J7 ^,CTION: The City Council adopted Resolution 88 -523 on 11/29/88. The purpose of the resolution was to create a SE't of permit approval processing standards. Among other things, the resolution states that a "Major Modification" is to be acted upon by the body which granted the original approval. Planning staff ',ias followed this mandate since the resolution's inception, except Ln the case of the Urban West proposal entitled Major Modificat.icri No. l to TR4637 and RPD 89 -4. In the case of this modification, the Cit',7 Council felt that the project should be reviewed by the F= Tanning Commission prior to the Council's review. The Council was cognizant of the fact that it had been over 4 years since the original project had been reviewed by the Planning Commission and approved by the Council. By stipulating that the Planning Commission r.:-eviEw t:.he project, the processing time was extended, however, the f:intr =l. prroje -t, as approved, appears to have warranted the additiontll ! i -r-e . Staff believes that this change in procedure worked for the benefit of the project, the citizens and the -ity. . Staff therefore proposes that Resolution No. 88 -523 be amended. to reflect this change in policy. The Resolution is also no longer synchronous to the Zoning Code on various issues. The Zoning Code has gone through a myriad of changes since 1.988. Whereas Resolution No. 80 - -2'�, prescribes the city offices that approves various permits; and Whereas, the City Council as w��''_1. as '-he staff have recommended changes to said approval authority; NOW, THEREFORE, THE CITY i o4JNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DOES RESOLVE AS FOLLOWS: Section 1. Resolution No. 8F- .:'.76, entitled: A RESOLUTION OF THE CITY -'OUNCIL OF THE CITY OF MOORPARK, CALIFORNIA PRESCRIBE THAT CERTAIN PERMIT APPROVAL PROCESS BE PREFORMED BY CERTAIN CITY OFFICIALS AND THE REPEALING OF ALL RESOLUTIONS IN CONFLICT THEREWITH. adopted February 18, 1986 is hereby resc nded. Section 2. Where the Planning Commission is authorized to approve or disapprove an entitlement her-ei.n, such decision is appealable to the City Council. Where the Director of Community Development is authorized to approve or disapprove an - -rtitlement and subsequently to the City Council. Section 3. A request for a Modification to an entitlement herein shall be deemed a "Minor Mocification", as determined by the Director of Community Development, when such a modification does not alter the intent of the determining bodv. 1 nther modifications are deemed "Major Modifications". Section 4. Major Modific�tLons shall be approved or disapproved by the official of body granting the original approval or an appeal thereof, and shall be processed ii *hf, same manner as the original approval. Section 5. Where the City council Ls the body with approving or disapproving authority, the action shall fir-st be processed through the Planning Commission for its recommendatioi. Section 6.
