.1 mph on Championship Drive is valid for use as the document to recommend the posting of the 45 mph speed limit. Resolution SAPublic Works \Everyone \Staff Reports\2008 \September \Championship Speed Limit-doc �' -� Attachment 1 RESOLUTION NO. 2008 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, RESCINDING RESOLUTION NO. 2006 -2511 AND APPROVING SPEED LIMITS FOR CERTAIN STREET SEGMENTS AND APPROVING THE POSTING OF SPEED LIMIT SIGNS ON SAID STREETS WHEREAS, a Traffic Speed Zone Survey and Engineering Study has been prepared for certain of the local streets within the City of Moorpark; and WHEREAS, the findings in said study support certain changes to speed limits and the posted speed limit for some of those street segments; and WHEREAS, on August 16, 2006, the City Council of the City of Moorpark adopted Resolution No. 2006 -2511 which sets the current speed limit for all of the local streets within the City is, in part, in conflict with the speed limits recommended by the aforesaid study. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That Resolution No. 2006 -2511, pertaining to the designation of speed limits, is hereby rescinded. SECTION 2. That the designated speed limit for each of the street segments shall be per Exhibit "A ". SECTION 3. The City Engineer /Public Works Director is hereby directed to replace and /or post new speed limit signs to reflect the adopted speed limit set forth in Exhibit "A ". SECTION 4. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions.
