Bobardt, Community Development Director DATE: March 7, 2017 (CC Meeting of 3/15/2017) SUBJECT: Consider Resolution Rescinding Resolution No. 2005-2362, Thereby Eliminating the Gabbert Road/Casey Road Area of Contribution (AOC) and Finding this Action is not a Project Subject to Environmental Review under the California Environmental Quality Act BACKGROUND/DISCUSSION The County of Ventura established the Gabbert Road/Casey Road AOC in 1981, along with the Los Angeles Avenue AOC and Spring Road/Tierra Rejada Road AOC. The intent of the Gabbert Road/Casey Road AOC was to provide a funding mechanism for improvements to Gabbert Road for 3,000 feet north from the railroad tracks to provide a full two-lane road with shoulders and drainage facilities, and Casey Road for 500 feet west from Walnut Canyon Road to residential collector standards. The original fee was established at $1,000.00 per lot to be collected upon approval of final tract maps in an area generally bounded by Walnut Canyon Road to the east, the Union Pacific railroad tracks to the south, a line just west of the Pentair Pool Products site extending north to and including Grimes Canyon Road to the west, and what would become Moorpark's northerly boundary to the north. A copy of the original AOC study and map are attached. In the time from its establishment until incorporation of Moorpark, the County collected $27,000.00 from one development project. With interest, the County had $27,178.01 when Moorpark incorporated. Upon incorporation, the funding that was collected and the responsibility for the AOC improvements were transferred to the City. Over time, the City had increased the fee based on the Engineering News Record Construction Cost Index. The last update was in 2001, when the fee was increased to $2,030 per residential lot and $6,428.00 per acre of non-residential development. This 2001 fee resolution also included updates to the fee for the Spring Road/Tierra Rejada Road AOC. When the Spring Road/Tierra Rejada Road AOC fee was further updated in 2005, a separate resolution (2005-2362) 6 Honorable City Council March 15, 2017 Page 2 was adopted for the Gabbert Road/Casey Road AOC to keep the fee the same as amended in 2001. A copy of this resolution is attached. Some of the funding collected through the Gabbert Road/Casey Road AOC was already used for improvements to Gabbert Road. The AOC fund currently has a balance of $97,070.34. However, the primary construction of future improvements to Casey Road and portions of Gabbert Road is expected to be the responsibility of adjacent approved and proposed development projects. The actual construction of these improvements is not expected for several years so the currently available funds will be used to make some of the necessary improvements in the next few years. As this construction responsibility of future projects has long been anticipated, development projects within the AOC boundaries, including Moorpark Country Club Estates, Masters at Country Club Estates, and Meridian Hills have not been required to contribute to the Gabbert Road/Casey Road AOC. No Gabbert Road/Casey Road AOC fees have been collected in over 10 years. For Gabbert Road, approved Tentative Tract Map No. 5906 (A-B Properties) is conditioned to improve Gabbert Road from Poindexter Avenue to a transition north of the future North Hills Parkway. Other proposed projects, including the Hitch Ranch Specific Plan and Tentative Tract Map No. 5847 (Westpointe Homes) will be conditioned to construct these improvements if they have not already been completed by the Tentative Tract Map No. 5906 project. For Casey Road, Essex Apartments is responsible for widening along Casey Road to extend the queueing for the intersection at Walnut Canyon Road. The Aldersgate Investment senior community and the Hitch Ranch Specific Plan will also be responsible for future improvements to Casey Road, including widening on the north side. With the physical improvements being addressed by adjacent development, future contributions to this AOC are no longer necessary, and staff recommends rescinding the current fee, and thus rescinding the Gabbert Road/Casey Road AOC. The remaining balance in the Gabbert Road/Casey Road AOC would be available for future City projects within the described area of improvements. ENVIRONMENTAL REVIEW Changing the funding mechanism for future public improvements by eliminating the Gabbert Road/Casey Road AOC fees is not a project subject to environmental review under the California Environmental Quality Act in that it would not result in a physical change to the environment. FISCAL IMPACT Future improvements to Gabbert Road and Casey Road will be funded by adjacent development. Purpose This report provides documentation to support establish- ing a "Gabbert Road/Casey Road Area of Contribution" to collect fees from future development. Fees collected will be used to finance highway improvements within the area to accommodate the transportation needs resulting from the growth and development in the northwestern portion of the Moorpark Area. II . Area Limits The area of contribution is generally bounded on the south by the Southern Pacific Railroad ; on the west by a line Capproximately 6000 feet west of and parallel to Gabbert Road; on the northwest by Grimes Canyon Road ; on the north by a line approximately 2800 feet south of and parallel to Broadway; and on the east by Walnut Canyon Road, excluding the Moorpark High School and the Walnut Grove Tract, as shown on the map attached as "Appendix A" . III. Setting The area is comprised of approximately 3 . 