Traffenstedt, Assistant City ManagerDT Teri Davis, Program Manager DATE: November 8, 2016 (CC Meeting of 11/16/16) SUBJECT: Consider Resolution Adopting the 2015 Ventura County Multi-Hazard Mitigation Plan and FEMA Revisions BACKGROUND AND DISCUSSION On February 6, 2013, City Council adopted the 2010 Ventura County Hazard Mitigation Plan (MHMP) and the City of Moorpark's 2013 Update to the MHMP, in compliance with the Disaster Mitigation Act of 2000 (Act). The Act requires local governments to reduce risks from natural hazards through mitigation planning and activities carried out prior to the occurrence of natural disasters. The goal is to identify policies and actions that can be implemented over the long term to reduce risk and future losses. The Act requires local agencies to adopt a MHMP and update it every five years. If a local agency's MHMP is not in compliance with the Act, the local agency may not be eligible for various disaster grants and community assistance from the State and the Federal Emergency Management Agency (FEMA). This MHMP differs from the Emergency Operations Plan (EOP), recently amended by the City Council, in that this MHMP prescribes mitigation actions to take place prior to a disaster or emergency while the EOP references guidelines to be observed during the activation of the Emergency Operations Center in response to an actual disaster or emergency. During 2015, staff participated in a multi-jurisdictional effort, led by the Ventura County Sheriff Office of Emergency Services (Sheriff OES), to revise and update the MHMP. This effort produced an updated 2015 Ventura County MHMP that addresses existing and potential hazards within the County and the participating cities. Key elements of the 2015 Ventura County MHMP include the Planning Process, Hazards Analysis, Vulnerability Analysis, Capability Assessment, Mitigation Strategy, and Plan Maintenance. In September 2015, the County of Ventura Board of Supervisors (Board) approved and adopted the 2015 MHMP prompting a state and federal joint review process. During the review process, FEMA identified areas of the 2015 Ventura County MHMP in need of revision and those FEMA revisions were returned to the Board. On July 26, 2016, the Board adopted the Ventura County MHMP with the FEMA revisions. 148 Honorable City Council November 16, 2016, Regular Meeting Page 2 On September 21, 2016, City Council adopted Resolution 2016-3541, directing the Planning Commission to study and provide a recommendation to the City Council on a General Plan Amendment to include the Ventura County MHMP in the Safety Element of the City's General Plan. The Planning Commission met on October 25, 2016 and voted to recommend to City Council the inclusion of the Ventura County MHMP and the FEMA revisions in the Safety Element of the City's General Plan. In addition to this agenda report recommending City Council approval and adoption of the 2015 Ventura County MHMP, a related public hearing agenda item is scheduled for the Council's regular meeting on November 16 to adopt the 2015 Ventura County MHMP into the City's General Plan Safety Element. The public hearing agenda report includes a more detailed summary description of the MHMP. The proposed general plan amendment is a separate but related approval action that is required to ensure the City has full access to available disaster assistance funding consistent with California Government Code Section 8685.9, which prohibits the state share for any eligible project from exceeding 75% of total state eligible costs unless the city has adopted a local hazard mitigation plan in accordance with the federal Disaster Mitigation Act of 2000 as part of the safety element of its general plan (in that situation, the State Legislature may provide for a state share of local costs that exceeds 75% of total state eligible costs). Additionally, Government Code Section 65302.6 provides that a city may adopt with its general plan safety element a local hazard mitigation plan as specified in the federal Disaster Mitigation Act of 2000. Section 2.48.040 of Chapter 2.48, Emergency Preparedness, of the City Municipal Code provides that the Moorpark Disaster Council shall consist of members of the City Council, and Section 2.48.050 requires the Disaster Council to develop and recommend for adoption by the City Council emergency and mutual aid plans and agreements and such ordinances and resolutions and rules and regulations as are necessary to implement such plans and agreements.. A joint meeting has been called to provide for Disaster Council recommendation of approval prior to City Council adoption of a resolution approving the 2015 Ventura County MHMP. The staff recommendation is for the Disaster Council to recommend approval and for the City Council to approve the attached resolution adopting the 2015 Ventura County MHMP, including the FEMA revisions. Included with the draft resolution is the cover page and the table of contents for the 2015 Ventura County MHMP, and the full report (including appendices and FEMA revisions) will be included with the final resolution and is temporarily available on the City website with the City Council regular meeting agenda reports for 2016. Attachment: Draft Resolution and 2015 Ventura County Hazard Mitigation Plan cover page and table of contents (full plan including appendices and FEMA revisions will be included with the final resolution and is temporarily available on City website with the 2016 agenda reports) 150 RESOLUTION NO. 2016- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA,APPROVING AND ADOPTING THE 2015 VENTURA COUNTY MULTI—HAZARD MITIGATION PLAN REQUIRED BY THE FEDERAL DISASTER MITIGATION ACT OF 2000 WHEREAS, the Federal Disaster Mitigation Act of 2000 requires local governments to identify risks posed by natural and human-caused disasters, and as a condition of mitigation grant assistance, requires coordinated mitigation planning and implementation efforts; and WHEREAS, the City of Moorpark participated with the Ventura County Emergency Planning Council to update the Ventura County Multi-Hazard Mitigation Plan to advance mitigation planning and projects within the County; and WHEREAS, each city, local agency, special district member, and the public as listed in the Plan, has contributed to this planning update and under the direction of the Federal Disaster Mitigation Act of 2000; and WHEREAS, the Federal Emergency Management Agency (FEMA) reviewed the 2015 Ventura County Multi-Hazard Mitigation Plan and provided revisions, which have been incorporated; and WHEREAS, the Ventura County Board of Supervisors adopted the 2015 Ventura County Multi-Hazard Mitigation Plan and FEMA revisions at a regular meeting held on July 26, 2016; and WHEREAS, consistent with California Government Code Sections 8685.9 and 65302.6, the City Council has incorporated the 2015 Ventura County Multi-Hazard Mitigation Plan, including FEMA revisions, into the Safety Element of the City's General Plan as approved by separate Council resolution on November 16, 2016; and WHEREAS, the Moorpark Disaster Council on November 16, 2016, recommended City Council adoption of the 2015 Ventura County Multi-Hazard Mitigation Plan including FEMA revisions. WHEREAS, the City Council of the City of Moorpark agrees to abide by the Disaster Mitigation Act of 2000 guidance and grant guidelines and this Multi-Hazard Mitigation Plan represents compliance with the same. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: 151 Resolution No. 2016- Page 2 SECTION 1. In accordance with the federal Disaster Mitigation Act of 2000,the City Council of the City of Moorpark approves and adopts the 2015 Ventura County Multi- Hazard Mitigation Plan with appendices and FEMA revisions (Exhibits A and B) as a regional plan and a guidebook to a more disaster resistant community. SECTION 2. The City Clerk shall certify to the adoption of the resolution and shall cause a certified resolution to be filed in the book of original resolutions.
