Vacca, Principal Plann DATE: December 27, 2006 (CC Meeting of 1/17/2007) SUBJECT: Consider Resolution Directing the Planning Commission to Study, Hold a Public Hearing and Provide a Recommendation on Amendments to Chapters 17.20 (Uses by Zone) and 17.42 (Wireless Communications Facilities) of the Zoning Ordinance BACKGROUND / DISCUSSION Moorpark Municipal Code Chapters 17.20 and 17.42 establish the city's review process and standards for wireless communication antennas and equipment structures. On September 29, 2006, California Senate Bill No. 1627 was enacted, limiting a city's review authority to a ministerial permit for wireless communications collocation facilities. An example of a collocation facility is where a cellular phone company adds antenna panels to another company's existing antenna structure, with electronic equipment either within or next to the existing equipment structure. Current city regulations, which require Planning Commission discretionary approval of a Conditional Use Permit for such a facility, need to be updated for consistency with State law. The Municipal Code calls for a resolution of City Council to initiate an amendment to the Zoning Ordinance. The attached draft resolution, if adopted by City Council, would direct staff and the Planning Commission to study and provide a recommendation to the City Council on a Zoning Ordinance Amendment regarding wireless communications collocation facilities. SACommunity Development \DEV PMTS\Z 0 A \Initiations \cc 070117 stf rpt ZOA Wireless Communication Facilites.doc OOOOE.9 RESOLUTION NO. 2007- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DIRECTING THE PLANNING COMMISSION TO STUDY, HOLD A PUBLIC HEARING AND PROVIDE A RECOMMENDATION TO THE CITY COUNCIL ON A ZONING ORDINANCE AMENDMENT THAT WOULD AMEND CHAPTERS 17.20 AND 17.42 OF THE MOORPARK MUNICIPAL CODE RELATED TO WIRELESS COMMUNICATIONS COLLOCATION FACILITIES WHEREAS, Section 17.44.050 of the Municipal Code provides that the City Council may initiate proceedings to consider amendments to the Zoning Ordinance by the adoption of a resolution of intent; and WHEREAS, the City Council wishes to initiate proceedings to consider a Zoning Ordinance Amendment that would amend Chapters 17.20 and 17.42 of the Moorpark Municipal Code related to wireless communications collocation facilities. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. INITIATION OF PROCEEDINGS: The City Council hereby authorizes the initiation of proceedings to consider a Zoning Ordinance Amendment that would amend Chapters 17.20 and 17.42 of the Moorpark Municipal Code to ensure that regulations related to wireless communications collocation facilities are consistent with State law, the city's General Plan, and other provisions of the city's Zoning Ordinance. SECTION 2. DIRECTION TO PLANNING COMMISSION: The Planning Commission is hereby directed to study, hold a public hearing, and provide a recommendation to the City Council on this matter. SECTION 3. CITY CLERK CERTIFICATION AND FILING: The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions.