6 square miles of developable land consisting ofhillsides, mesas and valleys . Except for Gabbert Road , there are presently no publicly maintained roads in the area. Deve4:§pment with- in the area will impact the rural setting and increase traffic beyond the capacity of Gabbert and Casey Roads . -1- 11 IV. Proposed Improvements Gabbert Road from the railroad tracks to a point approxi- mately 3000 feet northerly will be reconstructed and widened to a full two lane road with shoulders and drainage facilities. Casey Road from Walnut Canyon Road approximately 500 feet westerly will be improved to a residential collector standard with concrete curb and gutter. V. Basis for Future Assessment Approximately 300 single family lots are proposed within the area of contribution between 1980 and 1991. Based on estimated needs of $300, 000 it will be necessary to impose a fee of $1,000 on each lot. The October, 1980 cost of $1000 per lot will be adjusted on an annual basis to account for inflation. The annual adjustment will be equal to the increase or decrease in the Engineering News Record Highway Bid Price Index for California during the same period. This index is a nationally recognized indicator of changes in highway construction costs. Interest on the deposited funds will not offset the increase in inflation, therefore, the adjustments are necessary to provide adequate funding for the reconstruction of Gabbert Road and Casey Road. VI . Collection of Fees Fees will be collected at the time of approval of the final tract map or parcel map. Fees collected will be deposited in an account entitled 'Gabbert Road/Casey Road Area of Contribution" and will not be refundable. If a Developer, with the approval of the Director of Public -2- 12 , 7) , . I � - ,.I. ......L5.1. _- .._._ uII Il f..r• nil .-..:.....__�..... -- RESOLUTION NO. 2005-2362 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, RE-ADOPTING THE GABBERT ROAD/CASEY ROAD AREA OF CONTRIBUTION FEES WHEREAS, the County of Ventura established certain areas of contribution in 1981 to provide a method of collecting fees from future development projects and to promote orderly growth, such fees to be used to finance specific street improvements; and WHEREAS, upon incorporation of the City of Moorpark, the County of Ventura transferred responsibility for the administration of these Areas of Contribution to the City; and WHEREAS, since the incorporation of the City, the City has periodically made adjustments to these fees. and the improvements to be funded by said fees; and WHEREAS, by separate action on the date of the adoption of this Resolution, the City Council revised the fees for the Spring Road/Tierra Rejada Road Area of Contribution (SP/TR AOC) by rescinding Resolution No. 2001-1848 and adopting a new Resolution; and WHEREAS, said Resolution No. 2001-1848 included the current fees for the Gabbert Road/Casey Road Area of Contribution (GB/CSY AOC) ; and it is necessary, therefore, to re-enact those fees; and WHEREAS, it is the intent of the City Council, by the adoption of this Resolution, to re-adopt the GB/CSY AOC fees, unchanged. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. Traffenstedt, City Clerk (seal) Pire:14K°",... 17 RESOLUTION NO. 2017- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, RESCINDING RESOLUTION NO. 2005-2362, THEREBY ELIMINATING THE GABBERT ROAD/CASEY ROAD AREA OF CONTRIBUTION (AOC) AND FINDING THIS ACTION IS NOT A PROJECT SUBJECT TO ENVIRONMENTAL REVIEW UNDER THE CALIFORNIA ENVIRONMENTAL QUALITY ACT WHEREAS, the County of Ventura established certain areas of contribution in 1981 to provide a method of collecting fees from future development projects and to promote orderly growth, such fees to be used to finance specific street improvements; and WHEREAS, upon incorporation of the City of Moorpark, the County of Ventura transferred responsibility for the administration of these Areas of Contribution to the City; and WHEREAS, the fees for the Gabbert Road Road/Casey Road AOC have been amended from time to time, most recently being set by the City Council through Resolution No. 2005-2362; and WHEREAS, the future improvements identified in the Gabbert Road/Casey Road AOC will be the responsibility of future adjacent development so that a funding mechanism through AOC fees is no longer needed; and WHEREAS, the Community Development Director has determined that the changing of the funding mechanism for future public improvements by eliminating the Gabbert Road/Casey Road AOC fees is not a project subject to environmental review under the California Environmental Quality Act. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. Environmental Review. The City Council, through its independent judgment and analysis, concurs with the Community Development Director that the changing of the funding mechanism for future public improvements by eliminating the Gabbert Road/Casey Road AOC fees is not a project subject to environmental review under the California Environmental Quality Act. SECTION 2. Resolution No. 2005-2362 is hereby rescinded. SECTION 3. The funds in the Gabbert Road/Casey Road AOC shall be expended consistent with the intended purpose.
