TO: The Honorable City Council „” ,k , FROM: Nelson Miller, Director of Community Development Paul Porter, Senior Planner 77 DATE: May 1, 1997 (CC Meeting on May 7, 1997) SUBJECT: CONSIDER APPROVAL OF VESTING TENTATIVE TRACT MAP NO. 5081 ON THE APPLICATION OF AMERICAN STORES PROPERTIES, INC. FOR A SUBDIVISION OF 11.8 ACRES INTO EIGHT LOTS OF 2.5, .7, 4.1, 1.5, .6, .7, .9 AND .8 ACRES LOCATED AT THE NORTIMST CORNER OF TIERRA REJADA ROAD AND MOUNTAIN TRAIL STREET IN THE CITY, ASSESSOR'S PARCEL NO. 505 -0- 012 -41 Background On January 21, 1997, the applicant applied for Vesting Tentative Tract Map No. 5081 to subdivide the Commercial Shopping Center under Major Modification No. 1 to Commercial Planned Development Permit No. 90 -2. The Planning Commission held a public hearing on Vesting Tentative Tract No. VTT 5081 on April 14, 1997 and recommended conditional approval of the subdivision to the City Council. Issues discussed at the Planning Commission hearing centered on three areas of concern: 1. Completion of improvements to the median at Mountain Trail Street. 2. The potential difficulty of the City dealing with several property owners rather than one applicant regarding potential maintenance and management problems. 3. The need for and completion of of dual left turn lanes on Los Angeles Avenue for south turning movements onto Tierra Rejada Road. ' * L1 'Uj b ' The subdivider shall eat l.4, a P?9, ,potty OWn rs' sh1l aCi provide for non- exclusive reciprocal ingress /egress, drainage, and utility easements between and on behalf of all the owners of the commercial development on Vesting Tentative Tract Map 5081. Said easements shall be indicated on the map or other city approved document and shall be reviewed and approved by the City Engineer. With respect to Condition 30, concerns have previously been expressed that there is inadequate right of way to accommodate a dual left turn lane and still preserve the opportunity to ultimately widen Los Angeles Avenue to six full -width (12 foot) lanes (three through lanes in each direction) , retain the eight foot bike /emergency stopping lane on each side, and a four foot median. In order to ultimately develop this intersection, additional right of way would be needed, or some lanes eliminated, C: \M \TR5081 \7MAY97.CC or lane widths reduced, or the bike /emergency stopping lanes eliminated and /or the median and parkways reduced in width. In order to develop three through lanes in each direction an additional twenty -nine feet width of right of way the length of the SCE property (at the northwest corner of the intersection) would also be required. These issues would need to be addressed as part of any traffic study. It has also been suggested that the tract boundaries should be modified to address several issues which have come about with the development of this project and surrounding properties. With the turn lanes and meandering sidewalks along Tierra Rejada and Mountain Trails, it is suggested that the property boundary be one foot away inside the curb, with public easements for the sidewalks, which would be consistent with the adjacent subdivisions. Also, there is a remnant portion of a lot in the northwesterly portion of the property adjacent to Lot 65 of Tract 4342 -3 which is a continuation of the slope at the rear of the shopping center. This remnant is a slope to which the subject property is adjacent on the downhill side. It has been policy that slopes should be apart of downhill lots. The Director of Public Works has previously requested that American Stores accept this remnant property and the landscaping and maintenance of that slope. Two additional conditions have been suggested to be added to address these issues, as follows: 38. The tract boundary shall be adjusted to be one foot inside the curb line along the perimeter streets, with easements provided for public sidewalks. 39. That portion of Lot K of Tract 4342 -5, as further described below shall be incorporated within the tract and accepted for ownership, installation of landscaping, and maintenance. That portion of Lot K as shown on Tract No. 4342 -5 filed in book 116, pages 74 through 80 of Miscellaneous Records, in the records office of Ventura County, State of California, described as follows: Beginning at the Southeast corner of Lot No. 65 as shown on Tract No. 4342 -5 filed in book 116, pages 74 through 80 of Miscellaneous Records, thence. 1st North 12 degrees- 18' -45" West, 65.821feet along the Easterly Property line of said Lot No. 65 thence. 2nd Leaving said Lot 65, North 71 degrees- 1 ' -11" East 28.85 feet to the Westerly Lot line of C: \M \TR5081 \7MAY97.CC i "voi said Lot K, thence. 3-rd Along the Westerly boundary line of said Lot K, South 18 degrees- 49' -49" East, 68.40 feet, thence. 4-t-h Leaving said Lot K boundary line, South 75 degrees- 54' -44" West, 36.45 feet to the True Point of Beginning. PROCESSING DEADLINES: processing_ Expiration Date: As the City Council is the approving authority for this Vesting Tentative Tract Map, the City Council must adopt the Resolution approving or denying the Map within 30 days after the first regular City Council meeting following the date of the Planning Commission's Resolution. Therefore, the City Council must render a decision of the subdivision by May 16, 1997. If the City Council does not take action, the Map will be approved. 1. Open the public hearing and accept public testimony and close the public hearing. 2. Determine that the effects of Vesting Tentative Tract Map No. 5081 have been adequately analyzed in the Mitigated Negative Declaration, Initial Study, and Mitigation Monitoring Program prepared for CPD 90 -2. 3. Make the appropriate findings as found in the attached Resolution. 4. Add conditions 38 and 39 as described in the staff report and make a Finding that the portion of Lot K described in the staff report is surplus property which is land locked and has no value other than adjoining property, should be incorporated into the lot adjacent on the downhill side and disposition of the property would be consistent with the General Plan. 5. Adopt the attached Resolution recommending approval of Vesting Tentative Tract Map No. 5081 to the City Council. Attachments: 1. City Council Resolution 2. Planning Commission Resolution 3.
