SUBJECT: Consider Adoption of a Resolution Stating the City Council's Intent
to Establish the Moorpark City Library and Request to Join the
Metropolitan Cooperative Library Services
DISCUSSION
In order to join a state library cooperative and to be eligible for state Public Library
Funds (PLF) the City's library must be recognized by the State Library Board (Board).
The Board meets once a year, in mid September. This year the Board will meet in
Sacramento on September 14. According to the state Education Code, establishment of
a public library must be done by ordinance. There is not sufficient time between now
and the Board's September meeting to consider an ordinance. Therefore, staff is
requesting that the Council consider the adoption of the attached resolution (Attachment
A) indicating the City's intent to consider an ordinance establishing the Moorpark City
Library at its next regularly scheduled meeting on September 20, 2006.
Education Code Section 18900 et. seq., which requires the adoption of an ordinance
establishing a public library also set forth regulations and maintenance of public libraries
including the establishment of a library board (see attachment B). Staff believes that
these provisions are consistent with the Council's discussion of a library committee or
commission. Some cities have established library boards comprised of its City Council
and others have appointed community members.
The requirement to adopt a ordinance establishing a public library in order to participate
in a state library cooperative and to be eligible for state PLF, along with the need to
seek recognition by the State Library Board and its meeting schedule were only made
known to staff on August 14, 2006. Staff has spoken to representatives from the State
Library Agency and they have stated that due to the time constrains, which prevents the
City from considering the adoption of an ordinance by the September Board meeting

date, that the resolution of intent would be acceptable. State Library staff have agreed
to include Moorpark's request on the Board's agenda.
In addition to recognition of the Moorpark City Library, and Board must also approve the
City's membership in a library cooperative. Library cooperatives facilitate book loans
between library systems and provide other services to their member agencies. Staff
recommends that Moorpark request membership in the Metropolitan Cooperative
Library Services (MCLS). This is the same cooperative that the Thousand Oaks,
Oxnard, and Los Angeles city libraries belong to, along with most city libraries in Los
Angeles County. Membership costs approximately $4,000 annually. The current MCLS
membership must approve Moorpark's request. The MCLS board meets next week.
Staff has already made contact with the MCLS director who has indicated that she will
agendize Moorpark's request. If MCLS accepts Moorpark's membership, they will notify
the State Library Board which will have final approval.

RESOLUTION NO. 2006-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, STATING INTENT TO
ESTABLISH THE MOORPARK CITY LIBRARY
WHEREAS, effective January 15, 1998 the City of Moorpark entered into a
Memorandum of Understanding between the Ventura County Free Library System and
the Cities of Camarillo, Fillmore, Ojai, Port Hueneme, San Buenaventura, and Simi
Valley relating to the joint operation of library services in Ventura County;
WHEREAS, on June 21, 2006, the City Council adopted Resolution No. 2006-
2479 withdrawing from the Ventura County Library effective January 1, 2007;
WHEREAS, Resolution No. 2006 -2479 withdrawing from the Ventura County
Library System effective January 1, 2007;
WHEREAS, Resolution No. 2006 -2479 states the City's intent to undertake
provision of public library services;
WHEREAS, the City of Moorpark has the authority to establish a public municipal
library pursuant to the California Education Code § 18900 et seq.; and
WHEREAS, the California State Library Board will conduct its annual meeting on
September 14, 2006, and the City wishes the Board to consider recognition of the
Moorpark City Library for purposes of Public Library Funds and Cooperative Library
Service Act.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. On September 20, 2007, the Moorpark City Council shall consider the
adoption of an ordinance establishing the Moorpark City Library as set forth in California
Education Code § 18900 et seq., including provisions for regulation and maintenance of
a public library system provided therein. With the adoption of said ordinance, the
Moorpark City Library shall be established effective January 1, 2007, the same day as it
stops being a member of the Ventura County Free Library System. 2. The

City Council intends to request membership in the Metropolitan Cooperative Library
System.
SECTION 2. The City Council directs its staff to request membership in the
Metropolitan Cooperative Library System.
SECTION 3. The City Clerk shall certify to the adoption of this resolution and
shall cause a certified resolution to be filed in the book of original resolutions.

EDUCATION CODE
SECTION 18910 -18927
18910. The public library shall be managed by a board of library
trustees, consisting of five members, to be appointed by the mayor,
president of the board of trustees, or other executive head of the
municipality, with the consent of the legislative body of the
municipality.
18911. The trustees shall hold office for three years. The members
of the first board appointed shall so classify themselves by lot
that one of their number shall go out of office at the end of the
current fiscal year, two at the end of one year thereafter, and two
at the end of two years thereafter.
The legislative body of the municipality may, by ordinance,
provide for the compensation of such trustees; provided that the
respective compensation for such trustees shall not exceed fifty
dollars ($50) per month.
18912. Men and women are equally eligible to appointment as
trustees.
18913. Vacancies shall be filled by appointment for the unexpired
term in the same manner as the original appointments are made.
18914. Boards of library trustees shall meet at least once a month
at such times and places as they may fix by resolution.
18915. Special meetings may be called at any time by three
trustees, by written notice served upon each member at least three
hours before the time specified for the proposed meeting.
18916. A majority of the board shall constitute a quorum for the
transaction of business.
18917. The board shall appoint one of its number president, who
shall serve for one year and until his successor is appointed, and in
his absence shall select a president pro tem.
18918. The board shall cause a proper record of its proceedings to
be kept.
18919. The board of library trustees may make and enforce all
rules, regulations, and bylaws necessary for the administration,
government, and protection of the libraries under its management, and
all property belonging thereto.
18920. The board of library trustees may administer any trust
declared or created for the library, and receive by gift, devise, or
bequest and hold in trust or otherwise, property situated in this

state or elsewhere, and where not otherwise provided, dispose of the
property for the benefit of the library.
18921. The board of library trustees may prescribe the duties and
powers of the librarian, secretary, and other officers and employees
of the library; determine the number of and appoint all officers and
employees, and fix their compensation. The officers and employees
shall hold their offices or positions at the pleasure of the board.
18922. The board of library trustees may purchase necessary books,
journals, publications, and other personal property.
18923. The board of library trustees may purchase real property,
and erect or rent and equip, such buildings or rooms, as may be
necessary, when in its judgment a suitable building, or portion
thereof, has not been provided by the legislative body of the
municipality for the library.
18924. The board of library trustees may request the appropriate
state officials to furnish the library with copies of any and all
reports, laws, and other publications of the state not otherwise
disposed of by law.
18925. The board of library trustees may borrow books from, lend
books to, and exchange books with other libraries, and may allow
nonresidents to borrow books upon such conditions as the board may
prescribe.
18926. The board of library trustees may do and perform any and all
other acts and things necessary or proper to carry out the
provisions of this chapter.
18927. The board of library trustees, or if there is no board of
trustees, then the administrative head of the library shall, on or
before August 31st, in each year, report to the legislative body of
the municipality and to the State Librarian on the condition of the
library, for the year ending the 30th day of June preceding. The
reports shall, in addition to other matters deemed expedient by the
board of trustees or administrative head of the library, contain such
statistical and other information as is deemed desirable by the
State Librarian. For this purpose the State Librarian may send to
the several boards of trustees or administrative heads of the library
instructions or question blanks so as to obtain the material for a
comparative study of library conditions in the state.
