Traffenstedt, Senior Planner -1)5-r DATE: March 25, 1997 (CC Meeting of 4 -2 -97) SUBJECT: CONSIDER DRAFT COMMENTS ON MITIGATED NEGATIVE DECLARATION AND INITIAL STUDY FOR M- MAINTENANCE CONSTRUCTION CLEAN -UP, INC., COUNTY OF VENTURA CONDITIONAL USE PERMIT (CUP) NO. 4970 M- Maintenance Construction Clean -up has submitted an application for a CUP to the County of Ventura to use 14.5 acres of a 205 -acre developed parcel off of Shekell Road for recycling materials recovered from new residential construction sites. The proposed project site was previously used as an egg ranch (Egg City) for approximately 30 years and is located north of the City of Moorpark, at the intersection of Shekell Road and State Highway 23 (see attached location map). No new construction or site development is proposed. The proposed permit area includes five concrete pads, surrounded and separated by a 30 -foot asphalt roadway, and an existing 6,240 square foot warehouse that will be used for the recycling operations. The proposed hours of operations will be Monday through Friday 7:00 a.m. to 5:00 p.m. and Saturday 8:00 a.m. to 1:00 p.m. Following in the Discussion Section are recommended comments on the Mitigated Negative Declaration and Initial Study that are proposed to be included in a comment letter to the County of Ventura. DISCUSSION 1. Page 14, Noise and Vibration - The conclusion that the project will not result in a significant cumulative traffic noise impact along State Highway 23 through the City of Moorpark is not consistent with the conclusions in the Transit Mixed Concrete Project (County CUP 4933) Final Environmental Impact Report. Page 15, Transportation Circulation, Public Roads and Highways, (1) and (2) Levels of Service and Safety /Design - The City does not concur with the conclusion that the proposed project will not exceed the City of Moorpark thresholds of significance. The referenced Traffic Study dated July 26, 1996, and prepared by Penfield & Smith, incorrectly identifies the City of Moorpark significance criteria for intersections with a level of service (LOS) D or below. For an intersection operating at LOS D, E, or F, the City considers any increase in traffic to be significant, and thus requiring mitigation. In addition, the Traffic Study and Transportation Circulation section in the Initial Study do not adequately address all potential LOS impacts due to outdated traffic count and traffic model information that has been used in the referenced Traffic Study. The outdated traffic information has resulted in an understatement of the projected LOS impacts. Intersections in the City which are projected to operate at LOS D or E in the Year 2005, without improvements, include Moorpark Avenue and Los Angeles Avenue, Spring Road and Los Angeles Avenue, Science Drive and New Los Angeles Avenue, and Tierra Rejada Road and Los Angeles Avenue. Recent traffic count and traffic model information can be obtained from the City's Community Development Department. 3. Page 15, Transportation Circulation, Project Specific Traffic Mitigations - Mitigation Measure (b) was added after the Traffic Study was prepared, and prohibits project related truck traffic on the following roads: north on State Route 23 from Egg City Gate B, all of Stockton Road, lower Grimes Canyon Road (south of Broadway), west on Shekell Road from Egg City main gate, and all of Balcom Canyon Road. This mitigation measure will revise the assumed trip distribution and increase the number of trips on State Routes 23 and 118 through the City of Moorpark. The impacts of this mitigation measure on roadway intersections within the City of Moorpark should be addressed. 4. Page 16, Transportation Circulation, Cumulative Traffic Impact Mitigations - As previously identified, other intersections within the City may also require improvements for cumulative traffic impacts. A mitigation measure should also be included which limits the total number of daily truck and employee trips for the life of the conditional use permit. (The applicant has proposed that the recycling facility will receive a maximum of 50 incoming truck loads per day and that the total number of employees will be 8.) C: \1 -m \staffrpt \cc4- 297.mnd 0("89 M- Maintenance Construction Clean -up To: Honorable City Council March 25, 1997 Page 3 For the record, the County's traffic fee mitigation program does not provide funding for any roadway improvements within the City limits, such as the proposed State Route 23 and 118 bypass arterials. Key intersections along Moorpark Avenue and Los Angeles Avenue will operate at an unacceptable level of service, as defined by the Ventura County Congestion Management Plan and City General Plan, if the future roadway improvements assumed for City and County General Plan buildout are not constructed. The proposed project's cumulative traffic impact is, therefore, considered to be significant and adverse, and we concur with the mitigation requirement for the applicant to participate in any reciprocal traffic mitigation fee agreement between the City and the County that is designed to reduce the cumulative traffic impacts. Given that the City Council previously directed staff to express the City's opposition to the Transit Mixed Concrete Project, which also resulted in cumulative adverse traffic and noise impacts, staff's intent is to include a statement of opposition to the M- Maintenance Construction Clean -up Project in the comment letter to the County.
