To: Honorable City Council From: Nancy Burns, Senior Management Analyst Date: June 14, 2001 (CC Meeting of June 20, 2001) Subject: CONSIDER TRANSFER OF LAND WITHIN GISLER FIELD SITE (TRACT NO. 5161, RESIDENTIAL PLANNED DEVELOPMENT NO. 98 -7) FROM CITY OF MOORPARK TO MOORPARK REDEVELOPMENT AGENCY BACKGROUND The sale escrow for this project, wherein the Moorpark Redevelopment Agency is selling approximately seven and one half (71,i�) acres to Cabrillo Economic Development Corporation for the development of fifty -nine (59) single family residences, including fifteen (15) Affordable Units, is nearing closure. All conditions required by the City or Redevelopment Agency by closing have been satisfied or waived. It was recently confirmed eight (1,208) square feet buildout of Gisler Road as owns the property contained DISCUSSION that approximately twelve hundred of Poindexter Park is needed for the part of Tract 5161. The Agency still in Tract 5161. Neither the Final Map for this project nor the Preliminary Title Report for the site to be sold to Cabrillo Economic Development Corporation for residential development revealed that a portion of land included at the eastern edge of the site is owned by the City, rather than the Redevelopment Agency. Early discussions with the developer about the project included a need identified by the developer for additional land to maximize the number of units which could be developed at the site. However, this was Honorable City Council Date 06/14/01 Page 2 not formalized by deeding any land to the Agency, to be part of the site. This matter was subsequently discovered by the title company, as final preparations for closing were being made. Exhibit "A ", to be provided under separate cover, shows the property in question. At its widest point, the piece of land is approximately forty -one (41) inches wide, and tapers to zero width. The length of this land is approximately three hundred eighty -seven (387) feet. Total area of the piece of property is estimated to be twelve hundred eight (1,208) square feet. In order to consummate the sale transaction of the site, said portion of land must be accounted for in the transfer of title to the purchaser, Cabrillo Economic Development Corporation. This may be done through a Grant Deed conveying title to the Redevelopment Agency, for which the City would receive monetary consideration. Such payment would be repaid by the developer through escrow, and title to this portion of land would be conveyed to the developer. A recently acquired parcel needed for right of way for Gisler Road, approximately thirty -seven hundred twenty -seven (3,727) square feet in size, was sold to the developer for twenty -four thousand dollars ($24,000). This equates to approximately six dollars forty -four cents ($6.44) per square foot. The recency of this transaction, and the similarity of its purpose to the need for the piece of land referenced in this report, confirm comparability. At the rate of $6.44 per square foot, the approximate value of the piece of land discussed herein is seventy -seven hundred eighty dollars ($7,780). In addition, another matter has recently come to light regarding the north /south street through the project. The City has interest to the street, both in fee title as well as in easement for right of way for public use. Although the City can abandon its interest in easement, it cannot abandon its fee title interest. The fee interest must be conveyed to the Redevelopment Agency. This may be done either through a Grant Deed or a Quitclaim Deed. After the close of escrow, the street will be dedicated to the City. This matter was not picked up earlier by the title company. Authorize sale to Moorpark Redevelopment Agency for $7,780, with subsequent resale to Cabrillo Economic Development Corporation; and 2. Authorize the execution of a Quit Claim Deed to transfer the City's fee ownership of the north /south street through this site to the Moorpark Redevelopment Agency.
