SUBJECT: Consider Award of Contract for Grading, Landscaping and
Structural Improvements for Poindexter Park and Construction
of Restroom / Concession Building at Arroyo Vista Community
Park.
SUMMARY
Staff is recommending that the City Council award a contract to Terra-
Cal Construction for the construction of park improvements for
Poindexter Park, and to construct the restroom / concession building at
Arroyo Vista Community Park.
BACKGROUND
The City Council appropriated $1, 100 , 000 of funding to make park
improvements at Poindexter Park. Funding sources are from the Park
Improvement Fund (Fund 5) ($875, 000) and from the Redevelopment Agency
(MRA) ( $225, 000 ) . These improvements are to include two baseball
diamonds with backstop fencing, bleachers, dugouts and grass infields;
a tot lot; a large picnic shelter with tables ; benches; barbeques;
drinking fountain (s) ; two restrooms (one with a concession facility
which is proposed to be constructed by Moorpark Little League, at their
expense) ; a Veteran ' s Memorial Grove with two gazebos; off street
parking; and an entry monument sign. (See attached itemized cost
breakdown) .
The City retained the services of a landscape architect, T. I . Maloney,
to prepare plans and specifications for the improvements at Poindexter
Park. T.I . Maloney had previously been contracted with the City and was
the architect on the Phase I landscape improvements at Arroyo Vista
Community Park.
The City further retained the services of Picon to serve as the Project
Coordinator.
The park plans and specifications were plan checked by the Building and
Safety Department . At the City Council meeting of August 2 , 1995, the
Council directed staff to advertise for receipt of bids for the
construction of improvements for Poindexter Park. The planned restroom
/ concession building at Arroyo Vista Community Park was included as
part of the bid for Poindexter Park, as a bid option.
Bids were opened on Tuesday, November 7 . There were seven qualified
bidders, and Terra Cal Construction was the apparent low bidder, with a
$952, 000 bid for the Poindexter Park project and $124, 000 for the Arroyo

Vista Community Park restroom / concession building, for a total of
$1, 076, 000 .
The construction bid for the restroom / concession building at Arroyo
Vista Community Park is higher than the original estimate of $85, 000 .
However, in two previous bid advertisements, bid prices have been around
$120, 000 . There has been significant savings in other improvements at
Arroyo Vista Community Park, resulting in a currently projected $41, 255
surplus / contingency. Staff would recommend that those savings be
applied to this building project .
DESIGN FEATURES
The conceptual design of Poindexter Park, which was designed by Harris &
Associates Landscape Architects , attempted to capture the early
agricultural history of Moorpark, and to accomodate the desire of
Moorpark Little League to have two baseball fields . The picnic shelter
will resemble an old barn, and the restroom facility will have a rustic
appearance. Trellises will cover the entry ways into the play areas,
and the landscaping will include split-rail fencing. Behind the entry
monument sign, there is a planned apricot grove of nine Moorpark Apricot
trees . The playground will include standard swings and climbers, and
will include an area for manipulative water and sand play for small
children. The spring toys will resemble farm animals .
As part of the design there will be an open passive area for picnicking
and for the establishment of a Veteran' s Memorial Monument . Two large
Victorian Gazebos, similar in design to that which is on High Street,
will provide areas in the Memorial Grove for picnicking and relaxing.
The scope of work for the park includes excavating and over-excavation
of the access road, a 10" crushed aggregate base, a curb break and entry
way from Poindexter Road, temporary drainage swale, and grading 26 ° of
the 40 ' wide road at the approximate elevations for the future housing
project
Off street parking which will accommodate 65 vehicles, is located along
the southwest end of the park, and will be of benefit when the two
baseball fields in the south end of the park are used during the spring
season. Both fields have bleachers, dug outs, backstops, and fencing.
Moorpark Little League has committed to constructing their own restroom
and concession stand near the southeast end of the park. Staff will be
coordinating Little League ' s construction schedule so that it will
coincide with the rest of the park improvement construction. There will
be picnic tables located near this restroom / concession facility for
game spectators .
DISCUSSION ON FINANCIAL OVERVIEW
The construction cost estimate for the park, as prepared by T. I .
Maloney, indicates that park construction costs , as well as the
architect ' s fee, and the project administration fee will exceed the
budgeted amount by approximately $6, 835 . 00 . This estimate did not
included additional permit fee costs .
Staff has determined that the project will have a total cost of
$1, 114, 341 . This can occur by including only a 5% contingency on the

