SUBJECT: Consider releasing Surety Bond No. SCR 709 -53 -29
for work associated with widening improvements on
New Los Angeles Avenue in conjunction with Parcel
Map 3828 (Moorpark R &T Center).
BACKGROUND
On January 8, 1985 an improvement surety was executed
between Moorpark R &T Center (Simi- Moorpark Freeway
Properties, LTD) and The American Insurance Company
(Surety). The surety bond was put in place to guarantee
performance and payment for work associated with Parcel Map
3828 in the City of Moorpark. The work guaranteed by the
bond was for the widening of the north side of New Los
Angels Avenue (six (6) lanes total) at the north east
corner of Science Drive and Los Angeles Avenue.
DISCUSSION
Subsequent discussions between the Developer, Caltrans and
City Staff resulted in modifications to the scope of work
on the north side of Los Angeles Avenue. It was agreed
that full widening improvements (street, curb, gutter and
sidewalk) would be completed on the south side of the
Avenue with only curb and gutter improvements on the north
side. The south side widening improvements are to be
completed in conjunction with the Tract 4973 development.
To satisfy City and Caltrans requirements for the widening
work on the south side, Simi - Moorpark Freeway Properties,
Ltd., obtained a Caltrans encroachment permit and submitted
a surety in the amount of $450,000 (bond No. 3SM 890 936

00). The surety was put in place to guarantee south side
widening improvements as well as the curb and gutter
improvements on the north side.
Improvements to the north side of Los Angeles Avenue are
guaranteed by both the Tract 4973 bonds and the Parcel Map
3828 bonds. As such, Simi - Moorpark Freeway Properties,
Ltd. requests that bond No. SCR 709 5329 be exonerated.
Although widening improvements have been completed,
Caltran's replacement bond (3SM 890 936 00) remains in
place.
RECOMMENDATION
1. Authorize the City Clerk to exonerate bond
No. SCR 709 -53 -29
