Traffenstedt, Assistant City Manager 1) ""r PREPARED BY: Teri Davis, Program Manager DATE: December 14, 2016 (CC Regular Meeting of 12/21/16) SUBJECT: Consider Adoption of a Revised Salary Plan Resolution that Includes a Salary Range Increase for One Non-Competitive Service (Management) Position, a Title Change for One Management Position, Minimum Wage Adjustments for Hourly Positions, and Rescinds Resolution No. 2016-3532 BACKGROUND AND DISCUSSION Attached to this report is a draft resolution amending the City's Salary Plan, with changes shown with the use of legislative format. The updated Salary Plan includes increasing the salary range for the Recreation Services Manager classification (a Management position) from Range 67 to 71. The reason for this salary range increase is to be consistent with other similar City Division Head positions which already have the higher Salary Range 71, such as the Administrative Services Manager, Planning Manager, and Program Manager positions. The attached Salary Plan Resolution also incorporates a change to one Management position job title. What is proposed is to change Information Systems Analyst to Information Systems Administrator. The reason for this job title revision is to be consistent with industry standard naming conventions for positions that are more technological versus analytical. Staff anticipates bringing a staff report back to the Council in January or February 2017 to amend the Classification Plan job description to make the title change, along with some edits to the job description essential functions as may be necessary to include more technological job duties. The attached Salary Plan Resolution also incorporates edits to the Hourly Positions Salary Tables that are necessary to be in compliance with the new California minimum wage that will be effective January 1, 2017 (from $10 to $10.50 per hour). Section 8 of the attached resolution includes an effective date of the pay period beginning December 24, 2016. Prior to City Council adoption of the revised Salary Plan resolution, staff is recommending the Mayor provide an oral report of a summary of the staff recommendation for the action on the Salary Plan Resolution, including the specific 99 Honorable City Council December 21, 2016 Regular Meeting Page 2 changes that affect the identified Management positions. There is a separate agenda, report scheduled for the December 21, 2016, City Council meeting for a revision to the City Council Rules of Procedure. That report provides more detail on Senate Bill No. 1436 that will take effect in 2017 and revises Section 54953 of the California Government Code. Existing law prohibits the legislative body from calling a special meeting regarding the salaries, salary schedules, or compensation paid in the form of fringe benefits of a local agency executive, as defined. Senate Bill No. 1436 requires the legislative body to orally report a summary of a recommendation for a final action on the salaries, salary schedules, or compensation paid in the form of fringe benefits of a local agency executive during the open meeting in which the final action is to be taken. "Local agency executive" is defined in Section 3511.1(d) of the Government Code as follows: (d)"Local agency executive" means any person employed by a local agency who is not subject to the Meyers-Milias-Brown Act (Chapter 10 (commencing with Section 3500)), Chapter 5 (commencing with Section 45100) of Part 25 of Division 3 of Title 2 of the Education Code, or Chapter 4 (commencing with Section 88000) of Part 51 of Division 7 of Title 3 of the Education Code, and who meets any of the following requirements: (1)The person is the chief executive officer, a deputy chief executive officer, or an assistant chief executive officer of the local agency. (2)The person is the head of a department of a local agency. (3)The person's position within the local agency is held by an employment contract between the local agency and that person. This "local agency executive" definition may be considered applicable to all of the City's Non-Competitive Service (Management) positions, because an employment agreement is now required for all new Management employees, and this definition isspecifically applicable to the City Manager, Assistant City Manager, Deputy City Manager, and all City department head positions. The Meyers-Milias-Brown Act referenced in the above definition is applicable to the City's Competitive Service Positions, which are not over- time exempt, and there are no changes proposed for the Competitive Service position salary tables. Although Senate Bill No. 1436 takes effect in 2017, consistent with the proposed change to the City Council Rules of Procedure, Staff Recommendation No. 1 on the following page of this report is for the Mayor to make an oral summary report of the proposed Salary Plan revisions prior to a motion to adopt the revised Salary Plan Resolution. FISCAL IMPACT There are sufficient funds in the current Fiscal Year 2016-17 Budget for the Recreation Services Manager salary range change from Range 67 to Range 71. Some salary savings are expected due to the current position vacancy. The top hourly rate for Range 71 is currently $55.13 per hour versus a maximum of $49.92 per hour for Range 67, a difference of 10%. The changes to the Hourly Positions Salary Schedules to 100 Honorable City Council December 21, 2016 Regular Meeting Page 3 implement the new minimum wage do not require a budget amendment, because only a few part-time Recreation positions are affected, the salary adjustments are minor, and the minimum wage change was already known and incorporated at the time of Fiscal Year 2016-17 Budget adoption. STAFF RECOMMENDATION 1. Prior to a motion to adopt the revised Salary Plan Resolution, the Mayor shall make an oral summary report as follows: Staff is recommending the City Council approve a revised Salary Plan Resolution that includes increasing the Non- Corn petitive Services Recreation Services Manager position salary range from Range 67 to 71 (a 10% increase); revising one Non-Competitive Service position title from Information Systems Analyst to Information Systems Administrator with no salary change; and revising all of the Hourly Positions Salary Tables for Salary Ranges 6 to 15 for compliance with the California minimum wage of $10.50 per hour effective January 1, 2017. 