Lindley, Assistant to the City Manager I DATE: October 24, 1995 (CC Meeting of November 1) SUBJECT: Consider Approval of a Memorandum of Understanding Between the City of Moorpark, Caltrans, and the Ventura County Transportation Commission for an Advanced Fare Media Demonstration Program Background The Ventura County Transportation Commission (VCTC) is initiating a county-wide Advanced Fare Payment Media (Smart Card) Demonstration Program using a grant supplied through Caltrans. The objective of the county-wide program is to demonstrate various Transportation Demand Management (TDM) strategies designed to examine and test how effective an interagency county-wide Smart Card system will be in encouraging and improving the flow of public transportation users between different transit providers within Ventura County. VCTC is requesting that all Ventura County transit providers participate in a 12 month (October 1995 through September 1996) demonstration program with the actual on- board demonstration project beginning on January 2, 1996. Previous demonstration programs have been completed in the cities of Los Angeles, Gardena, and Torrance. Caltrans will provide 2,000 credit card sized "Smart Cards" that can electronically record and store computerized information, such as the card holders name, address, and amount of prepaid credit for transit service. The Smart Card will interact with card readers that will be installed by Caltrans on all 52 Ventura County transit buses, including Moorpark's bus. In addition, the cards will allow for an automated passenger counting system. It is anticipated that the Smart Card will provide: Greater convenience and mobility for transit users; • Potential for increasing ridership; ▪ Improved monitoring of schedule adherence; • More accurate data collection for measuring service efficiency and effectiveness; and • Automated origin/destination data collection. 0200S7 95- F3 • Smart Card Page 2 To date, all of the Ventura County cities/transit agencies have approved participation in the Smart Card demonstration program including, Thousand Oaks, Simi Valley, Camarillo, Ojai, South Coast Area Transit (SCAT), and the Ventura Intercity Service Transit Authority (VISTA). There will be no cost to the cities/agencies participating in the program. Our only obligation is to: allow a card reader to be installed in our buses, grant access to the data collected, and store a computer in the location where our bus are maintained. Caltrans will provide all necessary equipment and software, conduct any necessary maintenance on equipment, and act as overall project manager. VCTC agrees to provide marketing, assess the results of the demonstration program, and make a recommendation regarding the permanent use of the Smart Card system. As a part of this agreement, the City retains the right to terminate this agreement with 30 days written notification. Upon completion of the 12 month demonstration program, the City will have the option of retaining the Smart Card equipment and software at no cost. All on-going maintenance and software upgrades will be at the City's expense. Recommendation Staff recommends that the City approve the Memorandum of Understanding between the City of Moorpark, Caltrans, and the Ventura County Transportation Commission for an Advanced Fare Payment Media Demonstration Program, and authorize the Mayor to execute the MOU on behalf of the City. MEMORANDUM OF UNDERSTANDING between California Department of Transportation (CALTRANS) and VENTURA COUNTY TRANSPORTATION COMMISSION (VCTC) and CITY OF MOORPARK (MOORPARK) I . SCOPE This Memorandum of Understanding (MOU) by the signatory parties herein is to support the Caltrans Advanced Fare Payment Media program. The participation of MOORPARK in the pilot program will be for twelve (12) months (October 1995 to September 1996, with actual operation of the "Smart Card" equipment on the buses beginning January 2, 1996) . However, an option to continue the program beyond the twelve (12) month demonstration period shall be considered during the tenth month of the project upon mutual consent of all involved participants . This demonstration program shall operate within designated cities throughout Ventura County. II . OBJECTIVES A. The objective of the program is to demonstrate various Transportation Demand Management (TDM) strategies designed to mitigate traffic congestion and to examine and test the use of an integrancy Advanced Fare Payment Media (Smart Card) which would facilitate the flow of user-traffic between different transit systems . This will provide greater convenience and enhanced mobility for public transportation users in Ventura County. B. Specifically, MOORPARK, VCTC, and CALTRANS will test the use of the CALTRANS Advanced Fare Payment Media (Smart Card) on dedicated transit vehicles traveling within designated areas . The "Smart Card" project will : • Test the use of "Smart Cards" in existing, real time environments; 1 000(j!