Prepared By: Shaun Kroes, Program Manager `7 DATE: March 3, 2017 (CC Meeting of 03/15/17) SUBJECT: Consider Amendment No. 2 to Cooperative Agreement with the Ventura County Transportation Commission for Administration of Funds from the Proposition 1B Public Transportation Modernization,Improvement and Service Enhancement Account BACKGROUND On October 5, 2012, the Ventura County.Transportation Commission (VCTC) approved two applications from the City of Moorpark (City) for Proposition 1B (Prop 1B) Public Transportation Modernization, Improvement and Service Enhancement Account (PTMISEA) for the following projects and amounts: 1. Two replacement compressed natural gas (CNG) buses ($774,000.00). The new buses will replace two existing diesel buses (2005 El Dorado MST II model). 2. Expansion of the Metrolink North Parking Lot and slurry seal of the existing Metrolink North Parking Lot ($317,000.00). The City completed procurement of the replacement buses in January of 2016. On June 1, 2016, the City signed Amendment No. 1 to the Cooperative Agreement,which enabled the City to transfer approximately $10,000.00 in accrued interest associated with funding allocated to the bus replacement project to the Metrolink North Parking Lot project. DISCUSSION The original Cooperative Agreement has an expiration date of June 30, 2017. Originally, all grant monies were to be expended and the projects completed by the June 30, 2017 deadline. The City is currently at 90%design completion and staff has inquired with VCTC staff about extending the deadline. The City and VCTC are working to establish a maintenance agreement for the Metrolink Train Station, including the improved Metrolink 55 Honorable City Council March 15, 2017 Page 2 North Parking Lot, prior to construction beginning. In addition, City staff would like to complete construction of the Metrolink South Parking Lot second entrance prior to construction of the Metrolink North Parking Lot. Completing the second entrance would create easier access in and out of the Metrolink South Parking Lot for commuters who will not be able to access the Metrolink North Parking Lot while it is under construction. Staff at VCTC confirmed that the Cooperative Agreement could be extended. Although an extension through 2022 is available, City staff is requesting an extension through December 31, 2019. It should be noted that although the Cooperative Agreement will be extended through 2019, it is staffs intention to have construction at both parking lots completed by the end of 2017. FISCAL IMPACT Extending the Cooperative Agreement will enable the City to continue to fund the Metrolink North Parking Lot Expansion Project(CIP 8063)with$317,000.00 of Prop 1B funds plus all accumulated interest (currently estimated at around $25,000.00). STAFF RECOMMENDATION Approve Amendment No. 2 to the Cooperative Agreement subject to final language approval by the City Manager and authorize the Mayor to sign. Attachment: Amendment No. 2 to the Cooperative Agreement 56 AMENDMENT #2 TO COOPERATIVE AGREEMENT BETWEEN THE VENTURA COUNTY TRANSPORTATION COMMISSION AND THE CITY OF MOORPARK THIS AMENDMENT #2 to the Cooperative Agreement between the Ventura County Transportation Commission and the City of Moorpark regarding the administration of funds from the Proposition IB Public Transportation Modernization, Improvement and Service Enhancement Account (PTMISEA) ("the Agreement") is entered into between Ventura County Transportation Commission (VCTC) and the City of Moorpark, this day of 2017. WHEREAS, at its October 5, 2012 meeting, VCTC authorized the programming of$317,000 of PTMISEA funds, plus any interest on the funds which may have accrued, for the Moorpark Metrolink North Parking Lot project; and WHEREAS, the performance period stated in Section 11(4) of the Agreement requires all funds allocated under the grant to be expended by June 30, 2017 and all funds remaining unexpended thereafter to revert to Caltrans; and WHEREAS, the Metrolink North Parking Lot project will need additional time to be completed; and WHEREAS, VCTC and the City of Moorpark desire to extend the performance period to December 31, 2019. NOW THEREFORE THE PARTIES DO AGREE TO AMEND THE AGREEMENT AS FOLLOWS: 1. Section 11(4) of the Agreement is revised to read: Grant Performance Period: Funds allocated under this grant shall be expended by December 31, 2019. Funds remaining unexpended thereafter shall revert to Caltrans. 2. There are no other changes to the Agreement made by this amendment and all provisions of the Agreement remain in full force and effect. 57 CITY OF MOORPARK VENTURA COUNTY TRANSPORTATION COMMISSION Janice S.
