HomeMy WebLinkAboutAGENDA REPORT 2006 0621 CC REG ITEM 10BITEM 1 O• B - MINUTES OF THE CITY COUNCIL Moorpark, California June 7, 2006 A Special Meeting of the City Council of the City of Moorpark was held on June 7, 2006 in the Community Center of said City located at 799 Moorpark Avenue, Moorpark, California. CALL TO ORDER: Mayor Hunter called the meeting to order at 6:38 p.m. 2. ROLL CALL: Present: Councilmembers Harper, Mikos, Millhouse, Parvin, and Mayor Hunter. Staff Present: Steven Kueny, City Manager; Joseph Montes, City Attorney; Hugh Riley, Assistant City Manager; Mary Lindley, Parks /Recreation and Community Services Director; Barry Hogan, Community Development Director; Johnny Yugal Lail, City Engineer /Public Works Director; and Deborah Traffenstedt, Administrative Services Director /City Clerk. 3. PUBLIC COMMENT: None. 4. PRESENTATION /ACTION /DISCUSSION: A. Consider Use of Hiah Street as Truck Haul Route for Up to 40 Workin Days for the Essex Portfolio Development Project (Formerly Moorpark High School Site. Staff Recommendation: Authorize the use of High Street westbound only for import dirt haul of fill material for duration of 40 working days. In addition to standard haul permit conditions, haul hours shall be 7:30 a.m. to 3:30 p.m., Monday through Friday. Mr. Lail gave the staff report. In response to Mayor Hunter, Ms. Traffenstedt stated there were no speakers. CONSENSUS: It was the consensus of the Council to authorize the use of High Street westbound only for import dirt haul of fill material for duration of 40 working days, subject to standard haul permit conditions and haul hours from 7:30 a.m. to 3:30 p.m., Monday through Friday. The Council directed the City Engineer to add a notice to the Home Page and Channel 10. Minutes of the City Council Moorpark, California Page 2 June 7 2006 Mr. Hogan and Mr. Lall left the meeting at 6:47 p.m. 5. CLOSED SESSION: Mr. Kueny requested the Council adjourn to closed session for discussion of one case under Item 5. A. and one case under Item 5.13. on the agenda. MOTION: Councilmember Harper moved and Councilmember Millhouse seconded a motion to adjourn to closed session for discussion of one case under Item 5. A. and one case under Item 5.B. on the agenda. The motion carried by unanimous voice vote. Mr. Montes announced that in the matter of Item 5.A, the facts and circumstances creating significant exposure to litigation consist of a statement threatening litigation received from the Department of Justice. A. CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION Significant exposure to litigation pursuant to Subdivision (b) of Section 54956.9 of the Government Code: (Number of cases to be discussed - 4) B. CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION Initiation of litigation pursuant to Subdivision (c) of Section 54956.9 of the Government Code: (Number of cases to be discussed — 4) Present in closed session were Councilmembers Harper, Mikos, Millhouse, Parvin and Mayor Hunter; Steven Kueny, City Manager, Joseph Montes, City Attorney; Hugh Riley, Assistant City Manager; Mary Lindley, Parks /Recreation and Community Services Director; and Deborah Traffenstedt, Administrative Services Director /City Clerk. The City Council reconvened into open session at 6:57 p.m. Mr. Kueny stated that one case under Item 5.A. and one case under Item 5.13. were discussed and there was no action to report. 6.
