FROM: Steven Kueny, City Manager DATE: May 13, 1988 SUBJECT: Proposed Memorandum of Agreement (MOA) with the Public Employees Association of Ventura County (PEAVC) As you will recall in June, 1987, the Council approved a number of modifications to the existing City Personnel Rules and Regulations as part of the agreement with the employee bargaining units. In addition to salary and health plan adjustments, the modifications included the following: 1. Clarification on temporary, out-of-class assignment. 2. Standby and call back pay provisions. 3. Definition of overtime and payment of overtime to four otherwise exempt classifications (Senior Planner, Associate Planner, Finance Officer and Recreation Coordinator) in certain situations. 4. Textbook and tuition. reimbursement. 5. An additional holiday (3rd Monday in January) . 6. Additional use of sick leave and/or vacation in event of Worker's Compensation temporary disability payments. 7. An additional two days of sick leave. 799 Moorpark Avenue Moorpark, California 93021 (805) 529-6864 The Council directed Staff to prepare the Memorandum of Agreement (MOA) for Council consideration and approval. The first draft of the MOA was not received from the Association until December, 1987 and, after three (3) meetings, the attached draft, as presented, was agreed upon. The City has honored all provisions as agreed upon in June, 1987 even without the formal approval of the MOA. The only exception has been the payment of overtime pursuant to Sec. 902B. We will honor any payment accrued prior to approval of the MOA. This involves only a limited number of hours. In addition, we solicited the opinion of the employees concerning their desire to allow payroll deductions prior to MOA approval. The employees requested that we not allow payroll deduction for their Association dues until after approval of the MOA. As stated in Article 2, the Association recognizes the City will not amend any Resolution or Ordinance affected by the MOA until next fiscal year. Until such time as a subsequent MOA is approved, the proposed MOA will supplement the City's existing Personnel Rules and Regulations. STAFF RECOMMENDATION: Adopt Resolution No. 88-'17U approving the MOA and authorize the City Manager to sign it on behalf of the City.
