SUBJECT: Consider Resolution No.16#Vvto Enable the
Enforcement of the California Vehicle Code on
Property Located at the Southwest Corner of High
Street and Spring Road (Tipsy Fox)
Background
The owner of Tipsy Fox, Mike Abdul, has formally requested in
writing that the City Council adopt a resolution enabling the
City's law enforcement officers to enforce the California Vehicle
Code (CVC) on his property. Mr. Abdul has indicated that the
parking problems caused by the number of day laborers, and their
vehicles, gathering on his property has made the situation
intolerable for his customers and employees. The adoption of such
a resolution requires a Public Hearing.
Approximately 35 to 55 men seeking employment gather in and around
the parking facility at Tipsy Fox Liquor Store each weekday
morning. A few of the men bring their vehicles, taking up parking
spaces that would otherwise be used by the store's customers.
Apparently, the contractors who solicit the workers cause an even
greater problem when they pull into the parking lot. Due to the
lack of available parking spaces and lack of consideration on the
part of the contractors, they often park in inappropriate places or
double park which creates havoc in the parking lot. Mr. Abdul
believes that as a result of the parking problems created by the
gathering of day laborers on his property, potential customers
avoid his store, and his business has been negatively impacted.
The City has adopted such resolutions before; e.g., McDonald's and
Town Center. Mr. Abdul also proposes creating a couple of time -
restricted parking spaces (15 or 20 minute limits) to ensure that
store customers have access to a parking space. Any enforcement of
time restricted parking by the City would be done on a limited
bases only.
Lieutenant Rouse has indicated that with the adoption of the
resolution, he and his officers will have the authority to enforce
the CVC at Tipsy Fox. However, he has expressed some concerns
about the lack of manpower to carry out the enforcement. Since the

City's Code Enforcement Officer can write tickets for vehicle code
violations, he can also be deployed to enforce the code at Tipsy
Fox.
The Community Development Committee (Mayor Lawrason and
Councilmember Perez) considered Mr. Abdul's request and recommends
adoption of the resolution.
Recommendation
The Community Development Committee nd staff recommend that the
City Council adopt Resolution No. 'enabling the enforcement of
the California Vehicle Code on property located at the southwest
corner of High Street and Spring Road.
