DISCUSSION The current Agreement with QCP requires Council approval for any increase over three percent (3%). It is necessary to amend the City's original Agreement as on March 9, 2017, QCP provided notice of an increase of one-dollar ($1.00) to the cost of the supplement per page rate from $21.50 to $22.50 with an effective date of July 1, 2017. Staff has also determined the need for 10 additional legislative binders for storing City Council resolutions at a cost of$2,250.00. FISCAL IMPACT Funding for this increase is included in the Fiscal Year 2017/18 Budget scheduled for adoption on this agenda. STAFF RECOMMENDATION Approve Amendment No. 1 to Agreement with Quality Code Publishing and authorize the City Manager to sign the Amendment, subject to final language approval by the City Manager. Attachment: Amendment No. 1 94 AMENDMENT NO. 1 PROFESSIONAL SERVICES AGREEMENT BETWEEN THE CITY OF MOORPARK AND QUALITY CODE PUBLISHING FOR RESEARCH, EDITING, CODIFICATION, AND PUBLISHING ORDINANCES OF THE CITY OF MOORPARK This Amendment No. 1 to the Agreement between the City of Moorpark, a municipal corporation ("City"), and Quality Code Publishing, a limited liability corporation ("Consultant"), for Municipal Code research, editing, codification and publishing services ("Agreement"), is made and entered into the day of , 2017. RECITALS WHEREAS, on October 1, 2014 the City and Consultant entered into an Agreement to have the Consultant provide Municipal Code research, editing, codification and publishing services; and WHEREAS, on March 9, 2017 the Consultant provided notice of an increase of one-dollar ($1.00) to the cost for the Moorpark Municipal Code supplemental per page rate with an effective date of July 1, 2017 which is attached hereto as Exhibit C, and on March 24, 2017 at the request of the City, the Consultant provided notice of cost to provide ten (10) legislative document binders for City Council resolutions, at a cost of two thousand two hundred fifty dollars ($2,250.00) WHEREAS, the City and Consultant now desire to amend the Agreement to increase the compensation for services to be performed by Consultant for production of the supplemental charge per page from twenty-one dollars and fifty cents ($21.50) to twenty-two dollars and fifty cents ($22.50), and to assess a one-time charge of two thousand two hundred fifty dollars ($2,250.00) for legislative binders, and document said Agreement to amend by jointly approving Amendment No. 1 to the Agreement. NOW, THEREFORE, it is mutually agreed by and between the parties to the Agreement as follows: I. Section 1, PART II — PRICES AND PAYMENT TERMS of Exhibit A — SUPPLEMENTAL SERVICES is replaced in its entirety by Exhibit D. II. Section 2, Remaining Provisions: Except as revised by this Amendment No. 1, all of the provisions of the Agreement shall remain in full force and effect. 95 In Witness Whereof, the parties hereto have caused this Amendment to be executed the day and year first above written. Payment Schedule: Balance due upon delivery of products and services to the City.
