NIC)O(PA!'K, G.At_IFC ^, City Coun ^il of 144 S ACTION: DATE: August 21, 1995 (Meeting of September 6, 1995) SUBJECT: Consider Approval of a Certificate of Acceptance for an Easement Deed from Moorpark Unified School District for Improvements and Maintenance for an Area Adjacent to the Peach Hill Drain in PC - 3. BACKGROUND In September, 1987, the City Council adopted the conditions of approval for the three tracts (4340,4341, and 4342) in the West Village of PC -3 (Urban West Communities). Prior to the approval of the Final Map, the developer was conditioned to design the landscaping improvements along the Peach Hill Watercourse, with the design to be reviewed by the Parks and Recreation Commission and final approval of the design to be made by the City Council. A combined bicycle and pedestrian trail was to be installed as part of the design. The Conditions of Approval also state that the Homeowners Association shall own and maintain the watercourse until a public maintenance mechanism is in place. Upon such a time, staff would recommend to the City Council that a new Zone of Benefit within the Landscaping and Lighting District (AD 84- 2) be established. A. Discussion The landscaping improvements along the watercourse, and the aforementioned trail, were not installed until after the Arroyo West School was built. California Community Builders is proceeding with the landscaping improvements along the Peach Hill Watercourse, as part of the PC -3 Master Plan requirements. The current fence line of the Arroyo West School is located approximately 2 - 5' north of the edge of the property line and access road, leaving an area unimproved along the fence from Country Hill Road westerly to the end of the school property at Country Trail Park. California Community Builders has agreed to install landscaping improvements along this area, and the City would assume maintenance after one year, upon acceptance, along with the balance of the improvements along the drain and retention basin. The improvements 0001.I.S would be a combination of landscaping and concrete, at different points along the fence line. The subject area is property of the Moorpark Unified School District, who have indicated that an easement deed for the property, for the purposes of access and maintenance, would be acceptable to the District, prior to CCB making the aforementioned improvements. Without these improvements, this area would be unimproved and detract from the balance of the Peach Hill Drain improvements. RECOMMENDATION Approve the Certificate of Easement Deed and direct the Certificate and related Deed.
