SUBJECT: Consider Resolution Authorizing Employees with Certain Job
Classifications to Act as a Public Officer to Enforce Vehicle Parking
Violations of State Statute or City Ordinance and Rescinding
Resolution No. 2014-3351
BACKGROUND AND DISCUSSION
Resolution No. 2014-3351 was adopted in December 2014 to update the list of those
employee classifications authorized and trained to issue vehicle parking citations under
California Penal Code Section 836.5 and Moorpark Municipal Code Section 1.10.
The City issues a citation for Municipal Code violations through administrative and
criminal citations. In' order to issue a parking citation (criminal), the City Council must
authorize certain job classifications by resolution to enforce provisions of the Municipal
Code.
Staff is recommending rescinding Resolution No. 2014-3351 to add the following
additional employee job classifications to the list of those authorized to issue a parking
citation: Assistant City Engineer, Community Services Manager, Planning Technician,
Public Works Manager, Recreation Coordinator I, Senior Civil Engineer, and to change
the job classification title of Economic Development and Housing Manager to Economic
Development and Planning Manager.
STAFF RECOMMENDATION
Adopt Resolution No. 2017- , rescinding Resolution No. 2015-3439.

RESOLUTION NO. 2017-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, RESCINDING RESOLUTION NO.
2014-3351 AND AUTHORIZING THE EMPLOYEES WITH THE
LISTED JOB CLASSIFICATIONS TO ACT AS A PUBLIC
OFFICER TO ENFORCE VEHICLE PARKING VIOLATIONS OF
STATE STATUTE OR CITY ORDINANCE PURSUANT TO
SECTION 836.5 OF THE PENAL CODE AND SUBJECT TO THE
PROVISIONS OF SECTION 1.10 OF THE MUNICIPAL CODE
WHEREAS, the Moorpark Municipal Code in Title 1, Chapter 1.10, Section
1.10.040, Authority to issue criminal citations, authorizes any city code compliance
officer to issue a criminal citation; and
WHEREAS, the Moorpark Municipal Code in Title 1, Chapter 1.16, Section
1.16.020 defines a code compliance officer to be any officer or employee authorized by
the governing body to enforce certain provisions of the Moorpark Municipal Code; and
WHEREAS, when a violation occurs within the City, employees with various City
classification titles must be identified as employees authorized to issue a parking
citation.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. Resolution No. 2014-3351 is hereby rescinded.
SECTION 2. The City Council finds and declares that the employees with the job
classifications listed in alphabetical order of Assistant City Engineer, Assistant Engineer,
Associate Civil Engineer, Associate Planner I and II, Code Compliance Technician I and
II, Community Development Technician, Community Services Manager, Crossing Guard
Supervisor, Economic Development and Planning Manager, Irrigation Specialist,
Landscape/Parks Maintenance Superintendent, Management Analyst, Maintenance
Specialist, Maintenance Worker II and III, Parks and Landscape Manager, Parks and
Facilities Supervisor, Planning Manager, Planning Technician, Principal Planner, Public
Works Manager, Public Works Superintendent/Inspector, Public Works Supervisor,
Public Works Technician, Recreation Services Manager, Recreation Coordinator I, II
and III, Recreation Supervisor, Senior Civil Engineer, Senior Maintenance Worker,
Senior Management Analyst, and Vector/Animal Control Specialist, Vector/Animal
Control Technician I and II shall be deemed an employee authorized to issue parking
citations in accordance with Moorpark Municipal Code, Chapter 1.10, Code Violations,
Penalties, and Enforcement.

SECTION 3. The City Clerk shall certify to the adoption of this resolution and
shall cause a certified resolution to be filed in the book of original Resolutions.
