X DATE: AUGUST 21, 1995 (City Council Meeting of September 6, 1995) SUBJECT: ADRAGNA GRADING PLAN CHECK AND FEES(106 Wicks Rd.) Background: This item is being submitted at the City Council's request as an explanation of the deposits requested for this project along with an accounting and itemization of work performed to date. There is an extensive history with this lot. Rather than include another exhaustive history of the site I have attached, for your review, copies of a January 6th, and a July 13th memorandum to the City Manager (Exhibit 1). The January 6th memorandum provides a brief chronology of events and course of action. The July 13th memorandum provides an explanation of the fees requested to date. Again, the fees are based upon an engineer's estimate of the work. Copies of the engineer's estimate and the applicable section from the Fee Schedule are attached, as part of the July 13th memorandum. Discussion: A complete itemization of all work performed (personnel, date, time, and description) has been prepared and is attached (Exhibit 2). Also attached, as requested, is a copy of all correspondence and documents in the file (Exhibit 3). It should be noted that the initial meetings with the property owner and the preparation of the compliance review punchlist were completed in November. No time was billed to the property owner until December. Engineering has also waived the geotechnical review fee. One of the limitations of the current fee schedule is that fees have not been increased in over 10 years. To offset this deficiency the City approved a revision to the schedule which enables the Engineering Department to collect actual costs should the initial fee be insufficient to cover these costs. Because of the nature of this project, the current owner not being the person responsible for the illegal grading, it was my direction to engineering staff to only collect actual costs as they were incurred, rather than request substantial deposits up front. It was our intent to keep costs down. (YUG,11 Corrective action on illegal grading, such as this, can often require several times the plan check effort of a project that is submitted under normal circumstances. Actual costs are dictated by the quality of plans and responses submitted by the applicant and his engineer. To date plans have been submitted 3 times (including conceptuals) and still require corrections and additional information. Additionally, inspection deposits will be required upon completion of the plan review. This deposit will be based upon the final cost estimates (yet to be determined) and will be similar, in amount, to the initial plan check fee. Conclusion: All fees and deposits requested to date are consistent with the City Fee Schedule. Due to the nature of the project, actual costs can be expected to be several times the cost of a conventional submittal. The Engineering Department has made every effort to keep costs down while facilitating the owners request for an early occupancy of the structure. Costs to date for the plan review are $2520.36 (70% for city Engineering and 30% for City overhead). The City Engineering portion ($1764.25) accounts for roughly 26 hours of work. The request for additional actual costs, in the July 6th letter to Mr. Adragna, is for $1377.88 ($964.52 to City Engineering) or just over 13 hours of engineering work. Additional plan check fees will be required prior to completion of the plan review and an inspection deposit will be required at completion of the plan review. At your request, I am submitting an explanation of the deposits requested for this project with a brief discussion of the scope of our involvement. There is an extensive history with this lot. Attached for your review is a copy of a January 6th memo to you in which a brief chronology of the process and a course of action was outlined. The problems with this lot were discussed early with Mr. Adragna and were well documented. It was also understood that the City Engineering Departments involvement to bring this lot into conformance with City Standards, would be greater than for a typical project because of the existing illegal and non - standard construction which would need to be remedied. The Engineering Department has, however, made special efforts by allowing the Adragnas' to occupy their home while they addressed these hazardous items. The City also required a security for those items deemed not immediately threatening to the site's or adjacent structures. Mr. Adragna's engineer, Dan Holmes, submitted a conceptual grading plan in the third week of January 1995. A third plan check was completed by our department and returned to the applicant with several corrections the fourth week of May 1995. No further plan check requests have been received by our office to date. It should be noted that in resolving this unpermitted activity, engineering staff has assisted the owner in preparing special agreements with surrounding neighbors, directed the efforts of the soils engineer in preparing the necessary reports and prepared special bond arrangements to guarantee the work. These coordination efforts have been extensively reviewed with City Staff. It is anticipated that additional deposits will be required to cover the costs of additional plan check, preparation of "As- Builts" and staff time to release securities. Upon completion of these tasks the owner will be responsible for the "Actual Costs" of the effort plus any Citv overhead which accrues, as required by the City's fee schedule. 000157 X. 1 2`��1 Addit_onally, inspection deposits will be required upon completion of the plan review. These will be based upon the final cost estimates as required by the City's fee schedule. The initial fee for plan check on this project was calculated by the following formula as it is shown in the fee schedule (attached). (Based on the Engineers Estimate of $6,616.50) The Plan Check Fee = $300 + 15% x $5,616.50 = $1,142 The initial permit deposit will be collected upon completion of the plan check and will equal the initial deposit collected for plan check. The fee schedule also states that if the actual cost (including City overhead) exceeds the total deposits then the owner shall be responsible to pay the actual costs (including overhead to the City) ..- .7._.-.�...