SUBJECT: Consider Request for Library Records
DISCUSSION
On June 27, the City sent a letter to the Interim Library Director, Alan Langville,
requesting certain library records. In a written response to the City, Mr. Langville stated
that our request was pending guidance from County Counsel and consideration by the
Library Commission.
The Library Commission is meeting on July 20 at which time it will discuss the City's
request for library records including patron files (name, address and phone number),
data on all library collection materials, and an inventory of all computers, office
equipment, furniture and other items used in conjunction with library operations. The
Library Commission's agenda report (Attachment A) indicates that the City's request will
have a cost and asks the Commission to provide direction on whether the Moorpark
Service Area should bear the expense. Additionally, the report indicates the County
Counsel has been asked to provide guidance on whether it is legally appropriate to
provide the City with patron files.
In response to legal questions, the City Attorney as pointed to Government Code
Section §6267, which reads as follows:
All registration and circulation records of any library which is in whole or in part
supported by public funds shall remain confidential and shall not be disclosed to
any person, local agency, or state agency except as follows:
library. (a) By a person acting within the scope of his or her duties within the administration of the

(c) By order of the appropriate superior court.

As used in this section, the term "registration records" includes any information which a library
requires a patron to provide in order to become eligible to borrow books and other materials,
and the term "circulation records" includes any information which identifies the patrons
borrowing particular books and other material.
This section shall not apply to statistical reports of registration and circulation nor to records of
fines collected by the library.
Subsection (a) appears to pertain to the City's situation.

LETTER FROM CITY OF MOORPARK
(June 27, 2006)
In your packet is a copy of a letter dated June 27,
2006 written by Mary Lindley,
Parks, Recreation & Community Services Director for the City of Moorpark
requesting various inventory and database information on the Moorpark Library.
A response was sent on July 3 (also in this packet) indicating that their initial
requested receipt date of July 7 could not be met, due to the need for direction from
County Counsel and this Commission.
The collection of this data for Moorpark will have a cost, and an estimate will be
available at the Commission meeting. Some of the information, such as an
inventory of furniture and equipment, will be very easy to provide. An inventory of
the collection is a more staff intensive project. Should these costs be bome by the
service area?
Additionally, County Counsel has been asked to provide guidance on these issues.
One issue is of particular concern: is it legal for us to turn over our patron files?
(And, if so, which names —all patron addresses within the city limits, or just patrons
who are registered at the Moorpark Library regardless of address, or?)
We request direction from the Commission on these issues.

Dear Alan:
I have enclosed a copy of the letter and resolution sent to each member of the
Library MOU for your files. To assist the City with its plans to assume operation
of the Moorpark Library, please provide the following by July 7, 2006:
1. MARC records for the collection belonging to the Moorpark Library;
2. The items' specific-information for the collection, including but not
limited to, branch, bar code, call number, and price; and
3. Machine readable patron files.
Additionally, please provide a comprehensive list of all of the materials,
equipment, and furniture in the Moorpark Library public use areas, including but
not limited to, collection shelving, public access and catalog computers, catalog
equipment, furniture (seating, tables, fixtures, etc.), and any other items available
for public use. We would like this information by July 31 so that we can begin
planning for purchases the City will need to make upon transfer of the Library.
assume that the Library System maintains current inventory records of its
collection, equipment, furniture, etc., cataloging and inventorying all purchases
as they are received, and that it will be able to provide the information by the
dates requested. If this is not the case, please let me know so that we can
discuss options.
appreciate all of the assistance you provided to the City and its consultant
during the completion of our recent library study. I know that your department is
short- staffed and that your resources are limited. I would like to work with you
and your staff to ensure a smooth transition of library service with minimal impact
to the public and to your staff.

This is to acknowledge receipt of your letter of June 27, 2006 requesting various
inventory and database information on the Moorpark Library. We will not be able to
meet your initial requested date of July 7.
County Counsel has been asked to provide us with guidance on several issues that
your request has raised. Additionally, this request needs to go to the Library
Commission at its next meeting on July 20, so that they may provide direction to
library staff.
After the Commission meeting, it may be appropriate for us to meet to discuss
transition issues. We will be contacting you.
