Bobardt, Community Development Director I DATE: November 3, 2016 (CC Meeting of 11116/2016) SUBJECT: Consider Resolution Approving General Plan Amendment No. 2016- 02 to Include the 2015 Ventura County Multi-Hazard Mitigation Plan with Appendices and FEMA Revisions as Part of the Safety Element and Finding of Exemption from the California Environmental Quality Act in Connection Therewith BACKGROUND On September 21, 2016, the City Council adopted Resolution No. 2016-3541, directing the Planning Commission to study and provide a recommendation to the City Council on a General Plan Amendment to include the 2015 Ventura County Multi-Hazard Mitigation Plan (MHMP) in the Safety Element of the City's General Plan. On October 25, 2016, the Planning Commission held a public hearing on this proposed amendment. No members of the public spoke on this proposal. After discussion, the Planning Commission adopted Resolution No. PC-2016-614, recommending approval of the General Plan Amendment. This public hearing item is for the City Council to consider approval of a General Plan Amendment to include the 2015 Ventura County MHMP, with Appendices and FEMA Revisions, as part of the Safety Element of the City's General Plan. A separate agenda item is included on this meeting's agenda for the City Council to consider adoption of the MHMP. DISCUSSION On July 26, 2016, the Ventura County Board of Supervisors adopted the 2015 MHMP, updated with FEMA revisions, that covers 9 of the 10 cities in the county (Simi Valley did not participate in this plan), as well as the unincorporated area of the county. It has been prepared to address federal requirements under the federal Disaster Mitigation Act of 2000, which encourages close coordination between local, state and federal agencies in disaster mitigation planning. The complete MHMP, with appendices and FEMA revisions, is available online on the City website. The attached draft resolution includes only the cover page and table of contents. The final resolution will include the complete MHMP with appendices and FEMA revisions. 33 Honorable City Council November 16, 2016 Page 2 This 2015 MHMP is an update of a plan that was originally developed by the County in 2005 and first updated in 2010. The plan addresses hazards in the areas of agriculture/biology, climate change, dam failure, drought, earthquake, flood, landslide, levee failure, post-fire debris flow, tsunami, and wildfire. A total of 22 general potential mitigation actions have been identified that focus on minimizing impacts of hazards Countywide. Of these, 6 are applicable to Moorpark and have been incorporated into Moorpark's Mitigation Action Plan (Appendix J, Pages J-18 to J-19) In addition, 4 local measures have been identified and incorporated into Moorpark's Mitigation Action Plan. The Mitigation Action Plan addresses local equipment needs and seismic upgrades to local facilities, public education, water conservation, flammable vegetation management, electronic communication improvements, and consideration of a new fire station location. Section 8685.9 of the Government Code limits State assistance on eligible projects as part of the California Disaster Assistance Act to no more than 75% of total state eligible costs, unless the local city has adopted a local hazard mitigation plan in accordance with the federal Disaster Mitigation Act of 2000 as part of the Safety Element of its General Plan, in which case the Legislature may provide for a state share of local costs that exceeds 75% of total state eligible costs. ENVIRONMENTAL DETERMINATION The Director has reviewed this project and found it to qualify for a General Rule Exemption in accordance with Section 15061(b)(3) of California Code of Regulations (CEQA Guidelines) in that Moorpark's Mitigation Action Plan of the MHMP involves emergency equipment purchases, seismic upgrades to certain existing public facilities if necessary, educational efforts, communication improvements, landscape maintenance, and study of a potential new fire station site. It can be seen with certainty that there is no possibility that these activities may have a significant effect on the environment. No further environmental documentation is required. NOTICING Public Notice for this hearing was given consistent with State law and Chapter 17.44 of the Zoning Ordinance by publication in the Ventura County Star with a 1/8 page ad on November 5, 2016. SECTION 3. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions.