-.. ...._:..:.icy. ( P &3e3�5 CONFIDENTIAL MEMORANDUM To: Steve Kueny, City Manager From: Dirk Lovett, Assistant City Engineer Date: January 6, 1995 Subject: 106 Wicks Road Per your request I am forwarding this account of recent events regarding the subject property and the involvement of the Director of Community Development. The new property owners of two parcels at 106 Wicks Road, Matt and Patti Adragna, requested Engineering clearance for the house on the subject property prior to receiving a Building and Safety occupancy clearance. Upon a site review from our office it was discovered that there were several issues that needed to be resolved prior to Engineering approval. These included uncompacted/unapproved fill, lack of proper drainage, non - approved retaining wall, erosion, incomplete access road, encroachments onto adjacent properties, and lack of Geotechnical Engineering evaluation on both parcels. A punch -list of these items was provided the Adragnas on November 29, 1994. Upon receipt of the punch list the Adragnas requested my presence at a field meeting with themselves and their civil engineer to discuss the punch list. On December 5, 1994 Chris Oberender and I attended a meeting at the site which was attended by the Adragnas, Civil Engineer Dan Holmes, and Director of Community Development Jim Aguilera. After my explanation of the punch list and steps required of the Adragnas to obtain occupancy I was asked by Mr. Aguilera _if we might consider a conditional occupancy of the subject property since most of the punch list involved work done on the easterly parcel that did not contain the house. I explained that my concerns were not just for the safety of the occupants of 106 Wicks Road but also for those properties which have been or could potentially be impacted by the items on the punch list. It was then agreed that should the punch list items that directly impact the safety of the subject building 00015 ��ey�9 and adjacent properties be satisfactorily resolved that Engineering would give a conditional release for occupancy, subject to the City's receipt of a surety, with time limit, for the remaining corrections. Because Mr. Aguilera had also recently purchased the property adjacent to and west of the subject property I, subsequently, expressed my concern to the Adragnas and Mr. Aguilera of a possible public perception of a conflict of interest in Mr. Aguilera's role in decision making on this property. Even though Mr. Aguilera felt that there was no conflict of interest he deferred all decision making on the City's behalf to the Deputy City Manager Richard Hare. As a result, I met with Mr. Hare on December 19, 1994 to confirm the City's position and receive direction regarding our Departments course of action with respect to the above agreement. Mr. Hare confirmed that the arranged agreement above was acceptable and that no formal covenant or agreement would be necessary if an acceptable surety, equal to 150% of the remaining corrections, is held by the City which would state that all improvements be complete, to the satisfaction of the City Engineer, within 2 -6 months. Tract or Parcel Nap Issuance Fee: $34.00 b. Final Hap Parcel Nap Check Fee: A Fixed Quality Control fee of $1,671.00 per map plus $34.00 per lot for the first three map checks and quality control only. C. Revisions to Approved Tentative Subdivision Hap: Any substantial revisions (i. e. street alignments, pad sizes, pad elevation changes in excess of two feet) to approved tentative subdivision maps shall require City Council approval. A fee of $685.00, not including any required planning fees, shall be required for any request for any such application of map revision. d. General Provisions: • The number of plan checks covered by the above described fees shall be limited to three. The third plan submittal shall be checked to confirm that said plan submittal is correct and complete. Any additional plan checking efforts required to approve said plans shall be subject to additional fees based upon Actual Cost plus City overhead. • All fees shall be paid at the time of submitted. The Time Extension deposit shall be collected for the purpose of off setting all costs associated with the requested time extension. Any costs associated with a tine extension shall not be charged to the remaining portion of the inspection deposit. Upon completion and acceptance of the improvements, any balance remaining after deducting the Actual Costs of inspection (including City Overhead) shall be refunded to developer. In the event Actual Cost exceeds available deposit funds, the developer shall pay balance due upon receipt of invoice therefor. C. Deferred Construction Agreement: A fixed fee of $411.00 shall be required for processing this agreement. d. Guarantee Period Inspection: Actual Cost, including city overhead. 1 fee deposit of $1,000.00. Upon acceptance of improvements after guarantee period, any balance remaining after deducting Actual Cost of inspection (including City overhead) shall be refunded to the developer. In the event Actual Costs exceed the $1,000.00 deposit, developer shall pay the balance due upon receipt of invoice therefor. The slope repair a; locations of compaction tests are shown on the�,41 Plate 1. SLOPE REPAIR PROCEDURE The remedial slope repair involved reconstruction of a 15 to 20 foot wide section of the south facing slope descending from the building pad. The remedial repair was accomplished by filling the erosional scar with compacted earth. The slope was reconstructed to approximately pre- existing slope conditions. The repair work was initiated by excavating a key into firm native soils at the toe of the affected area. The excavated slope failure materials removed from the key area, were stockpiled and subsequently replaced in thin layers or lifts in the key area where they were brought to near optimum moisture content and compacted to at least 90% of the material's maximum dry density with a gasoline powered wacker. The finished slope surface was reconstructed to match the pre- existing slope site conditions. The finished slope surface was compacted using a gasoline powered wacker. Drainage All surface drainage from the building pad above the slope repair area of the residence shall be collected away fron the the descending slope. Precautions shall be taken to avoid excessive watering of the south facing slope area. Any future resident or home owner shall be advised of the above recommendations and shall be responsible for maintenance of drainage control devices. Slope Planting and Maintenance All slopes shall be provided with lightweight, deep rooting ground cover or shrubs. Small boxed trees may be planted. The services of a landscape contractor are recommended to aid in proper plant selection. The purpose of the investigation was to evaluate the adequecy of the existing foundation system supporting the two -story residence; and to determine the factor of safety against failure of the slopes descending along the south side of the residence. Listed below are Grading /Drainage issues requiring attention along with items required to be submitted to and approved by the City Engineering Department prior to site clearance. Problems: 1. Non - permitted, uncompacted fill has been placed on the south and east slopes. 2. Drain and sewer lines on the south slope are exposed and /or broken. 3. Drain lines on both the south and east slopes are eroding soil. 4. North property line retaining wall has not been approved or inspected by the City. 5. Grading on Bridgeman property, to the north, has not been approved by the City. Has it been approved by Mr. Bridgeman? 6. Access road and grading has not been completed per the approved plans. 7. Fill east of the property extends beyond the property line. Required action: 1. Prepare an engineered grading and drainage plan showing all grading(previous and proposed contours), drainage devices, drain water energy dissipators, grading quantities, property lines, easements, slope landscaping, etc..