_-.9 • Develop a system which will help in meeting the requirements of the California Clean Air Act (CCAA) of 1988 (Chapter 1588 of the Statutes of 1988) , the Federal Clean Air Act Amendments of 1990 (P.L. 101-549) , and the Ventura County Congestion Management Plan (VCCMP) in response to the CCAA, Senate Bill 963 for the California Pass, and will recommend strategies to other local jurisdictions; • Examine the procedures necessary to operate a centralized "Smart Card" Clearinghouse - (which would allow customers to be billed and ideally allow them to update their card over the phone; this may be tested at the end of the demonstration project) ; • Participants shall collaborate with other transit providers also using the "Smart Card" to determine which test applications would most benefit their operations and then determine the appropriate survey instruments to be utilized during the demonstration. This shall be performed from the perspective of: transit properties, corporate sites, compliance with government regulations and procedures, and passenger acceptance; • Provide a fully coordinated tariff system for public transit service which will benefit the public in compliance with Public Utilities Code section 130262 . III . ROLE AND RESPONSIBILITY OF CALTRANS A. CALTRANS will act as the overall demonstration project manager, supplying project management for the "Smart Card" project and other projects in the demonstration program. In addition, CALTRANS will appoint an advisory team to guide development of the project and to maintain the project schedule and purpose. B. CALTRANSwill endeavor to perform, but shall not be limited to, the following tasks : 2 Otjari0 . 7 • Supply a "Smart Card" system to all participating transit agencies in Ventura County with a total of 52 vehicles (all operational vehicles in the County) ; • Supply 2, 000 Radio Frequency fare cards (Smart Cards) ; • Designate a contractor to design, build and install passenger "Smart Card" transaction units which will have the following capabilities : a. fare transaction system to accommodate interagency and corporate card fare usage b. vehicle location c. synthesized speech production d. transfer and receipt printing e. local area radio (for data uploading and downloading in the garage) f. automated passenger counting (to count all boarding and alighting regardless of the fare media used) • Provide user/maintenance training, including all training materials, for "Smart Card" passenger transaction units . Maintenance shall be performed upon equipment failure by the Caltrons/VOLPE , subcontractor within 48 hours . Basic, routine maintenance shall be carried out by the local Transit Provider. Spare parts and backup units will be provided by Caltrans/VOLPE, as part of this Memorandum of Understanding. IV. ROLE AND RESPONSIBILITY OF VCTC A. Marketing and promotion for the projects will be funded by VCTC. The VCTC Transit Information Center will provide for the distribution of "Smart Cards" to participants in the demonstration. B. VCTC, cooperating with other interested public and private entities, will determine the feasibility of implementing a Mobility Management Demonstration Program which will operate in concert with the Advanced Fare Payment Media (Smart Card) to centralize data from existing travel demands and 3 modes and correlate this information for the Ventura County Transit Operators Advisory Committee (TRANSCOM) . C. VCTC will endeavor to perform, but shall not be limited to, the following tasks : • Provide marketing of the Advanced Fare Payment Media (Smart Card) program, including potential participation in a local area radio test in support of the program and work in cooperation with the United States Department of Transportation, Research and Special Demonstration Programs Administration, VOLPE National Transportation Systems Center, or other designee of the STATE; • Assess the impact of the Mobility Management Center and the Advanced Fare Payment Media (Smart Card) on the current Transit Information Center and make recommendations regarding implementation as county-wide demonstration programs . D. Any VCTC administrative costs will be paid through the "Smart Card" grant. V. ROLE AND RESPONSIBILITY OF MOORPARK A. Moorpark has agreed, by execution of this Memorandum of Understanding, to participate in the CALTRANS Advanced Fare Payment Media (Smart Card) program. The on-board portion of this demonstration project is scheduled for nine (9) months beginning- on January 2, 1996. Preliminary project coordination will need to occur with each of the Transit Providers beginning in October of 1995 . Continuation of the pilot program, beyond this time frame may be considered during the tenth month of this Memorandum of Understanding upon mutual consent of all parties involved. B. MOORPARK acknowledges that it is one of several transit participants in the Advanced Fare Payment Media (Smart Card) demonstration program and understands that, as part of the regularly- scheduled