DISCUSSION: A report concerning this proposal by Moorpark College was requested following receipt of the referenced letter by the City Manager. Additional information relating to the proposal has now been received for Council evaluation including: 1. The swap meet will be held every Sunday, from 6:00 a.m. to 2:00 p.m. 2. The proposed location is in the parking lot at the northeasterly end of the campus (see Attachment "B ") in an area that is not contiguous to any residences. 3. The first date of the swap meet is now scheduled for May 2, 1999. The swap meet operator is Metropolitan Theaters, who has lost their lease at the drive -in theater on Tierra Rejada Road in Simi Valley. 5. Traffic generated by the swap meet is anticipated to be 800 -1000 cars, about the same as generated by Saturday instructional classes and will be channeled in a counter clockwise pattern around Campus Road. (Note: Currently both Campus Road [private road on campus] and Collins Drive are two way streets that meet at University Drive. Limiting the directional flow on Campus Road can be directed by the College as deemed appropriate, however, altering the directional flow on Collins Drive, which becomes Campus Road at University Drive west of the Library would require City approval. Conversation with the Police Department Traffic Division concluded that a one way flow for Campus Road could be accomplished for this limited purpose, but doubted that it would be necessary for the proposed swap meet.) 6. The College will provide traffic control and security. (Note: Traffic control and security on the College campus are normally handled by Moorpark College Police personnel, while adjacent City streets are patrolled by the Moorpark Police Department. When there are special activities on campus that could impact the surrounding residential area the Moorpark Police Department is notified in advance. Any need for traffic control on City streets would need to be funded by the College.) 7. Proceeds from the swap meet based upon the contract agreement between the operator and the College will benefit the College Foundation. 8. Site clean up after the swap meet will be handled by a private company under contract to the College. 9. There will be no permanent structures allowed for the swap meet. 10. The parking lot that will be utilized for this event is completely paved. MACLafleurUMMoorpark Collegeftap Meet on Campus.doc () 001.lz1") Honorable Mayor and City Council Swap Meet - Moorpark College April 7, 1999 Page 3 Research of Planning Department files indicates that a swap meet was first held on the Moorpark College Campus in October 1993, following the issuance of Zoning Clearance No. 93 -228, (Attachment "C ") authorizing a Temporary Special Use Permit with the concurrence of City Council. The swap meet activity was authorized from 6:00 a.m. to 7:00 p.m. on Sundays, and 10 other days throughout the year. The swap meet was discontinued in January 1994, because of an apparent lack of success by the operator. When first proposed in September of 1993 the College was informed by the Community Development Director that a Conditional Use Permit was required to permanently establish the use, and that the Temporary Special Use Permit would suffice only during the course of processing of the application to permanently establish the use. The college site is designated as OS- 2 (Open Space 1 du /40 ac) by the General plan and is zoned OS (Open Space). The zoning ordinance includes festivals and similar events as a use permitted in the OS zone with a City Council approved Conditional Use Permit. On September 29, 1994, an application was received from Moorpark College for a Conditional Use Permit (CUP 94 -2) and Environmental Initial Study, proposing establishment of the swap meet at the College Campus on the parking lot similar to the activity held in 1993. The application was determined to be incomplete and there is no record of a revised submittal or hearings held by Planning Commission or Council. There was, however, a second Zoning Clearance issued for a swap meet on October 21, 1994 (Attachment "D "), which was authorized for issuance by the City Council after consideration of a report on the request at their meeting of October 5, 1994 (Attachment "E ") . There are no additional records of activity concerning this swap meet. In conjunction with this latest effort by the College to establish a swap meet on campus, the College President recently met with the Campus Hills Homeowners Association to explain the proposal and respond to concerns over potential traffic problems. A copy of a letter from a resident near the College expressing concern to the College President over traffic is attached to this report (Attachment "F "). RECOMMENDATION: Direct staff as deemed appropriate. Our intent is that the Moorpark College Foundation will enter into an agreement to host a Swap Meet on campus between the hours of 6:00 a.m. and 2:00 p.m. on Sundays. It is hoped that the start date will be April 4. We confirm that vendors will be required to obtain business licenses from the City, that no hazardous materials will be stored or generated on -site, and that all Ventura County Fire Department and Environmental Health Department requirements will be met. Additionally, it is our intent to work closely with our neighbors to ensure they will not be negatively affected by this activity. This Temporary Special Use Permit is issued pending completion of and processing of an application for a Planning Commission approved Conditional Use Permit for an open air swap meet which shall be restricted to sale of new and handcrafted items, produce, and food authorized by the County Environmental Health Department. 2. The applicant was to file an application for a Conditional Use Permit by November of 1993. However, the College did not file in November and- ceased to operate the swap meet in January, 1994. Temporary outdoor events such as swap meets are allowed in the Institutional Zone with approval of a Planning Commission Conditional Use Permit. Discussion On September 29, 1994, Moorpark College submitted an application for a,Conditional Use Permit for operation of a swap meet on weekends. The applicant has indicated that they would like to operate the swap meet on Saturday and Sundays from 7:00 to 4:00 p.m. As was the situation last year, all vendor and customer activity will be in parking lot C, with customer parking to be located in parking lot B (see attached plot plan). Last year, the City received no complaints from surrounding property owners related to noise or traffic. The purpose of the applicant's request is to generate funds for the College Foundation, which is the institution's non - profit organization dedicated to raising funds for scholarships and campus improvement projects. The swap meet will also present an opportunity for local charities, non - profit groups and youth organizations to make money for their organization. PP09 :30:9919 :55emA :\50CT99.CC 1 ATTACHMENT E (300,141 The current application received