Background On February 5, 1992 the City Counci i. approved Resolution No. 92 -828 to allow the construction of l96 townhomes in Tract 4792 (Traditions). As of June 7, 1995 a total of 139 of the 196 units have been completed, including models. This is the first Minor Modification filed for the development:. Discussion This Minor Modification request is to change the approved design of the fence on the eastern project boundary, adjacent to the commercial site. As approved, the design consisted of a 4' wrought iron fence over a 2' slumpstone wall. This proposal is to change the design to a 2' wrought iron fence over a 4' slumpstone wall. The purpose of this modification is to provide additional screening of automobile headlights and noise from the parking spaces at the adjacent commercial property which would be visible from this development. The overall height of the fence will not be changed. This Minor Modification request meets all applicable Zoning Code requirements. This Minor Modification request has been conditioned to require that the fence shall have identical materials and colors as required by the fence plan. This proposal has been reviewed by the Director of Community Development who approved the application on June 6, 1995. This matter is being presented to the Council as a courtesy. Should the Council, or any other party, desire to appeal the Director's decision, a hearing should be scheduled. The last day for an appeal to be filed is June 22, 1995. The next available hearing date is July 5, 1995. If the Council. takes no action, the Director's decision will become effective on Ttine ?2: 1.995. Recommendation Receive and File the Report. The land involved is Assessor's Parcel No.: 505 -0- 270 -48 in the RPD zone Categorically exempt from CEQA requirements as a Class 1, Exemption for Minor Alterations. Ordinance Compliance: Based upon the information and findings developed by staff, it has been determined that this application, with the attached conditions, meets the requirements of Moorpark Ordinance Code Section 81.11- 2.1.2 Permit Standards, in that; a. The Minor Modification is consistent with the intent and provisions of the City's General. Plan and the Zoning Ordinance; b. The Minor Modification is compatible with the character of surrounding development; C. The proposed. Minor Modification would not be obnoxious or harmful, or impair the utility of neighboring property or uses; d. The Modification would not be detrimental to the public interest, health, safety, convenience, or welfare; and e. The conditionally permitted lase is compatible with existing and planned land uses in the general area where the development is to be located EXHIBIT D Appeals: As stated in Section 17.44.090, within 16 calendar days after the permit has been approved, conditionally approved or denied, any aggrieved person may file an appeal of the approval, conditional approval or denial with the Community Development Department who shall set a hearing date before the Planning Commission to review the matter at the earliest convenient date.
