Nowak, Assistant City Manager c=Nnp 07 April 1999 (Council meeting of 04- 21 -99) SUBJECT: Consider Agreement to Purchase Tax - Defaulted Properties BACKGROUND: At its meeting of December 2, 1998 the City Council issued an objection to the sale of five (5) tax - defaulted properties within the City. At the default deadline of February 26, 1999 two (2) of the parcels were not redeemed for the back taxes. The City has the opportunity to purchase those two parcels at the default price. DISCUSSION: On December 2, 1998 the City Council approved an objection to the sale of five (5) tax - default properties in the City. This gave the City the opportunity to purchase the parcels if not redeemed by the established date, which was February 26. Two (2) parcels were not redeemed: 284 Charles Street - APN 512 -0- 093 -070 436 Charles Street - APN 512 -0 -081 -040 The outstanding taxes owed on both properties were $23,000. An additional $1,500 would be owed for the County's noticing costs. The full $24,500 can be paid from the City's CDBG Affordable Housing project. The City Council must approve the "Agreement to Purchase Tax - Defaulted Property" in order for the acquisition to proceed. 00 � �.; Tax - Defaulted Properties Meeting of 21 April 1999 Page 02 RECOMMENDATION: (ROLL CALL VOTE) Staff recommends that the City Council authorize the Mayor to execute the "Agreement to Purchase Tax - Defaulted Property" and the City to pay the amount of $24,500 from its Community Development Block Grant funds for the acquisition costs. Attached: Agreement Map showing properties AGREEMENT TO PURCHASE TAX - DEFAULTED PROPERTY This Agreement is made this 31st day of March, 1999, by and between the Board of Supervisors of Ventura County, State of California, and The City of Moorpark, a municiple corporation, as a taxing agency (PURCHASER *), pursuant to the provisions of Division 1, Part 6, Chapter 8, of the Revenue and Taxation Code. The real property situated within said county, hereinafter set forth and described in Exhibit "A" attached hereto and made a part hereof, is tax - defaulted and is subject to the power of sale by the tax collector of said county for the nonpayment of taxes, pursuant to provisions of law. It is mutually agreed as follows: That as provided by Section 3800 of the Revenue and Taxation Code, the cost of giving notice of this agreement shall be paid by the PURCHASER, and 2. That the PURCHASER agrees to pay the sum of $24,500.00 for the real property described in Exhibit "A" within 14 days after the date this agreement becomes effective. Upon payment of said sum to the tax collector, the tax collector shall execute and deliver a deed conveying title to said property to PURCHASER. That said PURCHASER will not share in the distribution of the payment required by this Agreement. If all or any portion of any individual parcel listed in Exhibit "A" is redeemed prior to the effective date of this agreement, this agreement shall be null and void as to that individual parcel. This agreement shall also become null and void and the right of redemption restored upon the PURCHASER'S failure to comply with the terms and conditions of this agreement. §§ 3791, 3791.3, 3793 R &T Code ^T The undersigned hereby agree to the terms and conditions of this agreement and are duly authorized to sign for said agencies.