project, requesting Little League to contribute $5, 580 to install grass
in the two ball diamond infields and to extend the water, sewer and
electric to the southeast corner of the park for their restroom and
concession building, and funding an additional $40, 000 in permit fees
for Callegus Water District and other inspection fees that were not
included in the original cost estimate. The project cost is $14, 341 over
the budgeted amount of $1, 100, 000 . Staff would recommend that the City
Council fund the difference, if necessary, through the Redevelopment
Agency, because the construction of the gravel access road from
Poindexter Road, which is included in the park project, will benefit the
construction of the future housing project .
In the event that the City Council should reject the construction for
the restroom / concession building at Arroyo Vista Community Park, the
apparent low bid would become Advanced Construction, with a base bid of
$949, 300 for the Poindexter Park. The alternate costs identified by
Advanced Construction for the installation of grass in the two ball
diamond infields and the extension of the water, sewer and electric to
the southeast corner of the park for the Little League restroom and
concession building, would be $14 , 700 , which includes a 20%
administrative cost to the City. The average bid for these alternates,
from all bids received after eliminating the high and low bidder on the
alternates, is $6, 100 .
Moorpark Little League has made a commitment to construction a
restroom/concession building at a value of over $50 , 000 . The facility
would become City property, which Little League would utilize and
maintain during their season. Representatives from Little League have
indicated that the additional $5, 580 for the related site work was not
included in their budget when planning the building construction, and
they are not able to provide these funds to the City.
If the City Council decides not to access Moorpark Little League for the
cost of the utility extensions and the grass infields, the Council would
need to requestan appropriation of $20, 000 from MRA to fund the balance
of the park construction costs .
The park design as approved was intended to help meet the expansion
needs of Moorpark Little League by providing a second ball diamond and a
larger parking lot . Without this desire to install a concession
facility, including a second restroom facility, there would be no need
to extned the utilities (water, sewer and electrical) to the east end of
the park. It is unlikely the City would use this facility since the
park design already includes a restroom more suitably located for
general use of the park. The City standard for ball diamonds has been
to install a multi-use, skinned infield.
TENTATIVE CONSTRUCTION SCHEDULE
Staff is anticipating an accelerated construction schedule, and is
hopeful that the park construction be completed within three (3 ) months .
The delay in advertising for receipt of bids due to the unforeseen time
involved with the plan checking process, will not allow, even with good
weather, for a park opening to occur in conjunction with Moorpark Little
League opening day, which is April 5, 1996 . Staff estimates that the
park should be open for use by the middle of May, 1996, at the earliest .

1) Award contract for construction of grading, landscaping and
structural improvements for Poindexter Park to Terra-Cal Construction of
Baldwin Park, for the amount of $952 , 000, plus 5% contingency for both
projects, and construction of Arroyo Vista Community Park restroom and
concession facility for the amount of $124, 000; 2) Request appropriation
of $15 , 000 from the Redevelopment Agency to fund the balance of
Poindexter Park construction, which is inclusive of a 5% contingency,
and 3 ) Require Moorpark Little League to fund %5, 580 for extension of
utilities, grass infields and 20% for inspection and administration; and
4) Authorize Mayor to sign all appropriate contractual agreements .

Dear Mr. Vein:
Thank you for forwarding the letters from the Center for Contract Compliance and the
Local Union 345. As we both know,the Center for Contract Compliance is solely funded
by Union Employer Contributions. This organisation prides itself in manufacturing
information and twisting it for the benefit of its own Union Membership. Much to the
Union's dissatisfaction, Terra-Cal Construction, Inc. is an open shop contractor.
Terra-Cal Construction has been in business for over 13 years. We have an extensive list
of satisfied customers in the public works market of which we have few or no complaints.
Our General Engineering and Landscape Construction is second to none. We take great
pride in building long term relationships with our customers as indicated in our bid
package and reliable list of bonafide references.
As you well know, Terra-Cal is licensed, bonded and insured. Our contractor's license and
license bond are in good standing and have absolutely no complaints or disciplinary
actions brought against it. We are bonded with a California A+rated admitted Insurance
Carrier. Out bonding company is one of the finest and most reputable in California. The
same holds true for our Casualty Insurance Carriers. Further proving to the numerous
agencies we contract with that they are protected from any unforeseen loss.

