Background On November 9, 1987, the City Council approved Resolution No. 87- 430 approving Tract 4342 and Planned Development Plan 1072 for the construction of 179 homes. A total of 3 Minor Modifications have been approved for this site. These modifications include changes to the elevations and floor plans. Tract 4342 contains a recorded access easement, 10' in width running from the terminus of Sagewood Drive to the adjacent commercial site. This easement is depicted on approved street improvement plan 88- ML- 10319. In addition, the Fence and Wall Plan for CPD 90 -2, approved on November 29, 1994, also includes the easement. When lots 64 and 65 of Tract 4342 (which abut the easement) were completed, the property line wall was completed without an opening for the easement. This was due to the easement not being included on the landscape plans which are used to verify wall and fence compliance at the time of final inspections. This easement is to provide pedestrian access to and from the commercial site. CPD 90 -2 was approved with pedestrian access. CPD 90 -2 Major Mod, submitted by American Stores and currently in process, includes stairs to Sagewood Drive, which is required by the City. Discussion This Minor Modification request is to eliminate the requirement to provide the access easement between lots 64 and 65, the opening in the wall, and the walkway down to the commercial site. The commercial site is located approximately 15' below the level of the adjacent homes. The two homes on each side of the easement have been completed with the wall already in place. The applicant has submitted a letter from the Homeowners Association expressing their desire that the access be eliminated. A petition was also included from 10 residents on Sagewood Drive requesting that easement be eliminated. The contention of the Homeowner Association and the Applicant is that the access, even when completed, will prove to be a safety and security hazard. This proposal has been reviewed by the Director of Community Development, who is deferring action on this application to the City Council since it is the Council who will act upon Commercial Planned Development No. 90 -2 Major Modification No. 1. Staff has scheduled these items together in order that the Council may make a decision on both items since they are interrelated. At a recent board meeting we informed the homeowners that this access was required by the city to complete the approved plan As a result of this meeting the Verona homeowners unanimously voiced their desire to have this free access changed and that no access be allowed. It is the opinion of the board that this access would lead to more problems than it would be beneficial. The Verona Board of Directors is therefore requesting that California Community Builders begin the necessary process to have the City change this plan to eliminate the access.
