E & Crff OF MOORPAPM, CAT --NP AA City Council Meet. of _ ACTION: SUBJECT: Consider Approval of a Certificate of Acceptance for an Easement for a Sidewalk on the East Side of Gabbert Road, IPD % -3 (West America Corp.) On August 26, 1996 the Planning Commission approved IPD 96 -3 for West America Construction Corporation to construct an industrial building at 5350 Gabbert Road. Site improvements include the construction of a meandering sidewalk which will be partially situated on private property east of the existing Gabbert Road Right -of -Way. In order to provide for adequate public access and to allow the City to maintain the sidewalk, an easement to The City of Moorpark is necessary. There is a standard condition requirement requires that all necessary easements and rights -of -way be dedicated to the City. An easement deed has been prepared which will allow public access and maintenance for that portion of the sidewalk lying outside the right -of -way. A Certificate of Acceptance from the City of Moorpark is required to record this easement deed, being granted to the City from West America Construction Corporation, for the sidewalk access and sidewalk maintenance. A vicinity map showing the location of the project is attached (see Attachment 1). The location of the subject easement within the project site is shown in Exhibit B of the easement deed attached. Approve the Certificate of Acceptance for a public sidewalk and maintenance easement on the east side of Gabbert Road, from West America Construction Corporation, and direct the City Clerk to send said easements and certificates to the County Recorder for recordation. 111 A �z 5.