Our staff has reviewed the allegations posed by the Local 345 and CCC. We are outraged •
by the slanderous and blasphemous remarks put in tabloid form by this self-serving union
watchdog committee. Our response to their exaggerations and half truths are as follows:
1. The department of Labor Wage &Hour Benefits Administration
investigated our pension plan and did not find any irregularities. Our plan
is accepted.
2. Two Irrigation "Apprentices" from pipefitters local 350 walked off our
jobsite claiming their work was not pipefitting work, after they had been
given the option earlier in the day to do labor work, or to leave for the day.
Because two walked off the job, the union took the case to the NLRB,
who, infact, did find that since the two walked off the job it was in fact a
legal strike, and we had to pay them back pay. That is the only occasion
we have had with the NLRB.
3. CalTrans in Orange County has complaints. We have not heard of
any, and our most recent projects have been completed over six
months ago.
4. Cal Osha filed safety complaints on multiple jobs. They have only been on
two of our projects, and that was about one year ago. The
unions reported us on two CalTrans jobs. Each site had a full
investigation, and we were sited for not having enough portable
toilets on one, and for not having hazardous materials data sheets
for pipe primer and dope on the other. I do not see that as flagrant.
5. Deputy Labor Commissioner has filed a notice to withhold
$66,700.00 for restitution and penalty. That is a fact, however, that
case has been closed, the restitution and penalty paid. That was on
a job about one year old. In spite of the innuendoes, no other
action was taken by the Labor Commissioner.

In addition, this letter isn't about CCC and the local Brotherhood of Unions protecting the
Awarding Bodies in question, it's simply about a disguised AFL-CIO affiliate, trying to
further their member company's revenues. At the expense of the non union contractor.
We strongly urge the City of Moorpark to disregard the exaggerated allegations posed by
the Local and the CCC. We do not believe the City of Moorpark has legal ground to
disallow our firm as the responsive and responsible low bidder. Disregarding our contract
would be a slap in the face to the working class in Southern Ca ifomia. Not to mention
the several thousands of dollars in increased construction costs that the City of Moorpark
taxpayers would have to bear.
We are looking forward to this project being awarded on November 15, 1995. A
representative from our firm will be at the City Council Meeting to answer any questions.

The Center for Contract Compliance' is a nonprofit organization concerned with
eomolianse of those laws that govern and directly affect the overall completion of public projects. •
To achieve this objective. the Center for Contract Compliance investigates any irregalarities and
by working closely with awarding agencies we hope to promote fairness in contracting.
We believe the public interest is best served when public contracts are awarded to
responsible and responsive bidders; those employers that comply with the taw. We have
documented in the past that emplbvcrs that cheat their workers by falsifying payroll records also
use inferior materials, do not pay proper tet. es, .and become a drain on the entire system.
The law requires that a bid only be awarded to the lowest responsible and responsive
bidder; t bidder that best responds in quality, fitness, :red capacity to the particular requirements
of the proposed work as demonstrated by his;her past performance.

Because of Terra-Col's past performance with regard to falsification of records and
nonpayment of prevailing wage, we ask that Terra-Cal Construction, Inc. be considered
nonresponsible and be removed from consideration as the number one low bidder.

It is obvious to us that Tcrra•CaI Construction, Inc. cannot be trusted to fulfill its
obligations under the law and your contract.

We have found it necess&ry to file wage complaints with the State of California Labor
Commissioners office on no less than ten (10) occasions, dating back as far as four years and as
recently as March 1995_ • _
Deputy Labor Commissioner Rosa Frazier (310.449i6303) has had to file a notice to
withhold payment due against Terra-Cal in the amount of$66,700.60 due to nonpayment of
prevailing wage. This current complaint and subsequent others are still pending_ Additionally,
our office has had to file numerous complaints against Terra-Cal for simply refusing to maintain
and supply certified payroll records. This action shows a blatant disregard for the most basic
components of public works contracting. For the aforementioned reasons, we ask that the City