2. Adopt the revised Salary Plan Resolution, rescinding Resolution No. 2016-3532. Attachment: Draft Resolution 101 ATTACHMENT RESOLUTION NO. 2016- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, AMENDING THE SALARY PLAN FOR COMPETITIVE SERVICE, NON-COMPETITIVE SERVICE AND HOURLY EMPLOYEES, AND RESCINDING RESOLUTION NO. 2016-352-732 WHEREAS, the City Council at its meeting on December 21, 2016, considered and adopted a revised Salary Plan to implement the new California minimum wage of$10.50 per hour that is required to be effective January 1, 2017. Additionally, the revised salary plan incorporates a range change for the Recreation Services Manager position from Range 67 to Range 71, and revises the Information Systems Analyst position title to Information Systems Administrator, as described in an agenda report for the December21, 2016, regular City Council meeting. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. Resolution No. 2016- Page 4 SECTION 2. The corresponding salaries for the ranges established in Section 1 of this resolution are attached hereto and incorporated herein as the"Hourly Salary Schedule" Table. The Bi-Weekly Salary for each range may be calculated by multiplying the Hourly Salary by two thousand eighty(2,080) hours and dividing that calculation by twenty six(26) pay periods. The Monthly Salary for each range may be calculated by multiplying the Hourly Salary by two thousand eighty(2,080) hours and dividing that calculation by twelve (12) months. The Annual Salary for each range may be calculated by multiplying the Hourly Salary by two thousand eighty(2,080)hours. The"Bi-Weekly Salary Schedule"and "Monthly Salary Schedule" attached to this resolution are for information purposes, only, since calculations are approximate due to rounding differences. SECTION 3. The Salary Plan is based on ranges of two and one-half percent (2.5%) and step increases of two and one-half percent(2.5%) with a total of thirteen (13) steps. SECTION 4. City shall continue to pay a deferred compensation contribution into a City approved deferred compensation program, for enrolled regular full-time and regular part-time employees, and the contribution amount shall be as follows: City Manager - Three percent(3.0%)of gross base salary, Department Head positions—two and one-half percent (2.5%) of gross base salary, and all other Management and Competitive Service regular full-time and regular part-time positions—Two percent(2.0%)of gross base salary. Gross base salary is defined as wages paid as described in the Salary Plan Schedule (reference Section 2, herein) and including longevity pay; and excluding bilingual pay, in- lieu insurance payment, uniform cleaning allowance, leave cash-out, overtime pay, car and cellular telephone allowances, and deferred compensation payment. A Retired Annuitant is not eligible for a deferred compensation contribution. SECTION 5. Bilingual pay compensation for Spanish language bilingual skills shall be paid to qualified regular full-time and part-time employees, consistent with the qualification requirements approved in a Memorandum of Understanding between the City of Moorpark and the Service Employees International Union CTW, CLC, Local 721, and to qualified non-competitive service employees consistent with a City Council adopted management benefits resolution. Qualification for bilingual pay shall be determined by the City Manager at his or her sole discretion. The current rates per an approved MOU and management benefits resolution are: forty cents($.40)per hour for verbal bilingual pay,for all hours actually worked, and including annual leave, vacation leave, City holidays, and sick leave, but not for disability leave or other unpaid leave, for up to forty (40) hours per week; and fifty cents($.50) per hour for combined verbal/written bilingual pay, for all hours actually worked, and including annual leave, vacation leave, City holidays, and sick leave, but not for disability leave or other unpaid leave, for up to forty (40) hours per week. A Retired Annuitant is not eligible for bilingual pay compensation. SECTION 6. Longevity pay compensation shall be paid to qualified regular full-time and part-time employees hired prior to January 1, 2015, consistent with the qualification requirements approved in a Memorandum of Agreement between the City of Moorpark and the Service Employees International Union CTW, CLC, Local 721 as follows: 121 to 180 Months of service — one-percent(1%), 10 5 181 to 240 Months of service — one and one-half percent (1.5%), Resolution No. 2016- Page 5 241 to 300 Months of service —two percent (2.0%) 301 or more Months of service — two and one-half percent (2.5%); and Longevity pay compensation shall be paid to qualified Non-Competitive Service employees hired prior to January 1, 2015, consistent with the qualification requirements approved in a City Council adopted management benefits resolution as follows: Department Heads and City Manager 61 to 120 Months of service — one percent (1.0%) 121 to 180 Months of service — one and one-half percent (1.5%) 181 to 240 Months of service —two percent (2.0%) 241 to 300 Months of service — two and one-half percent (2.5%) 301 or more Months of service —three percent (3.0%) City Manager 361 or more Months of service —three and one-half percent (3.5%) Management Employees 121 to 180 Months of service — one percent (1.0%) 181 to 240 Months of service — one and one-half percent (1.5%) 241 to 300 Months of service — two percent (2.0%) 301 or more Months of service —two and one-half percent (2.5%). Implementation of salary adjustments for positions noted in Section 1, herein, shall be limited by the performance review system. Employees shall be evaluated prior to their anniversary date, and approved salary adjustments shall be effective as of the first day of the pay period in which the anniversary date occurs. A Retired Annuitant is not eligible for merit raise salary adjustments pursuant to a performance review system, based on the limited term of the Retired Annuitant appointment. paycheck dated July 29, 2016Janua 13 2017. Resolution No. 2016-352732 is hereby rescinded in its entirety upon the effective pay period for and this revised Salary Plan,with the paycheck dated July 29, 2016 shall become effective with the pay period beginning December 24, 2016.
