Adjusting Real Time Billing Rates, Updating the Schedule for Land
Use Development Processing Fees and Rescinding Resolution No.
2004 -2186
BACKGROUND/ DISCUSSION
Update of fees and deposits for land use development entitlement processing, and
establishment of real time billing rates occurred in 2004 per Resolution No. 2004 -2186
(Attachment). Since that time, staff billing rates have changed based on cost of living
adjustments (COLA's) over the past two years. The fee /deposit schedule needs to be
updated to reflect those changes in City cost and to ensure that fixed fees represent the
actual cost of the service provided.
California Government Code Section 66014 provides for cities to charge fees to recover
the costs associated with processing land development zoning and use permit
applications. Section 66016 sets forth the notification and hearing process required
prior to levying new fees or service charges, or prior to increasing an existing fee or
service charge. Notice of the City Council public meeting will be mailed and published
in accordance with those requirements.
STAFF RECOMMENDATION
Set a City Council Public Hearing for July 19, 2006 to consider a Resolution approving
adjustments to real time billing rates, updating the schedule of land development
preliminary processing fee deposits, and rescinding Resolution No. 2004 -2186.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, ESTABLISHING A SCHEDULE OF
LAND USE DEVELOPMENT PRELIMINARY PROCESSING FEE
DEPOSITS AND RESCINDING RESOLUTION NO. 99 -1659
WHEREAS, the City of Moorpark provides land use development
planning services; and
WHEREAS, the City Council has determined that the cost of
these services shall be offset by fees which accompany land use
entitlement requests; and
WHEREAS, the Community Development Department staff costs
are charged against fees, based upon real time cost accounting;
and
WHEREAS, on September 23, 2003, the City Council did
consider and adopt Ordinance No. 297 which amended the Zoning
Code relating to entitlement process and procedures; and
WHEREAS, Ordinance 297 established modified categories for
entitlement process; and
WHEREAS, a fee for such entitlements are necessary; and
WHEREAS, it is necessary to differentiate within certain
fee categories, fees consistent with the demands for staff time
for specific forms of applications.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The City of Moorpark staff shall bill actual
time spent on land use applications and other at a real time
cost accounting rate per Table 1.
SECTION 2. Contract services shall be billed at cost,

City Engineer, except where otherwise specified; City Attorney;
geotechnical /geological services, landscape architect review and
inspection services; lighting engineer review and inspection
services and planning consultant services.

SECTION 3. The Community Development Code Compliance
Officer shall bill actual time spent on land use application and
other items eligible for cost recovery at a real time cost
accounting rate per Table 1.
SECTION 4. The Administrative Services staff shall bill
actual time spent on land use application and other items
eligible for cost recovery at a real time cost accounting rate
per Table 1.
SECTION 5. The Community Development Director has the
authority to reduce certain deposit amounts up to fifty percent
(50 %), where the project involves multiple applications of the
same type of project on the same property, to be processed
concurrently.
SECTION 6. The Schedule of Land Development Preliminary
Processing Fee Deposits shall be identified as those revised
fees show in "Exhibit A" to this Resolution
SECTION 7. This Resolution shall become effective sixty
(60) days following the public meeting held on May 5, 2004,
pursuant to Government Code Section 66016, (July 4, 2004)
implementing those changes to the fees described herein
immediately upon the effective date set forth herein.
SECTION 8. Resolution No. 99 -1659 adopted the 6th day of
October, 1999, is hereby rescinded upon the effective date of
this Resolution.

Any remaining deposit amount left from entitlement processing shall be applied to condition compliance. Upon certificate of occupancy or final building permit, any remaining
condition compliance deposit
shall be returned after all costs are deducted for final processing. (Complete application submittal packages that meet all City of Moorpark requirements will result in reduced
