Lail, City Engineer/Public Works Director f� DATE: November 29, 2007 (CC Meeting of 12/5/07) SUBJECT: Approve a Policy Restricting Utility Street Cuts for Public Streets with New Rubberized and Conventional Asphalt Overlay DISCUSSION Tierra Rejada Road, from SR 23 to Los Angeles Avenue, and Second Street are currently under construction. The entire street sections for both roadways are being cold milled and overlayed with rubberized asphalt at a total cost of approximately $3.6 million. This costly project will improve the appearance of the road and quality of the ride. Additionally, the use of the rubberized asphalt will reduce the traffic noise between 30 -40%. To protect and maintain the integrity of new overlay on public streets, as well as the appearance of the public street from utility cuts, staff is recommending a policy that will restrict utility cuts for 5 years following installation of a rubberized asphalt overlay and 3 years following installation of a conventional asphalt overlay, with the exception of utility cuts required for bona fide emergencies. The recommended policy language is as follows: To protect and maintain the integrity and appearance of new overlay pavement on public streets, no utility street cuts will be permitted for a 5- year period following installation of a rubberized asphalt overlay, and for a 3-year period following installation of a conventional asphalt overlay, with the exception of a utility street cut for a bona fide emergency, as verified and approved by the City Engineer. In the event an emergency utility trench is approved, the pavement shall be required to be repaved for the entire width of the street, for a minimum of 10 feet from both sides of the trench, with pavement material that matches the existing street surface. STAFF RECOMMENDATION Approve a policy restricting utility cuts, except for bona fide emergencies, as described in the agenda report, and incorporate the new policy into the next update of the City Council Policies Resolution.
