SUBJECT: Consider Amendment to the Commercial Non - exclusive and
Residential Exclusive Solid Waste Franchise Agreements
for the Purpose of a three (3) Month Agreement Extension
BACKGROUND
As you are aware, Moorpark currently franchises for commercial and
residential solid waste collection services. G.I. Rubbish and
Anderson Disposal Service provide exclusive residential service.
Non - exclusive commercial service is also provided by the above
haulers and two other haulers, E.J. Harrison and Rubbish Control.
Both the Commercial and Residential franchise agreements are due to
expire on June 30, 1995. The Commercial agreement was originally
due to expire on June 30, 1994. On June 1, 1994, the City Council
awarded a six month extension commencing July 1, 1994 through
December 31, 1994. The purpose of the extension was to provide
additional time to allow the Public Works, Facilities, and Solid
Waste Committee (Councilmembers Montgomery and Wozniak) to examine
agreement options. Another six month extension was granted on
December 7, 1995 commencing January 1, 1995 through June 30, 1995.
The purpose of this extension was to allow for both the Residential
and Commercial agreements to expire at the same time and be
considered together in the negotiations process with the haulers.
On February 15, 1995, Council took action to begin negotiations
with Anderson and G.I for an exclusive franchise agreement to
provide residential, commercial, and temporary collection services.
An Ad Hoc Committee consisting of Councilmembers Hunter and Wozniak
was subsequently appointed to address this matter.
On May 18, 1995, the haulers (Anderson Disposal Service and G.I.
Rubbish) were presented a listing of proposed items to be included
in the new solid waste franchise agreement. Based on the listing
provided by staff and clarifications made at the meeting, the
haulers indicated they would provide a proposal by June 14, 1995.
A meeting of the Ad Hoc Committee is scheduled for 5:00 p.m., June
19, 1995 to discuss the haulers' proposal,
Due to the likelihood that the negotiations with the haulers will
not conclude by June 30, 1995 (the expiration date of the current
franchise agreements) , it is proposed that a three (3) month
extension be granted to both the Commercial and Residential
franchise agreements.

Attached you will find the proposed amendment language. The
franchised commercial and residential haulers have been notified of
the proposed extension and agree with the proposed three (3) month
extensions.
RECOMMENDATION
Staff recommends that the City Council approve the proposed
amendment to the Commercial Non - exclusive and Residential Exclusive
Solid Waste Franchise Agreements for the purpose of a three (3)
month agreement extension.
