From: Jaime Aguilera, Director of Community Development( ,-0 Prepared by Craig Malin, Assistant Planner Date: August 11, 1995 (City Council meeting September 6, 1995) Subject: Consider approval of Minor Modification No. 2 to Development Plan Permit No. 392 (Teledyne Laars) to allow a "wind machine" to be located in the rear of the building. Background On April 24, 1987 the City Council approved Resolution No. 87 -104 to allow the construction of a 200,097 square foot industrial building. Minor Modification No. 1 was approved on March 10, 1988 to allow the placement of outdoor mechanical equipment. Discussion The occupant of this building, Teledyne Laars, manufactures pool heating equipment. This Minor Modification request is to allow the placement of a wind generating machine on the southwest side of the building, adjacent to the Arroyo Simi. The proposed equipment will be used to test the manufactured equipment. The machine is 11' wide by 11' long and 11" high and will be located on a 13' x 1718" concrete pad. A perimeter fence (wrought iron in front, chain link adjacent to the Arroyo), 6' in height, surrounds the site. There are 6' high gates blocking off both driveways leading to the site location. These gates are closed unless a code is entered by the employee to open the gates. The site is not visible from either the building entrance, parking lot, Condor Drive, or from the south (due to the vegetation adjacent to Arroyo Simi). Placement of the equipment in the proposed location will leave a total driveway width of 2818" (not including parking). This width is acceptable to the Fire Prevention District, which requires a minimum driveway width of 25' for emergency access. Staff has approved locating the machine in the proposed location. Section 17.36.050(B -2) allows the Director to approve operations outside the building in the case of operation hardship or special circumstance, which has been determined to exist for this request. OW This Minor Modification request meets all applicable Zoning Code requirements and has been conditioned to require that: 1) The exterior of the machine shall be painted to match the building. 2) On site landscaping shall be brought into conformance with the approved Landscape Plan for DP 392. 3 ) Should any of the vegetation adjacent to the Arroyo Simi be removed, rendering the wind machine visible from the south, additional landscaping shall be installed. This landscaping must be approved by the City and shall be installed within 30 days after notification by the City. 4) Failure to inaugurate this Minor Modification in twelve months or less from the date of approval will render this Modification null and void. This proposal has been reviewed by the Director of Community Development who approved the application on August 23, 1995. This matter is being presented to the Council as a courtesy. Should the Council, or any other party, desire to appeal the Director's decision, the item should be scheduled for a regular Council meeting. The last day for an appeal to be filed is September 8, 1995. The next available hearing date is September 20, 1995. If the Council takes no action, the Director's decision will become effective on September 9, 1995. Recommendation Receive and File the Report. Location: As shown on Exhibit "A ". The land involved is Assessor's Parcel No's: 512 - 150 - 320/330. CEOA: The project is Categorically Exempt from CEQA requirements as a Class 1, Exemption for Minor Alterations. Ordinance Compliance: Based upon the information and findings developed by staff, it has been determined that this application, with the attached conditions, meets the requirements of Moorpark Ordinance Code Section 17.44.030 - Permit Standards, in that; a. The Minor Modification is consistent with the intent and provisions of the City's General Plan and the Zoning Ordinance; b. The Minor Modification is compatible with the character of surrounding development; C. The proposed Minor Modification would not be obnoxious or harmful, or impair the utility of neighboring property or uses; d. The Modification would not be detrimental to the public interest, health, safety, convenience, or welfare; and e. The conditionally permitted use is compatible with existing and planned land uses in the general area where the development is to be located. Appeals: As stated in Section 17.44.090, within 16 calendar days after the permit has been approved, conditionally approved or denied, any aggrieved person may file an appeal of the approval, conditional approval or denial with the Community Development UJ:*.,!9 EXHIBIT E Department who shall set a hearing date before the Planning Commission to review the matter at the earliest convenient date.
