BACKGROUND: At the February 2, 1999 meeting, City Council adopted Resolution 99 -1578 establishing new procedures for the review and processing of General Plan Amendment Pre - screening applications. The Council resolution also required that fees established for this new process should be subject to full cost accounting practices of the City. Council directed staff to prepare appropriate notice, staff report and resolution for consideration of adoption of a fee at the meeting of April 21, 1999. DISCUSSION: California Government Code Section 66014 permits cities to establish fees for development project reviews or applications. This code requires that the fee proposal be discussed at a public meeting, with interested parties provided an opportunity to comment. After such public discussion, the legislative body may adopt the recommended fee by ordinance or resolution. State law limits the effective date of any new or changed fees for the processing of development projects to no sooner than 60 days following final action on the adoption of the new fee. Only one fee change is being proposed at this time, involving the addition of a new fee for the recently adopted General Plan Pre - screening application procedure. Based upon the criteria for the processing of these applications, more definitive formal information is required, two public hearings will be required, M:\ JLibiez\ M \feeamndmntstaffreport42199.doc ^ r ()0&Z,0 City Council Agenda Report General Plan Pre - screening Application Fees April 21, 1999 Page 2 public notice will be required, and considerable staff time will be required to process, schedule, review and analyze these pre- screening applications. Based on this heightened analysis, staff is recommending that the fee be a deposit fee and that these applications be subject to full cost recovery from the applicants. It is estimated that at least twenty hours of staff time will be required, on an average, to process these applications. The current charge rate for Community Development Staff is $88.00 per hour (effective 2/2/99). Therefore the recommended deposit fee is $1760.00 plus $7.50 per acre. Since the proposed fee is a deposit, any unused funds would be returned to the applicant, or with a written request, could be applied to entitlement request on the site of the pre- screening application. Resolution 99 RESOLUTION 99- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, STATE OF CALIFORNIA, ESTABLISHING A SCHEDULE OF LAND USE DEVELOPMENT PRELIMINARY PROCESSING FEE DEPOSITS AND RESCINDING RESOLUTION NO. 98- 1551 WHEREAS, the City of Moorpark provides land use development planning services; and WHEREAS, the City Council has determined that the cost of these services shall be offset by fees which accompany land use entitlement requests; and WHEREAS, the Community Development Department staff costs are charges against fees, based upon real time cost accounting; and WHEREAS, the City Council did consider and adopt Resolution 98- 1551 which established a schedule of land use development processing fees on December 2, 1998; and WHEREAS, subsequent to the adoption of Resolution 98 -1551, which became effective on February 2, 1999 pursuant to Government Code Section 66016, the City Council did consider and adopt under Resolution 99 -1578 new procedures for the processing of General Plan Amendment Pre - screening applications, not previously a portion of the City's entitlement procedures; and WHEREAS, a fee for such entitlement is necessary; and WHEREAS, it is necessary to differentiate within certain fee categories, fees consistent with the demands for staff time for specific forms of applications. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. That the Community Development Department staff shall bill actual time spent on land use applications at a real time cost accounting rate of $88.00 per hour. SECTION 2. SECTION 3. That the Community Development Code Enforcement staff shall bill actual time spent on land use applications and other items eligible for cost recovery at a real time cost accounting rate of $82.00 per hour. SECTION 4. That the Administrative Services staff shall bill actual time spent on land use applications and other items eligible for cost recovery at a real time cost recovery rate of $90.00 per hour. SECTION 5. That the Director of Community Development has the authority to reduce certain deposit amounts up to fifty percent (50 %), where the project involves multiple applications of the same type of project on the same property, to be processed concurrently. SECTION 6. That the schedule of Land Development Preliminary Processing Fee Deposits shall be as identified as those revised fees shown in "Exhibit A" to this Resolution. SECTION 7. That this Resolution shall become effective sixty days (60) following the public meeting held on April 21, 1999, pursuant to Government Code Section 66016, (June 20, 1999) implementing those changes to the fees described herein immediately upon the effective date set forth herein. SECTION 8. That Resolution No. 98 -1551 adopted the 2nd day of December, 1998, is hereby repealed upon the effective date of this Resolution. SECTION 9. That the City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original Resolutions.
