SUBJECT: Approval of Plans and Specifications and Authorization to Advertise
for Bids for the Magnolia Park Street Improvement Project
BACKGROUND
The FY 2006/07 Budget includes Project 7816 for the construction of a park at the
southwest corner of Charles Street and Magnolia Street. The City recently completed
efforts related to the vacation of a portion of Magnolia Street south of Charles Street, in
order to include that "vacated" street segment in the park property. The plans and
specifications for the removal of the street improvements are completed and staff
intends to proceed with the construction of the first phase of the improvements
necessary to construct the park.
DISCUSSION
A. Phase 1 Project Description
The plans and specifications are for the removal of street improvements at the
vicinity of the future park site and the reconstruction of street improvements
required to facilitate the future park improvement project. Attachment 1 depicts the
street and site work to be constructed for this phase 1 work.

1. Cost Estimate: A preliminary estimate of total project costs (street work and
park improvement costs) is as follows:

2. Budget: There are sufficient funds appropriated for the design and
construction of both the subject street work and the future park improvements.

C. Plans and Specifications
A copy of the Plans and Specifications for the subject project has been placed on
top of the file cabinets in the City Council Conference Room.
D. Project Approval -- Design Immunity
It is recommended that the City Council approve the project plans and
specifications in order to document City Council approval of the scope and design
of the project. Such approval is also required for the purpose of establishing
design immunity pursuant to Section 830.6 of the Government Code of the State
of California.

E. Schedule
It is anticipated that bids for the subject project will be solicited in October 2006.
Construction should start in December 2006 and be completed by February 2007.
F. City Manager Approved Contract
The Public Contracts Code allows construction contracts for projects costing less
than $100,000 to be approved by staff. The estimated construction cost for the
subject project is $75,000. Accordingly, it is the intent of staff to award a contract
to the lowest responsible /responsive bidder, subsequent to the opening and
evaluation of bids. It is recommended below, therefore, that the City Manager be
authorized to execute a construction contract for this project not to exceed
$75,000. In the event that the bids are higher than $75,000, staff will return to the
City Council for approval of the contract award.
G. Notice of Exemption
A Notice of Exemption will be prepared by the Community Development
Department and will be filed with the County Clerk's Office in accordance with
California Environmental Quality Act.
STAFF RECOMMENDATIONS
1. Approve the plans and specifications for the Magnolia Park Street Improvement
Project and authorize staff to advertise for the solicitation of construction bids for
the project.
2. Authorize the City Manager to execute a contract for the construction of the
subject project, based on a bid prepared, submitted, reviewed and approved in
accordance with applicable State and City requirements and regulations.
