SUBJECT: Consider a Resolution Adjusting Real Time Billing Rates, Updating
the Schedule for Land Use Development Processing Fees and
Rescinding Resolution No. 2004 -2186
BACKGROUND /DISCUSSION
On June 21, 2006, the City Council set a public hearing for July 19, 2006, to consider
adjusting real time billing rates, updating the schedule for land use development
processing deposits and fees, and rescinding Resolution No. 2004 -2186. The most
recent update of fees and deposits for land use development entitlement processing,
and establishment of real time billing rates occurred in 2004 per Resolution No. 2004-
2186 (Attachment 1). Since that time, staff's billing rates have changed based on cost
of living adjustments (COLA's) totaling 8.6% over the past two years, and salary
adjustments based on the 2005 salary survey. The fee /deposit schedule needs to be
updated to reflect those changes in City cost and to ensure that fixed fees represent the
actual cost of the service provided. Also, additional staff positions that perform
entitlement processing and support functions have been included in the rate schedule.
A $270.00 fee has been added for preparing "Zoning Letters" in response to frequent
requests for information from lenders and prospective buyers on the status of a
property's zoning, entitlements and ability to re -build in case of significant damage or
destruction by natural causes. This fee covers the cost of staff time to research, verify
and compile the requested information. Also, fees for appeals of Community
Development Director determinations have been broken into two categories, those that
require public hearing notice (proposed at $360), and those that do not (proposed at
$240). All other fee and deposit amounts have been reviewed and adjusted to reflect
changes in hourly rates and staff positions performing the work. Attachment 2 provides
a comparison of the fee /deposit schedule adopted per Resolution No. 2004 -2186 and
the proposed rate schedule

In accordance with California Government Code Section 66016, which sets forth the
notification and hearing process required prior to levying new fees or service charges,
or prior to increasing an existing fee or service charge, notice of this City Council public
meeting has been mailed and published.
The draft Resolution (Attachment 3) provides the details of the proposed billing rate and
fee adjustments. In accordance with Government Code Section 66017, the proposed
deposit and fee schedule will be effective sixty (60) days following the adoption of the
Resolution.
ENVIRONMENTAL DOCUMENTATION
The Community Development Director has determined that the proposed adjusting real
time billing rates, updating the schedule for land use development processing fees is
exempt from the provisions of the California Environmental Quality Act (CEQA), in that
the action of the City Council does not involve the consideration of the approval of a
project.
STAFF RECOMMENDATION (Roll Call Vote)
Open the public hearing, take public testimony and close the public hearing; and
2. Adopt Resolution No. 2006- , approving adjustments to real time billing rates,
updating the schedule of land development preliminary processing fee deposits,
and rescinding Resolution No. 2004 -2186.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, ESTABLISHING A SCHEDULE OF
LAND USE DEVELOPMENT PRELIMINARY PROCESSING FEE
DEPOSITS AND RESCINDING RESOLUTION NO. 99 -1659
WHEREAS, the City of Moorpark provides land use development
planning services; and
WHEREAS, the City Council has determined that the cost of
these services shall be offset by fees which accompany land use
entitlement requests; and
WHEREAS, the Community Development Department staff costs
are charged against fees, based upon real time cost accounting;
and
WHEREAS, on September 23, 2003, the City Council did
consider and adopt Ordinance No. 297 which amended the Zoning
Code relating to entitlement process and procedures; and
WHEREAS, Ordinance 297 established modified categories for
entitlement process; and
WHEREAS, a fee for such entitlements are necessary; and
WHEREAS, it is necessary to differentiate within certain
fee categories, fees consistent with the demands for staff time
for specific forms of applications.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The City of Moorpark staff shall bill actual
time spent on land use applications and other at a real time
cost accounting rate per Table 1.
SECTION 2. Contract services shall be billed at cost,
plus fifteen percent (15%), including but not limited to the
City Engineer, except where otherwise specified; City Attorney;
geotechnical /geological services, landscape architect review and
inspection services; lighting engineer review and inspection
services and planning consultant services.

SECTION 3. The Community Development Code Compliance
Officer shall bill actual time spent on land use application and
other items eligible for cost recovery at a real time cost
accounting rate per Table 1.
SECTION 4. The Administrative Services staff shall bill
actual time spent on land use application and other items
eligible for cost recovery at a real time cost accounting rate
per Table 1.
SECTION 5. The Community Development Director has the
authority to reduce certain deposit amounts up to fifty percent
(50 %), where the project involves multiple applications of the
same type of project on the same property, to be processed
concurrently.
SECTION 6. The Schedule of Land Development Preliminary
Processing Fee Deposits shall be identified as those revised
fees show in "Exhibit A" to this Resolution
SECTION 7. This Resolution shall become effective sixty
(60) days following the public meeting held on May 5, 2004,
pursuant to Government Code Section 66016, (July 4, 2004)
implementing those changes to the fees described herein
immediately upon the effective date set forth herein.
SECTION 8. Resolution No. 99 -1659 adopted the 6th day of
October, 1999, is hereby rescinded upon the effective date of
this Resolution.

USE DEVELOPMENT PROCESSING FEES AND DEPOSITS,
AND RESCINDING RESOLUTION NO. 2004 -2186
WHEREAS, the City of Moorpark provides land use development services; and

California Environmental Quality Act (CEQA), in that the action of the City Council does

Any remaining deposit amount left from entitlement processing shall be applied to condition compliance. Upon certificate of occupancy or final building permit, any
remaining condition compliance deposit
shall be returned after all costs are deducted for final processing. (Complete application submittal packages that meet all City of Moorpark requirements will result in reduced processing costs)
Downtown Specific Plan Area
Planned Development Permit Fees for conversions of existing Single - Family dwellings to retail or offices in the Downtown Specific Plan Area shall not exceed one -half the fee in this Table, or,
