SUBJECT: Consider Appointment of One City Representative to Fill a Vacancy on
the Air Pollution Control District Advisory Committee
BACKGROUND
The City is represented by one member who serves a four-year term on the Air Pollution
Control District Advisory Committee. An appointment is required at this time due to a
vacancy created by the resignation of current representative, Martin Mogul. Applications to
fill this vacancy were due on September 10, 2007, by 5:00 p.m. One application was
received from Michael Moore. Mr. Moore previously served on the Air Pollution Control
District Advisory Committee from May 2004 to January 2007. A copy of his application has
been provided under separate cover.
Article 3 of the Air Pollution Control District Advisory Committee Bylaws describes the term
of office as "January to January" and does not specify a beginning date. Per City Council
Policies Resolution 2006-2483, this position will be eligible for mileage reimbursement, as
representatives to the Air Pollution Control District Advisory Committee do not receive an
honorarium.
The Council's adopted procedure for appointments (Policy 5 in Resolution No. 2006-2483)
is as follows:
A. The Mayor shall solicit suggested nominees from members of the Council.
B. Prior to making a motion for appointment, the Mayor shall announce the
name(s) of all persons he/she intends to nominate, and in the order to be
nominated, for a board, commission, or committee.
C. The Mayor shall then make a motion putting forth each individual name to be
approved for appointment.
D. A second shall be required.
E. The Council shall vote on each appointment individually.