by the Department of Community Development is presently incomplete as the applicant is in the process of obtaining surrounding property owner lists to be used during the public hearing notification process for the upcoming Planing Commission hearing for the Conditional Use Permit. As the processing for the Conditional Use Permit could take three months or longer, staff believes that a Temporary Special Use Permit subject to the attached Conditions of Approval could be issued to the applicant authorizing the College to have a swap meet pending the processing and outcome of the Conditional Use Permit. Revenue Consideration During the previous process a year ago, staff discussed with the Council the concept of allowing the City to assess a portion of the revenue generated by the swap meet. The City Council decided against the idea. The applicant has now applied for a Conditional Use Permit and will intend to operate a swap meet for a long period of time. Staff believes it to prudent to discuss the issue in it's recommendations on the Conditional Use Permit. Zone Ordinance Amendment On May 13, 1992, the City Council adopted an updated General Plan Land Use Element which as a part included new Public Institutional and Open Space designations for properties such as the Moorpark College property. On May 18, 1994, the City Council initiated a Zoning Ordinance Amendment approving Zone Ordinance Change No. 94 -2 and amending Article 18 (Zoning Ordinance), for General Plan and Zoning Ordinance consistency purposes. Staff is currently in the procesp of preparing the Zoning Map Amendment to change the Zoning Of Moorpark College from RE- 1 acre to Institutional to make it consistent with the Land Use Element of the General Plan. As previously stated, temporary outdoor events such as swap meets are allowed in the Institutional Zone with approval of a Planning Commission Conditional Use Permit. Recommendation Authorize the Director of Community Development to issue a Temporary Special Use Permit to allow the open air swap meet subject to the attached Conditions of Approval. Attachments: 1. ', • 0 CONDITIONS OF APPROVAL TEMPORARY SPECIAL USE PERMIT MOORPARK COLLEGE OPEN AIR SWAP MEET 1. This Temporary Special Use Permit is issued pending completion of and processing of an application for a Planning Commission approved Conditional Use Permit for an open air swap meet which shall be restricted to sale of new and handcrafted items, produce, and food authorized by the County Environmental-Health Department. 2. The hours of operation (for setup, operation of the market and cleanup) shall be on Saturday and Sunday only between the hours of 6:00 a.m. and 7:00 p.m. Operation of the swap meet any other day is not allowed. 3. Any expansion of uses other than those approved as part of this Temporary Special Use Permit will render the Temporary Special Use Permit void. If deemed necessary discretion of the Director of Community Development, any any changes to this permit must be approved by the Director of Community Development or the City Council. 4. This Temporary Special Use Permit is approved for three months, and will expire on initial approval date, the applicant shall 9pursue completion of the application for the Conditional Use Permit. Upon request of the applicant, the Director of Community Development may extend the Temporary Special Use Permit three month period if the Conditional Use Permit application has been deemed complete, but not yet acted upon by the Planning Commission. 5. The parking lots to be used will be as follows: All vendor and customer activity will be in parking lot C with customer parking located in Parking Lot B as shown on the attached Plot Plan. If access for automobiles is to be provided in parking lot C, a two way driveway with a minimum 20 foot width must be maintained. 6. Any conditions of the Ventura County Fire Department shall be met, and the City shall be provided the Fire Department conditions prior to use inauguration of the swap meet. 7. Any condition of the Ventura County Environmental Health Department shall be met, and the City shall be provided the Ventura County Environmental Health_ conditions prior to Use Inauguration of the swap meet. All requirements and enactments of Federal, State, Ventura County, the City authorities and any other governmental entities, and all such requirements and enactments shall, by reference, become conditions of this permit. 9. A sign permit shall be obtained for any on -site signs. The design, location, colors and dates of erection are subject to review and approval of the Director of Community Development, prior to installation. 10. The applicant shall install one directional sign at the northeast corner of the intersection of Collins Drive and Campus Park Drive on College District property prior to the beginning of the swap meet each day . The signs shall be removed at the end of each day the swap meet is held. No signs are to be located within the City right -of -way or off - site. 11. Security and traffic control on College District property shall be provided by the Moorpark College Police. 12. Trash receptacles shall be provided and trash shall be disposed of during the hours of operation and at the conclusion of each swap meet event. 13. The applicant shall accept responsibility for, and if necessary reimburse the City for any expenses incurred as a result of the operation of the swap meet, including, but not limited to trash cleanup, police services, or repairing damage to City facilities. The applicant will be billed for any City staff or contractor time expended to perform such services. Payment of any such billing shall be made to the City within ten (10) calendar days of receipt of the City's billing. 14. All Vendors shall obtain a Business Registration from the City of Moorpark prior to participating in the swap meet. The applicant shall be responsible for requiring verification from each vendor that a City Business Registration has been obtained from the City prior to allowing them to participate in the swap meet. 15. The applicant is required to obtain verification that all vendors associated with the swap meet complete the reporting form from the State Board of Equalization pertaining to sales tax earned while selling goods at the swap meet. A copy of each form shall be provided to the City each Monday (or next day if Monday is a holiday). 16. Failure to comply with any of the Temporary Special Use Permit conditions shall be cause for revocation of said Temporary Special Use Permit for the use. I am wondering why Moorpark College intending to destroy the very good image of our Campus Hills, instead being a leaders to improve it and build a real friendly relation with the homeowners. Whoever's suggested this idea and you approved it means nothing but the destruction to our Campus Hills and its reputation. We believe we have too much traffic now Mondays - Saturdays in our area, so please leave Sundays as a quite day for the homeowners to enjoy. We strongly ask you to back up on this idea.
