Blais, Parks and Landscape Manager DATE: September 10, 2007 (CC Meeting of September 19, 2007) SUBJECT: Consider Authorization of Recordation of the Notice of Completion for Magnolia Park Construction Project BACKGROUND On April 4, 2007, the City Council awarded a contract to Malibu Pacific Tennis Courts, Inc. in an amount not to exceed $168,999 to provide for the construction of Magnolia Park at 296 Charles Street. The project is funded by the Moorpark Redevelopment Agency(MRA). DISCUSSION As stated above, construction of the Project has been substantially completed pursuant to the approved plans and specifications, less minor "punch" list items. There was one contract Amendment and one Change Order for this project. The contract was amended to expand the scope of work to construct handicapped accessible sidewalk improvements at Mountain Meadows Park for an additional cost of$8,950. The City Council approved the appropriation of funds from the General Fund at its September 12 meeting for this work. Change Order No. 1 provided modifications to the Magnolia Park monument sign for an additional contract cost of $4,685 to reduce the size of the sign which upon completion appeared too large for the size of the park and the space provided. At the completion of the construction work, the total cost of the construction contract awarded to Malibu Pacific tennis Courts, Inc. will be $182,634 ($173,684 MRA funds for Magnolia Park and $8,950 General Funds for Mountain Meadows Park). With the Council's authorization to record the Notice of Completion, the Contractor will receive the balance of the payment due 35 days after the recordation and fulfillment of all contractual obligations as determined by the City.Additionally, the City Clerks Office will be authorized to release the project bonds in accordance with the contract provisions.