TRANSCOM meetings, the project may be discussed. Those decisions which impact the 4 Transit Providers will be decided upon with group consensus . C. Moorpark agrees to provide: • One (1) vehicle (bus) dedicated to accept the "Smart Card"; • Access to transit vehicle to allow CALTRANS contractor to install passenger "Smart Card" transaction units on transit vehicles; • Access to the vehicle and/or card reader at scheduled intervals agreed to by the project advisory committee composed of VCTC's Transit Operators Advisory Committee (TRANSCOM) ; • Attendance at project status review meetings as requested; • Staff to act in an advisory capacity for hardware system design; • Staff to participate in the development of the report requirements and review of the output data; • Space for the placement of placards inside vehicle for project promotion; • Access to staff for training in the use of the "Smart Card"; • Staff support for monthly verification of report output; • Access to vehicle and other project sites for equipment at project conclusion. VI . HOLD HARMLESS CAUSE A. Neither CALTRANS nor any of its officers or employees are responsible for any damage or liability occurring by reason of anything done or omitted to be done by VCTC and/or MOORPARK under or in connection with any work, authority or jurisdiction delegated to VCTC and/or MOORPARK under this Memorandum of Understanding. It is 5 understood and agreed that, pursuant to Government Code Section 895. 4, VCTC and MOORPARK shall fully defend, indemnify and hold harmless CALTRANS, all officers and employees, from all claims, suits or actions of every name, kind and description brought for or on account of injury (as defined in Government Code Section 810 . 8 occurring by reason of anything done or omitted to be done by VCTC and/or MOORPARK under or in connection with any work, authority or jurisdiction delegated to VCTC • and/or MOORPARK under this Memorandum of Understanding. B. Neither VCTC nor any of its officers or employees are responsible for any damage or liability occurring by reason of anything done or omitted to be done by CALTRANS and/or MOORPARK under or in connection with any work, authority or jurisdiction delegated to CALTRANS and/or MOORPARK under this Memorandum of Understanding. It is understood and agreed that, pursuant to Government Code Sections 895. 4, CALTRANS and MOORPARK shall fully defend, indemnify and hold harmless VCTC, all officers and employees, from all claims, suits or actions of every name, kind and description brought for or on account of injury (as defined in Government Code Section 810. 8) occurring by reason of anything done or omitted to be done by CALTRANS and/or MOORPARK under or in connection with any work, authority or jurisdiction delegated to CALTRANS and/or MOORPARK under this Memorandum of Understanding. C. Neither MOORPARK nor any of its officers or employees are responsible for any damage or liability occurring by reason of anything done or omitted to be done by CALTRANS and/or VCTC under or in connection with any work, authority or jurisdiction delegated to CALTRANS and/or VCTC under this Memorandum of Understanding. It is understood and agreed that, pursuant to Government Code Section 895. 4, CALTRANS and VCTC shall fully defend, indemnify and hold harmless MOORPARK, all officers and employees, from all claims, suits or actions of every name, kind and description brought for or on account of injury (as defined in Government Code Section 810 . 8) occurring by reason of anything done or omitted to be done by CALTRANS 6 } and/or VCTC under or in connection with any work, authority or jurisdiction delegated to CALTRANS and/or VCTC under this Memorandum of Understanding. VII. TERMINATION This Memorandum of Understanding shall terminate upon completion of the demonstration program or on September 30, 1996, whichever is earlier in time. All parties involved reserve the right to withdraw from the project upon thirty (30) day written notification TO CALTRANS. Upon termination of the Memorandum of Understanding, all "Smart Card" equipment/software shall be removed by Caltrans/VOLPE from MOORPARK bus and facilities within thirty (30) days and said equipment and facilities restored to their original condition. The only exception will be if MOORPARK gives written notice to VCTC that it desires to continue the program beyond the end of the demonstration period. VIII . FUNDING No CALTRANS funding is encumbered under this Memorandum of Understanding and each party shall bear its own costs described herein unless separate agreements are executed between the parties obligating payments for services. 7 X1.,40•i��.1,ti t'ry 5 In WITNESS WHEREOF, the parties hereto have caused this Memorandum of Understanding to be executed by their respective officers, duly authorized, by the California Department of Transpiration (CALTRANS) on , 1995, the Ventura County Transportation Commission (VCTC on , 1995, and by the City of Moorpark (MOORPARK) on , 1995.
