Hare, City Clerk DATE: March 29, 1995 (CC Meeting 4/5/95) iTEN1$. %1J!t.P W, CAUFOPNi `i SUBJECT: CONSIDER RESOLUTION 95- DECLARING THAT THE PROVISIONS OF TITLE 8 OF PART 3 OF THE PENAL CODE (SECTIONS 7500 ET SEQ.) REGARDING MEDICAL TESTING OF ARRESTEES AND INMATES SHALL BE OPERATIVE IN THE CITY OF MOORPARK Michael Bradbury, Ventura County District Attorney, has recommended that the City adopt a resolution which will help law enforcement personnel learn if they have been exposed to the virus which causes AIDS. Law enforcement officers sometimes come into contact with the blood or other bodily fluids of persons they have arrested or who are inmates in correctional institutions. These officers have a legitimate concern as to whether they have been exposed to the human immunodeficiency virus (HIVi A recent amendment to Title 8 of Part 3 of the Penal Code (sections 7500 et seq.), which provides a procedure for officers to request the blood of an arrestee or prisoner to be tested for the HIV virus, states that this code section shall only be operative in a city, county, or city and county where the governing body has adopted a resolution affirming that it is operative.
