Background The subject fees are collected by the City's Building and Safety division prior to issuance of building permits. The purpose of these fees is to provide funding for construction of a new Police Services Center as a result of increased demand for Police services arising from additional development. The Police Services Center was completed in the fall of 2005. B. Changes The City has been collecting a Police Facilities Fee from new residential and non - residential development within the City since adoption of Ordinance No. 9 in October 1983 (Ordinance No. 9 was revised in April 1995 which resulted in the adoption of Ordinance No. 206 and adoption of Resolution No. 95 -1112, establishing a Police Facility Fee). The last fee increase was in September 2000 with adoption of Resolution No. 2000 -1777. Since 2000, several of the factors that determine the fee amount have changed, making it necessary to recommend an adjustment to the fee amounts. C. Public Hearina This fee falls under the regulation of Government Code Sections 66000 - 66025. Accordingly, the fee can only be amended after certain disclosure and timeline requirements and that there be a public hearing prior to the adoption of a new development fee or an increase in any existing development fee. It is recommended that such a hearing be held on March 15, 2006. 1 1 ': Honorable City Council February 15, 2006 Page 2 D. Proposed Fee Adjustment At the date of the writing of this report, the exact amount of the recommended fee adjustments was not yet known. It is the intent of staff to have the analysis required for that recommendation completed prior to the end of February. It is also the intent of staff to make that information available to the City Council and other interested parties, at that time. E. Effective Date Any approved fee increase will not become effective until sixty (60) days after the date the action was taken to increase the fee. STAFF RECOMMENDATION Staff recommends that the City Council take the following actions: 1. Set March 15, 2006, as the date of a public hearing to consider an increase to the Police Facilities Fee. 2. Direct the City Clerk to give notice of said hearing in a manner consistent with the requirements of the appropriate Sections of the Government Code. 000089
