BACKGROUND The Police Department currently has two officers assigned to its Special Enforcement Unit (SEU). The Unit's primary function is the investigation and documentation of local street gangs and their activity. No less important is the identification of offenders responsible for graffiti vandalism on both public and private property. The two SEU officers make use of both uniformed and plain clothed assignments to accomplish their objectives. When uniformed, the officers use two of the ten City marked police vehicles in the fleet. One of these two cars used by the SEU officers was originally acquired for the School Resource Officer (SRO) position. The SRO position became a part time position in FY 06/07 with the balance of the officer's hours spent in the SEU. With the adoption of the FY 07/08 budget, the Council approved another officer for a full time SRO. Thus, one of the two marked patrol cars currently being offered for the SEU's use will be needed for the uniformed SRO. This necessitates the purchase of an additional vehicle for the second SEU officer. DISCUSSION The long history of criminal street gangs and their impact on society is well documented. Law enforcement's efforts to prevent its spread and growth remains a top priority. Specific laws and stiff penalty enhancements for criminal acts perpetuated by documented gang members are vital weapons used to combat the gang sub - culture. To take advantage of available penalty enhancements, the establishment of the identity of current and new gang members is paramount. To do this requires officers to utilize a variety of tactics including covert surveillance. When undetected, the officers can document various acts that constitute violations of probation or parole terms and assist in returning the offending gang member(s) to a custodial facility. The SEU officers frequently need to surreptitiously monitor activities within the community to develop intelligence in support of search or arrest warrants; to monitor known gang parolees or probationers; to interrupt criminal activity as it is occurring in a location that has a high frequency of criminal activity reports. This requires a non- descript vehicle that blends into the surroundings. Currently, the inventory of plain vehicles available to these officers, consisting of primarily four -door sedans, is well established in the community as belonging to law enforcement and therefore fails to offer any advantage of anonymity. The unmarked police vehicle will be one that is very common in the greater Moorpark area. By dark tinting the rear passenger and storage compartment windows, an officer could remain inside the vehicle undetected while conducting surveillance. This vehicle would be obtained via the Ventura County Government Services Agency utilizing their bid process. Scheduled replacement for this classification of vehicle would be 10 years or 120,000 miles. Breakdown of Costs: Purchase Price: $26,775.00 Sales Tax @ 7.25°x6 $1,942.00 Total Purchase price $28,717.00 Communications Equipment /Installation: $3,583.00 Estimated Total Costs: $32,300.00 Annual Costs: County of Ventura GSA repair and replacement fee: $2,844.00 Mileage (est. 10,000 annually @ $0.14 per mile) $1,400.00 To complete the necessary purchase, staff is recommending that the Council amend FY 07/08 budget by appropriating $36,544.00 from the General Fund Reserve balance and transferring the $32,300.00 to the public safety capital outlay budget and $4,244.00 to the public safety vehicle maintenance account STAFF RECOMMENDATION (ROLL CALL VOTE REQUIRED) Adopt Resolution No. 2007- Attachment: Resolution No. 2007- 000133 RESOLUTION NO. 2007- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, AMENDING THE FISCAL YEAR 2007/08 BUDGET BY APPROPRIATING $36,544.00 FROM THE GENERAL FUND (1000 -5500) TO THE PUBLIC SAFETY BUDGET FOR THE PURCHASE OF AN UNMARKED POLICE VEHICLE. WHEREAS, on June 20, 2007, the City Council adopted the budget for Fiscal Year 2007/08; and WHEREAS, in that budget, Council approved an additional fulltime School Resource Officer who will be driving a marked patrol car currently being used by a Special Enforcement Unit (SEU) officer, a budget amendment is required to purchase a vehicle for the SEU officer; and WHEREAS, Exhibit "A" hereof describes said budget amendment and its resultant impacts to the budget line item(s) for the purchase of an unmarked police vehicle. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. A budget amendment appropriating $36,544.00 from the General Fund, as described in Exhibit "A' attached hereto, is hereby approved. SECTION 2. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions.
